SDR-387 Councilman Glennon moved, seconded by Councilman Hartman, to deny Otto, the request For storm water.fee credits in connection with SDR-387, Storm based on advice from the City Attorney that the present subdivision l?ater ordinance does not allow credit For storm water fees for Facilities Fees constructed as a requirement of Santa Clara County Flood Control District. MAYOR (1} Mayor reported that the Board of Supervisors of Santa Clara County, at a meetin~ held February 2S, 1963, approved the City's Highway #9 request for allocation of Funds for acquisition of rights-of-way widenin~ on Highway #9. Director of Public Tqorks reported there is some question as to which jurisdiction will handle the acquisition of rights-of-way and submitted a conference memorandum of his meetin~ of March S, 1963, with officials of the State Division of }Ii~hways. Council discussed major items which differed from their previous understandin~p of the proposed a~oTeement for improve- ment to Highway #9. These item~s were~ briefly: (1} The State's reluctance to enter a three party agreement for acquisition of riehts-of-way; (2} The State's proposal to participate in stor~ drain installation only to the extent of $32~000., their estimated cost for an open channel alon~ the hiehway; and (3) the State's proposed time schedule whereby work would not be put to bid until Spring, 196S. Councilman Glennon moved, seconded by Councilman Hartman to direct the Mayor to write a letter to Assistant State Highway Engineer J. p; sinclair in an effort to speed negotiations and effect improvement tO Highway #9 as soon as possible; Motion carried unanimously. {2) Councilman Glennon moved, seconded by Councilman Ritchie, to S.B.3~4 direct the Mayor to transmit to the State Legislature the Council's HighWay full and enthusiastic endorsement of Sen Bill #344, known as User tax the Collier Bill, providin~ for additional funds for city streets by increasing highway user taxes. ~fotion carried unanimously. I.C.C. (3} ~ayor announced that the Inter-City Council will meet tomorrow meeting evenin~ at the Los Gatos Lodge in Los Gatos. League {4) Mayor requested that reservations be made by ~arch 18, through Calif. Cities the City Clerk, by those council members who wish to attend the Meeting March 21 meeting of the Peninsula Division of the League of California Cities. L.G.U.H.S. (5) Mayor Brazil read a draft of a letter to the Los Gatos Hieh Third School Board of Trustees protesting a pronosal for a third High School high school site within the City of Saratoga, and Councilman Site Hartman moved, seconded by Councilman Rithcie to authorize the Mayor to transmit this letter to the School Board. Motion carried unanimously. B. FINANCE. Councilman Drake arrived at 9:4S P. ~., durin~ discussion of the list of disbursements presented for council consideration. Bills Councilman Ritchie moved, seconded by Councilman Glennon to approve the disbursements on the list dated ~rch 7, 1963, totalin~ $90,001.~, and authorize that warrants be~ drawn in payment. Motion carried unanimously. C; COUNCIL CO~{ITTEE REPORTS (1) Councilman Ritchie submitted a report, dated March 6, 1963, from Str$~t the Public Facilities Committee, re~ardin~ a request for acquisi- Swedper tion of a street sweeper . Councilman Ritchie moved, seconded by Councilman Glennon, to adopt the report, acceptin~ the findings that a street sweeper is not in keenlug with a minimutn service city and the recommendation for an annual review of the extent of street sweeping services required. ~tion carried unanimously. County (2} Councilman Hartman moved, seconded by Councilman Glennon~ that a ~ater resolution be prepared endorsin~ the pronosal for a County-wide Commission water importation program, as presented to the Santa Clara County Proposal Board of Supervisors by the l~ater Commission, and indicating the City o{ Saratoga's willingness to supDort a bond issue for financine the proposal. DEPARTmeNT }.lEADS AND OFFICERS (1} Director of Public lqo:;'ks reported, in connection with Council Sousa Lane authorization for the removal of the most northerly eucalyptus Eucalyptus tree at the entrance to Sousa Lane, that the tree is located on Tree private right of way. Council directed him to inform the interes- ted property o~ners of this and Director of Public i!!orks reported that a recent conversation ~dth one of the o,ners indicated that they ;~ill assume responsibility for removal of the tree. (2) Deputy Clerk read a ~eport from the Plannin~ Director dated Zonin~ Ord. March 1, 1963, transmittin~ a recommendation from the Planning Amendment Commission, that an amendment to the Zonin~ Ordinance be drafted, re agricultural providing for the limited keepin~ of livestock, as a~ricultural projects club projects, in residential zones. qayor directed, with Council approval, that the City Attorney draw uo the proposed amendment and cont~c~ the Planning Commission For clarification of certain recommendations, if necessary. (~) Planning Director Stanley l~alker read a report, dated ~arch 1963, regarding the Parks and Recreation pro~r,~n, listin~ several recommendations relative fo appraisal~ land acquisition, swimming Parks and pool facilities, and preliminary architectural designs for a Recreation community center. The re~ort also outlined a suggested ceneral Program schedule of action For the City Council in brin~in~ the Parks and Recreation program to a vote by the first 9art of July, 1963. Council discussed the various recommendations and noted that, although the time schedule recommended 'is favorable, it must be reflarded as a target which is contingent on related matters, such as negotiations re~arding library Facilities and s~d~unin~ noel facilities at the high school. It was agreed ~hat it would be advantageous to form a small co,~mittee of not more than two representatives to ~eet with a sub-committee of the High School Board in an effort ~o come uO with a proposal for s~imming pool facilities in line with the Council's desire to nroceed wit~ the parks and recreation Councilman Glennon moved, seconded by Councilman Hartman, t~ authorize the Staff to spend up to $1,000. for (1) Architect !~arren Heid to dra~ up preliminary site development plans; and for (2) land appraisal costs For acquisition of park sites anti rights-of-way for hathways. Mot' n carried unanimously. · 10 Emerg. Zone. Mr. Bernie Dove, of the Parks and Recreation Committee, reported Ord. Amend. that the seven acres adjacent to the Fruitvale School, which was re park site recommended for a park site, is no longer available and that the' Committee's alternate recormuendation was to acquire the 15 acres south of that area. Authorization was ~iven for the Staff to'draft an amendment to the Emergency Zonin~ Ordinance, reservin~ lands planned for future park sites, in accordance with the above recommendation. Storm (4) Administrative Aide reported that he has comniled a report of Damage expenses incurred for correction of damages caused by the recent Report storm and will transmit it to the Council within the next few days. VIII COr~{UNICATIONS A. WRITTEN Swimming Council received copies of a letter from ~{rs. t'zilliam Baskin, advisin~ Pool t~em of her attempts to investigate the feasibility of acquirin~ a swimming pool in Saratoga through a "tile subscription" program. B. ORAL Mayor Brazil acknowledged, with gratitude, the presence of Plannin~ Commissioner Crisp throughout the meetinR.
