Mayor Glennon called the meeting to order at 7:30 P.

Councilman liarman moved, seconded by Councilman Tyler to waive the
reading and approve the minutes of the August 21, 1963 meetin~ as
distributed. Motion carried unanimously.
II BIDS A~ CONTRACTS
A. CONTRACT I~ITH SAN JOSE WATER WORKS FOR T.~IN EXTENSIgN AL~]C F~UITVALE
AVENUE TO SEP. VE CIVIC CENTER SITE.
San Jose City Administrator requested that this matter be held over to the
I~ater Works next meeting as there were several aspects he would like to have

B. .REQUEST FOR AUTHORIZATION TO ADVERTISE FOR BIDS FOR I~ROVE~tEI~T
OF HERRI~N AVENUE
Director of Public !~orks reported that the plans and specifications
Herriman for the balance of the Herriman Avenue improvement project have been
Avenue prepared in accordance with requirements for projects to be financed
Bids by Gas Tax funds and that the improvement will be to the same
standards as the previously L~proved portion of the street. He
stated that all underground facilities are now installed, with the
exception of two homes which have not been connected to the se~mr.
Councilman Brazil moved, seconded by Councilman Harman, to authorize
the City Administrator to advertise for bids for improvement of
Herriman Avenue. Motion carried unanimously,
C. BIN-TYPE RETAINING I.~ALL OM PORTIOH OF BOH~4AN .ROAD
Bohlman City Administrator requested authorization to advertise for bids
Road for construction of a bin-type retainin~ wall on a portion of Bohlman
Retaining Road to prevent slides like those of last winter from recurring. He
I~11 Bids stated that he hopes to finance this project from the funds budgeted
for services in the Public Works Department but that it is possible'
that the bids might exceed the mount ori~inally authorized.
Director of Public Works described the construction proposed and
reported that it has been recommended as a result of the soil tests
which were previously authorized for this area.
Councilman Brazil moved, seconded by Councilman Hartman, to authorize
the City Administrator to advertise for bids for a bin-type retaining
wall as requested. Motion carried unanimously.

III ORDINANCES A[rD FOR!"~L RESOLUTIONS
A. RESOLUTION NO. 162
City Administrator explained that it is necessary for legal reasons
Res. 162 to distinguish capital outlay funds as opposed to surplus and
Civic Center operatin~ revenues to insure that authorized capital improvements
Improvement are not financed by current revenues and taxes. Resolution No. 162
Fund provides for the creation of a Civic Center Improvement Fund by
transferring $160,000 to it from the General Fund unappropriated
surplus and appropriating this stn for Civic Center Improvement
(primarily council chambers) as scheduled in the budget.
Mr. Walter Vaughn asked x~hy the matter of constructing a library
had been put on the ballot as a bond issue if the City has sufficient
funds to construct one. Mr. Vau~hn stated that he felt that a~y
improvement projects financed by surplus city funds should be subject
to the approval of the electorate.
Hayor Glennon advised Mr. Vaughn that although the Council has the
authority to appropriate surplus funds for construction of any
civic improveraents, it had chosen to present the library matter
to the voters because it is a part of the County library system
and the Council is willing to use some of the Ctty*s bondinE capacity
for a library if it is in a central location. ~ox~ever, the r{ayor
indicated that there is no question of the Council*s right to
authorize other needed civic center improvements, s~ch as a council
ehambers~ on the civic center site since the people retain the
ultimate power ~o approve or reject the Council at election time.
Councilman Brazil moved, seconded by Councilman Hartman, to adopt
Resolution No. 162 as presented. Motion carried unanimously.
IV SUBDIVISIONS A~ BUILDING SITES
A. SDR-442 - PAUL GIRAUDO
SDR-442
Giraudo Councilman Hartman moved, seconded by Councilman Brazil, to adopt
Resolution Mo. SDR-442-1, grantin~ buildin~ site approval to Paul
Giraudo for one legally non-conforming lot on Reid Lane. ~tion
carried unanimously.
B. TRACT 2967 - KIPI~!ONT
Tr. 2967 Councilman Brazil moved, seconded by Councilman !iartman, to accept
Const. the improvements in Tract 2967, Kirla~ont, for construction only -
Accept. with the one year maintenance period to begin. Motion carried
unanimously.

