MERRICK The City Attorney reported that he had written a s,-m~n~y of SDR-244 findings regarding this matter and had advised Mr, Metrick ~errick that there is no riEht of appeal from a buildin~ site approval decision. Mr, Joseph Bonacina, Attorney for Mr, Metrick, asked that the anttar be continued to the next meetin~ and with the concensus of the Council~ the Mayor so ordered, V NEW BUSINESS A. SDI~-221 JAMES TRUMAN Conneilman Glennon moved, seconded by Councilman Drake to approve SDR-221 Tr~-nn- Resolution SDP.-221-i, granting building site approval to Jznes Truman for ~wo lots on Verde Vista Lane, Motion carried unanimouslyo B. SDR-202 - PF~RRY POLENTZ SDR-202 Councilman Drake moved to ~dopt Resolution SDR-202-1s approving Polen~z three lots on Vieleery Avenue as building sites for Perry Po!entz, CoUncll~n~ Hc;-t--~n seconded the motion which carried unanimously, C. Motion carried unanimously, After discussion of a Flood Control condition regardinn fencing, the Mayor ordered~ without objections that the matter be referred to the next meeting and in ~he interims the Director of Public Works will prepare an estimnte of the amoun= of bond required for Construction and maintenance of the fence ~md will obtain from Flood Control a written comunicztion reEardinE removal of the fencing condition, VI ADMINISTRATIVE NATTEaS A. CITY ATTORNEY (1) Councilmen Har~m~n moved, seconded by Coun~ilnmn La, X~will Seven Oaks Homes~ Inc.- to deny the claim of Seven Oaks lierues, Inc. which was Claim referred to the City Attorney at ~he las~ meeting. (2) The City Attorney zeported that the letter from Lee B. Jones truck and Company relative to damages to a truck belonging to accident - Lee Jones Co, their clten=~ Peninsula Bullet Expresss has been fordarded to our insurance coupany and no action is r~qutred of the Council. (3) Cl~y Attorney announced that a suit has been filed by Moyer vs, Moyer versus Laderos City of Sa.'.-atoga~ and others~ in City connection with the development of Argonaut Shopping Cents=s and that he is tic. king the necessary steps to pro- teat the ctty's interests. (4) City Attorney reported that he has written to Aaron Cohen~ Lark Way Attorney for Mr, Will Jacobs, axplalntng why Lark Way is not a cl~y street and ~herefore falls under the sun, ey the cl~y is currently condu~atng of privately c~ned streets within the city, (5) Tee City Attorney amnounced that he has written an opinion regarding a gazbage collectZou problem involving the William Kruse Kruse~ss and Dzo Broenmer and the Los Canoe Scavenger Garbage Company. He reviewed the history of the case and referred to a letter from the Health Department advoaattn~ that the City do something to alleviate the serious garbage problem which e~xtsts at the Kruse residence, Councilman Glennon moved, seconded by Councilmen Drake Co request the Los Gatos Scavenger Company to resume garbsge service for the Kruse residence, Morton carried unanimously. ITTEN COMMUNICATIONS (1) ~le Clerk read a letter from Campbell school distric~ Crossing requesting the council to reto/n, during the next school Guard- Campbell year, the crossing guard at Quito and Mccoy, The matter School District was referred ~o the budget study for fiscal year 1961-62. The Mayor announced for council informa~ion that there is presently before the State legislature a bill which would allow schools to pay for crossing guards, Freeway (2) The City Adm~niStrator reported that the executed agreemen~ Agreeinput with the S~.a~e for the West Valley Freeway has been received, B.
