C-31 - BROI~ AND KAUFNAN The Clerk ~nnounced that the PlanninE Coa~ission has 'rec~ended that final approval of requested change of zoning at Titus and Rell- ~Yood Avenues from "A" to Ri:B2 be ~tthheld until tentative map for C-31 ~ublic the area has been approved by the Flnnnin~ Co~mlission. The Public hearin~ was opened and the Clerk stated there were no written Brown & Kaufm~n con~unications on file in response to the published notice o~ hearing. Ord. 3A-ZC-17 Nr. Splitstone, representin~ Brown and Kaufman spoke in favor of the re-zonin~ and stated that the tentative map for the area will be based on 12,500 square ~oot lots. There being no further conmunicatioux either approvir~ or opposing the application, the Clerk introduced Ordinance 3A-ZC-lY and the 14ayor directed~ without objection, that the hearing be continued to the u~xt meeting° IV OLD BUSINESS A. Joseph Bonacina~ Attorney ~or l~r. Ne~Tick. l(ro Bonacina spoke at length, advoca~in~ that~ although the lot had been created in violation of Ordinance 3A-8~ the Council allow l~r. Netrick building site app~_'oval, He su~.ested they could legally do this by ~nendin~ Ordinance 3A-8. The City Attorney reviewed the action which has been taken and advised the Council not to act on this matter. 2he Nayor, without obJection~ ordered the matter stricken ~rcm the agenda. B. TRACT 2032 A~ter discussion, Council~_~n Glennon moved, seconded by Councilman Tr.2032 Har~rnnn to reduce the fimprovement bond for Tract 2032 to ~10,000. Bond reduction in accordance with recounendaticn of th~ Director of Public ~orks. P~tlon carried enanimously. The City Attorney reported that the new subdivision o~dinance will include provision for reduction of original inprovement bonds where the deficiencies~ after the years maintenance patiodin are minor. Recess and Reconvened. V N~4 BUSINESS A. The Clerk introduced an agreement with the County of Santa Clara for A~=eement reimbursement for acquisition of rights-of-way for widening Highway #9 County - R/W cost north of the rail-road tracks. After discusslon~ the matter was Hwy ~9 referred to the 8ity Administrator with the directave that he endeavor to obtain from the County a~ overall cost estimate and a cost estimate for removal and relocatiou of utilities, B. SDR-220 AGNES LYNCH SDR-220 Councilman Drake moveds seconded by Councilman ~n~tman to adopt Lynch Resolution SDR-220-1s Srantin~ building si~'e approval to ~es Lynch for one lot on Foothill Lane, Motion carried unanimously. C. SDR-249 ROBL~.RT BARTIlOLD, JR. SDR-249 Councilman L~il l moved to adept Resolution SLR-249-1., approvin~ Ba~thold buildang site of Robert Barthold~ Jr, on Lanark Lane, Motion seconded by Councilmen Glennon and carried unanimously, SDR-260 Councilman Harman moved~ seconded By Counci]m~n Drake to adopt Barlow Resolution SD?.-260-1, approvins one lot buildins site located on Sprinter Avenue, c~ned by ReSina~_d Barlo~,;. Motion carried unanimously. C. SDR-267 PHILIP LIVELY SDR-267 COuncilman Har~n~n moved, seconded by Councilman Drake to adopt Lively Resolution SDR-267-1, approvins buildin~ sate of Philip Lively located off Sobey Ro~d. Motion carried unau/mously. VI AD~INIS~u~TIVE I'~TTERS A. MAYOR MAyor snnnunced that the matter of employment of a zoning administrator would be taken up a= a special meeting tomorrow night. B. FINANCE. Disburse- (1) Councilman Drake moved that the disbursements listed in the ments amount of $2s709.14 be approved and warrants be drawu in payment. M~tion seconded by Councilman Hart~a~ and carried unanimously. (2) The Treas~rer~s report for the month of Match was distributed Treasurer and the Treasurer reported that the balance of the bonds Report purchased would be mailed by the Federal Reserve Bank by' the end of the week~ C. COP~fITTEES (1) After discussions Councilman Langwill moved that the report of the special connuittee for study of curbs and gutters in sub- Street Standards - 1 acre lots divisious of one-acre lots or mores be approved and the street standards recommended be-incorporated iu the subdivision ordinance. Councilman Drake seconded the motion; carried unanimously. (2) The City Administrator announced that the Planning recommends tha~ the 50 foot buffer strips alon~ the freeway be Freeway Buffer Strips denied on the basis of cost, Councilman DraP~ mc~ed~ seconded by Councilman Glennon tha~ ~he City Admiuistrator informMr, Livingston that the Council does not wish to provide for the additional buffer strips because of the cost involved, carried unanimously, (3) The Council briefly reviewed a st!eat pattern proposal for the Street area roughly bordered by P~ospect, Righwa9 ~9 and CoX Avenue. Pattern No. of The plan was received from the Plannin~ Consultant and indicates Cox landscaping along the freeway end on cartabs streets. (4)The Mayor announced that, as a member of the Public ~orks Comm{ttees he had met with the Director of Publid ~orks and Herr~ Avenue a representative of the State D~v~sion of ~ighways to discuss design problems regardin~ the HerrimanAvenue Bridge. He reported that the meeting did not resolve any issues ands after Council discussions the m~tter was referred back to the Public ~orks Comm{ttee for recommendation. D.CITYATTORNEY No reports E.