Farnsworth Councilman Brazil moved, seconded by Councilman Hartman, to approve
the Minimum Access 'Road Reimbursement Agreement for Ralph Farnsworth
Reimbursement
Agreement for construction of an access road to a building site off Sobey
Road, subject to receipt of Mr. Farnsworth*s statement under oath
of the actual construction costs incurred. ~!otion carried unanimously.
V PUBLIC HEARIHCS -
A & C A. C-59 - A & G INVESTMENT CO}~A~
Invest. Co.
C-59 Public Hearing was opened on the application of A & G Investment
Withdrawn Company to fezone from A to ~.~I-4,000-X approximately 6 1/2
acres of property bounded on the north by Prospect Avenue, on the
south by Calabazas Creek and on the East by C-N zone,
City Administrator read a letter from the applicant requestin~ that
the rezoning application No. C-59 be ~ithdrawn, without prejudice.
City Attorney advised that by having an application for rezoning
vlthdrawn ~ithout prejudice an avplicant can refile his anplication
without waiting the required year, Planning Director reported that
he felt the withdrawal ~ould be a good procedure and he saw no
reason ~hy the Cityss best interests ~ould not be served in ~ranti~g
the request.

C-59 Public hearing was closed and Councilman B razil moved, seconded
by Councilman Hartman, to grant the request and Application No. C-59
was allowed to be withdrm~n, without prejudice. Hotion carried
unanimously.
VI OLD BUSINESS
A. POLICY DETEPd4INATION ON LEVEL OF POLICE SERVICES
City Administrator reported that this decision had been postponed
previously pending receipt by the City of data from the Sheriff's
Department with regard to the level of non-traffic calls occuring
~fthln the ~ity limits of the City of ~aratoga but that it had
proved impossible for the Sheriff's Department to develop and furnish
Policy this type of information from their current records. lie indicated,

of Police in the period from 1957 to 1963. The Mayor pointed out that this

the City of Saratoga can be made.
Councilman Brazil pointed out that one of the chief factors in
determining ~hether or not there was additional need for police ~ ~... '.
protection was the amount of time during which the car ~yas out
of action as a result ofhandling traffic citations or other types
of police calls. It was his impression from talking to the men on
the beat and from the officers in the department that this amount
of time has increased materially since the incorporation of the
City.
Chief Rosasco pointed out that the chief reason for his recommendation
for an increase of services from 12 to 18 hours was the heavy
increase in the nomber of streets that needed to be patrolled.
He further indicated that it~ was the conviction of the professionals
in the field that additional patrol was required to provide an
effective level of police services.
After discussing ~he fact that an increase from 12 to 18 hours of
patrol service roughly paralleled the increase in the assessed
valuation, the population and the number of streets added since
incorporation, it was moved by Councilman Brazil, seconded by
Councilman Tyler, and adopted that the contract with the Sheriff's
Department be amended to provide for an increase to 18 hours of
patrol car Services,
N~ BUSINESS
A. REQUEST FOR AUTHORIZATION TO PREPARE .REPORT FOR LIGHTING DISTRICT
FOR TRACTS 3392 and 3439
Tract City Administrator explained that electrical service for the street
lights to be installed along x.~ith partial underground utilities
3392 & fn Tracts 3392 and 3439 can by provided by (1) annexation to the
3439
Street Saratoga Lighting District (2) Annexation to the Azule Li~htfn~
District, or (3) formation of a separate lighting district. He
Lighting stated that costs to the existing members of the Saratoga Li~htin~
District District ~ould be increased slightly by annexation of these tracts
but that annexation to the Azule District would result in a
reduction to the existing members. l!r. Hanley reconmended that
the area be annexed to the Azule Lighting District and noted that
the administration of the districts ~ould be simplified by annexation
to existing districts rather than creation of nex~ ones to serve
those areas ~hich may.wish street lights.
Councilman Hartman moved, seconded by Councilman Brazil, to au~hoJ~i. ze
the City Administrator to prepare the required report for the annexa-
tion of Tracts 3392 and 3439 to the Azule Lighting District and
that the City Council go on record asexpressing its intent to
use the alternate system of levying and collectin? special assess-
ment taxes pursuant to Sections 18160 through 18169 of the Streets
and Highways Code. ~totfon carried unanimously.

