ROLL CALL Present: Councilmen Glennon, Brazil, Drake, Herman Absent: Councilman Tyler MINUTES Councilman Brazil moved, seconded by Councilman llartman to ~aive the readins and approve the minutes of the December 4, 1963 meeting as ~rritten. Motion carried unanimously. II BIDS A2,~D CONTRACTS A. AGREEMENT WITH STATE DISASTER OFFICE FOR PADIATION INSTRF~-~NTS FOR Agreement LICENSED SHELTERS for Radiation It was moved by Councilman Drake, seconded by Councilman Hartman, Instruments and unanimously' adopted to authorize the Mayor to execute an agreement ~ith the State Disaster office for radiation instruments for licensed shelters ~rithin the City. RESOLL~ION NO. i70 Res. 170 Palomino Councilman Brazil moved, seconded by Councilman Harridan to adopt Way Resolution No. 170, accepting Offer of dedication for Palomino Y~Yay. llotion carried unanimously. IV SUBDIVISIONS AND BUILDIL~G SITES A. SDR-458 - PAUL SUANSON SDR-458 Swanson The Council took under consideration the recommendation of the PlanninZ ~'~odification Commission as embodied in the staff report of December 9, 1963 that of Condition Condition II-C be modified to provide for the placement of-the required 5 feet of street improvements adjacent to the northerly edge of the existing pavement on Farewell Avenue instead of along the southerly edge in order to avoid removing four large trees along that side of the street. After some discussion, Hr. Shahs, representing :lr. Swanson, indicated that the applicant was agreeable to this change and it was moved by Councilman Brazil, seconded by Councilman Hartman, and unani~ously approved that the Council express its intention to concur in this modification at such time as SDR-458 is presented for final building site approval. V PUBLIC HEARINGS - 8:00 P. A. ORDINANCE NS-3.4 - A~ENDtNG PORTIONS OF TItE ZONING ORDIN~]CE RELATING Ord. TO SITE APJZA Pd~QUIPZL~NTS, CONSTRUCTION SIGNS AND PUBLIC INTEP~EST SIGNS NS-3.4 Site Area The City Administrator presented proposed Ordinance NS-3.4 submitted & Signs by the Planning Cammission, ~..~hich would define site area to exclude private streets or other rights of way over ~.~hich the public has right of access, precise plan lines and setbacks for future streets, and flood control easements. ~-Xr. Henley also outlined the proposed regulations goverain~ front and side yard definitions, construction signs and general public interest signs at the city entrances. The Administrator reported that the redefinition of site area had been prompted by the Commission*s concern with problems that had developed as a result of' residential structures bein~ placed too close to creeks when flood control easements are included in the calculation of square footage to meet site area requirements. Mayor Glennon declared the public hearing opened at 8:15 P. ~I. and there being no one present who ~shed to speak regarding this matter, it was moved by Councilman Brazil, seconded by Councilman Drake and unanimously approved to close the public hearing at 8:16 P. ~. Councilman Drake suggested that the best way to correct this type of problem might be through redeflnition of setback requirements rather than site area requirements and~ after discussion, Councilman Har~man moved~ seconded by Councilman ~azfl to re-open the public hearing at 8:45 P. M. ~otion carried unanimously and i~ayor Glennon referred the matter to the Planning Committee with the request that they discuss the situation ~th the Subdivision C.om~ittee of the Planning Commission and submit a report at the next regular meeting. It was moved by Councilman Hartman, seconded by Councilman Brazil and unanimously approved to continue the public hearing until 8:00 P, ~!. Thursday, January 2, 1964. VI OLD BUSINESS A. REPORT FRO~.I PLanNING CO?~ISSION REGARD!~]G STUDY O~] ~ETIP~MT Retirement DEVELOPHENTS Developments After discussion of a report from the PlanninB Commission regarding the feasibility of allowing retirement developments ~ithin the city ~ithout deviating from present density standards, it was moved by Councilman Brazil, seconded by Councilman Hartman, and unanimously adopted ~o approve the report dated November 21, 1963 from. the Subdivision Committee to the Planning Commission and request the Planning Commission to continue with their studies of this matter. VII NEW BUSINESS A. C-56 - O. R. MAGGIeRE The City Administrator read a letter from Mr. Maggiere requesting C-56 withdrar~al of his application to fezone from R-I-IO,000 to P-A Maggiere approximately three acres of land located at the north-west corner Withdra~.al of the intersection of Cox and Saratoga Avenues. It was moved by Councilman Brazil, seconded by Councilman Herman, and unanimously adopted to approve the request for withdrm~al of this item and. ~ayor directed the matter removed from the a~enda. VIII ADMINISTRATIVI~ I.L~TTERS A. ~IAYOR No reports B. FIN~ICE Bills (1) Councilman Drake moved, seconded by Councilman Brazil, to approve the disbursements on the list dated December 18, 1963, for a total amount of $24,347.86, and authorize that ~{arrants be drawn in payment. ~iotion carried unanimously. Finance Reports (2) The Treasurer's report and City Clerk's Financial Report for the month of November, 1963 ~ere distributed for council infonnaCion and, in answer to a query from Councilman Drake, ~r. Hanley indicated that any unexpe~ded balances in the Civic Center Improvement Fund budget will remain in this special fund at the ' close of the fiscal year but ~ill have to be re-budgeted for pay- ment of claims during the next fiscal year. -2- C. CO~']CIL CO~{ITTEES Councilman Hartman reported that