UP-30 On advice of City Attorneys item was withdrawn from a~enda as

VI OLD BUSINESS
A. WESTBROOK SUBDIVISION ANNEXATION REQUEST
Clerk reported that nothing further has been received fro~ the
applicants in this matter and City Attorney s rated that conversa-
tions he has had recently with representatives of the area indicates
Westbrook that they are awaiting council reaction to the Staff survey report
Annexation before they proceed with further expanses,
Request
Council discussed the Staff survey report briefly and~ concurring
with Councilman Drake that a matter of this import shosald have the
consideration of the full coancil, the Mayor pro tem directeds with
no objections that the matter be referred to the next meeting for
council expression of policy regarding the Westbrook annexation
request,

B. HIGI~/AY ~9 LMPROVEF~T PROPOSAL
City Administrator read the formal ~oposal for improvement to
Highway ~9 as drafted by the Director of Public Works and council
reviewed their copies of the proposal and attached engineering
data and mop, Mayor pro tom stated that this is a generalized
Hwy, ~9 description of the imprnvoment as it can not be precise until it
Improvement goes to the Division of Highways after it has been presented to the
Proposal County Board of Supervisors for their approval and cooperation, He
explained that the 90 foot plan lines would not change but that
width of right of way would vary because of areas to be ch8~elizeds
etc.s and that it is proposed to ask the cooperation of the Santa
Clara County Board of Supervisors in extending the existing agree-
ment for rights of way acquisition north of the railway tracks to
cover acquisition of =i~hts of way for the current proposals with
the same provision for repayment by the City from trafficways money,
~After discussion, Councilman Hartman moved, seconded by Councilman
x~n~ill to accept the propossl for improv~nt to Highway ~9 as
~rltten by the Director of Public Works, and that it be transmitted
to the Board of Supervisors at itws meeting of D~cember 11, 1961,~
accompanied by a cover let~er, signed by the F.~yor, stating the
couneilws position and requesting the Countyts participation in th9
financing of the p~:oposed improvenmnto t4otion carried tmanimously:
and council agreed that all who can should attend the Board of
Supervisors meeting on ~onday and City Administrator will advise
them when the matter will be on the agenda.
C. SDR-136 - SACRED HEART CHURCH
With no objection, a request to continue use of the old entrance
SDR-136 in addition to the now twosway entrance at Sacred Heart Chorch,
Sacred was held over to the next meeting and the staff was directed to
Heart transmit to Father Cea~.*:y of Sac~ed Heart Parish, a copy of the
Drivew~ys staff report end plan for his study end comment; and to advise
him that the matter will coma. up for council action at the
meeting,

Clerk read a request from F~, & ~s, Norman goepernik for a one
year extension of time in wh~.ch to meet conditions of their building
site approv~l agre~r~ut~ whicJ~ e_x. pires January 18, 1961o Clerk

Liability injuries in the amount of $71,500,00 filed by Roy Cox, ~ Cox
Claim - and Roy Cox as guardian o~ his minor children~ of 185~2 Raven-
Cox,st al wood Drive, Saratoga. Councilman Hartr~nn moved, seconded by
Councilman Lan~will to reject the claim and refer it to the

C. COI~ITTEES AND REPORTS
(1) Nr. Charles Earlay0 Chairran o£ the Saratoga Library Comission
briefly re,Tie~ed the Library Co,-.~.ission report which had been,
~ailed to the council m~bers. Council cozenended 1~. Earlay
for the comprehensiveness of the report and Nr. Earley genera!ly
Library outllned the re. com~ndation of the Library Co~.{ssion that the
Commission City build a new library buildin~ at the Civic Center site to

the present library buildin~ be used as a branch libraryo
Council discussed the status of. rental negotiations for the

(1) City Administrator submitted plans and cost est!mn_~es for a
footpath from Sat'aroma Avenue to Fruitwale School and reported
that the staff su8Eests that the council consider the installa-