(1) Hayor announced that the Inter City Council will meet at
I.C.C. Vahl"s restaurant tomorrow evenin~ and that the pro~ramwill
Mtg. include discussion of the new Local Agencies Formation Commission
which will rule on incorporation and annexation proceedings.
(2) RESOLUTION NO. 163
Res. 163
Flood Control Mayor Glennon read Resolution No. 163, supporting the Flood
Bonds Control Bonds scheduled for election on October 8, 1963.
Councilman Brazil moved, seconded by Councilman Tyler, to
adopt Resolution No. 163. Iiotion carried unanimously.
B. FINANCE
(i) Councilman Brazil moved, seconded by Councilman Harman, to

approve the disbursements on the list dated September 4, 1963
for a total amount of $7,856.56 and authorize that warrants be
dra~.nl in payment. Motion carried unanimously.

C. COUNCIL C~4ITTEES "
(1) Councilman Hartman reported that the Planning Committee
reconnnends adoption of the Planning Commission report dated
Policy July 22, 1963 regarding underground utilities subject to

(2) Councilman Hartman reported that the Planning Committee had met
Flood with the Subdivision Committee and County Flood Control
Control representatives to consider three proceedural steps to insure
liaison closer liaison with the Flood Control District: (1) The
Planning Director and the City Engineer or Director of Public
Uorks to inspect for any problems in the field and to notify
Flood Control of them (2) the possibility of requiring fee simple
deeds for required flood control channets instead of the present
dedication of easement (3) Having the Planning Com!,ission with-
hold action on tentative maps until Flood Control approval has
been granted. He reported that these items would be considered
by the Planning Commission and its recommendations would be
forwarded to the Council for final action.
D. DEPARTMENT HEADS AND OFFICERS
Bond City Attorney reported that he is drafting ~.~hat he feels will be
- an all inclusive form of complaint for declaratory relief in bonding
Claim problems, and that he hopes it will prove to be an inexpensive way
Litigation of titfgating a number of lon~ standing claims.
E. CITY AD!,ffNISTRATOR
Sara-L.G. (1) City Administrator reported that the Division of Highways had
Road replied to his request for plantlng the center strip on
Landscaping Saratoga-Los Gatos Road by advisin~ him that the State does not
authorize funds for landscaping any roads other than freeways
but that they would grant the City a permit to do the planting.
C~uncilman Hartman suggested, and the Council concurred, that
the State be notified that the City will plant the area if the
State ~lll maintain it.

(2) City Administrator reported that although the cost of
acquiring right-of-~.yay for the P. ighway ~9 improvement
Itighway #9 north of the railroad to Prospect t. ms estimated at $233,000
r/t.y costs the actual cost ~,.as $49s060.79 and he requested authorization
approved to approve the deduction of this mount from Saratoga*s share
of expressway funds in accordance x~ith the agreement between
the County and the City. Councilman Har~man moved, seconded
by Councilman Brazll~ to authorize the deduction of $49,060.79
from the Cityts share of expressway funds for the acquisition
of rights-of~eay on Highx~ay [J9. Hotion carried unanimously.
(3) City Administrator reported that the Janitorial work iu the
City offices city offices has been handled by the maintenance crex.~ for
janitorial payment on an extra hour basis and that, as they no longer
wish to do this workt the city called for informal bids for
contract
maintenance services by contract. lie stated that $100. per
month had been budgeted for Janitortal services and that the
Cc~maercial Building Maintenance Company submitted a bid of
$87.50 per month to clean the city offices, including ~indov..y
washing and flood waxing. The company is a large, bonded.
responsible concern and }It. llanley recommended that a contract
be executed with. this bidder.
Councilman Hat.an moved, seconded by C6uncilman Tyler, to
authorize the City Admihlstrator to execute a contract with
the Co,m,~ercial Building Lfaintenance Company for the services
outlined at a cost of $87.50 per month. l.iotion carried
unanimously.