the Planning Coramittee had met regarding the Chester Avenue Improvement District recently and that Chester the engineers had encountered some opposition to a proposed alternate Ave, route to Sobey Road requested by the City. After discussion of the Assessment problems confronting the engineers and the substantial expense involved District in carrying an assessment proceeding to the sta~e of a formal protest Informal hearing, it ~as the consensus of the Council to authorize the City Hearing Administrator to notify all interested parties that an informal hearing will be held regarding this matter at the regular meeting of January 15/1964. The purpose of this hearing ~7ill be to ascertain the attitude of the Council toward the project presented by the engineers at that time in the light of the reaction of all the property o~7ners affected by the project, D. DEPAR~I]T HEADS AND OFFICERS Bohlman (i) The Director of Public !=!orks recommended acceptance of the Road Bohlman P~oad retaining wall project and final payment without Retaining penalty for the 12 days delay in completion of the job. Wall explained that rain had~ on t~o occaslons~ caused slides in the area and prevented the Contractor from finishing the work on schedule. Councilman Drake questioned the justification for extending the penalty provision of the contract but acquiesced to the recommenda- tion after being assured by the City Administrator that the Contractor had deli~ently and continuously worked on this project each day that the l.~eather permitted him to do so. It was moved by Councilman i{ar~an, seconded by Councilman Zrazil~ and unanimously approved to authorize an extension of the penalty clause from November 20, 1963 until December 6, 1963 and accept the work for final payment. Tr.3034 (2) Director of Public Uorks reported that the City Engineer has Const. recommended acceptance of the construction of improvements in Tract 3034 but it was T~r. lIuff's recommendation and the Council agreed, that the developer be notified that construction will not be approved until the lot' grading plans have been complied with. Cox Ave. (3) At the suggestion of CounCilman Drake, the City Council urged Br'~.ge that design activity on the Cox Avenue bridge be given higher priority. canyon (4) In response to a question from Councilman Drake the Director of View Dr. Public Norks reported that the poor condition of upper Canyon Vie~ Drive was the responsibility of the developer since this was not a public street and the matter had been turned over to the City Attorney for possible action. Cox-Saratoga (5) Director of Public I~7orks stated, in answer to a question from Ave. signal C6uncilman Hartman, that the timer on the Eox-Saratoga Avenue traffic signal has recently been giving some trouble as a result of construction work in the vicinity and the matter is being investigated. (6) The City Attorney indicated that he had just received a letter Fire Dist. from the County Counsel concurring with his opinion that the Annexation Saratoga Fire District should follow the standard procedure for annexation of the Saratoga Country Club area and he stated that he plans to contact the County Counsel's office to find out if they Will initiate annexation proceedings on behalf of the Fire District. The Mayor directed that, while the City has no legal authority orresponsibility in the annexation proceeding, the staff . should assist the district in any appropriate ~ay to expedite the contemplated annexation. -3- E. CITY A~/IINISTRATOR Stop Sign (1) The City Administrator reported that Chief of Police Rosasco has Bonnie Ridge recommended against the installation of a stop sign at Bonnie & Scotland Ridge and Scotland Drive as he feels the problem is one of speed and not a dangerous intersection. It was moved by Councilman Brazil, seconded by Councilman Drake, and unanimously adopted to accept the recommendation and disapprove the request for a stop sign, Chief of (2) It was reported by the City A~ministrator that the Chief of Police Police will be out of the country until January 10, 1964. (3) After extensive discussion of a request from_ Valley Title Co~apany Sarahills that the City Council release them from their obligation to reserve Lot 9 a 20" easement over Lot 9 in the Sarahills subdivision, it was r/w Reserve moved by Councilman Drazil, seconded by Councilman [artman and unanimously adopted to deny the request as it was the Council decision that it could not authorize release of this reservation until access out to HiZ~Tay #9 either through Verde Vista Lane or the extension of Ruseell Lane is more firmly established. IX CO~.IUNICATIONS A. WRITTEN Street lights (1) Eetters requesting installation of stree[ lights at Saratoga Ranire Lane Avenue and Ranire Lane and at Fifth and Big Basin l~y were & Fifth St. referred to the City A~inistrator for investigation and report regarding costs and procedures uhich might be followed if the Council acceeds to these requests. GGG (2) Mayor Glennon noted that the Council had received holiday greetings from the Good Govermment Group and he extended the best wishes of the Council to those GGG representatives present. B. ORAL (1) Nayor Glennon achnowledged, with pleasure, the presence of Planning Cop~aissloner Cowley. Shariff's (2) Mayor Glennon noted that the monthly report to the Council from Reports the Sheriff's Department is informative, complete and is apprecia- ted by the Council. (3) It was announced by the ~ayor that the next regular meeting will be held on Thursday, January 2, 1964, in accordance with the State Code requirements regardin~ holidays.
