It was moved by Councilarea ltartmn~, seconded by Counct]m~-~ Tyler and
unanimously approved to adopt Resolution SDR-349-1 granting building
site approval to A. S. De1 Carlo for one lot on Farwell Avenue.
-D. SDR-476 - FIRST CHURCH OF CHRIST, SCIENTIST
SDR-/~76 City Administrator stated that all conditions had been met, fees paid
and bonds posted for this building site appl.~.cation.
Hayor Pro-tem inquired about the parking and if there had been provisions
made for the future growth of the congregation.
First Dr. Wilbur E. Kellcm, a member of the Planning Conmission reported' that
Church of the people responsible for this development have been most cooperative
Christ and have redesigned the parking area to meet the City's requirements
Scicntist and have set aside additional space for future parking needs.
Councilman Hartman moved, seconded by Councilman Tyler and unanimously
appro~ed to adopt Resolution SDR-476-1 approving one lot on Lomita
Avenue as a building site for the First Church of Christ, Scientist.
V PUBLIC HEARINGS
A. ORDINANCE NO. 38.3 - EXCAVATION AND GRADING
Public Hearing on Ordinance amending the Saratoga City Code, Article V,
Chapter (3), to provide excavation and grading regulations and adopting
certain provisions of Chapter 70 of the Uniform ' Building Code by
reference.
Excava- Mr. Hanley stated that this Ordinance, together with the Hillside
tion& Ordinance, provides control of excavation and grading and would enable
Grading the City to prevent scarring of the hillsides with deep cuts and fills.

Frank Mr. Frank Halstead of Santa Clara County Contractors and Homebuilders
Halstead Association reported that they ~.~hole-heartedly support the enactment
of this Ordinance and appreciated the opportunity to work with the City
staff and representatives of professional engineering groups in the final
preparation.
Jerry Mr. Jerry Hanson, 14291 Elva Avenue, Saratoga, California speakin~ in
Hanson favor of the Ordinance, indicated that he had a grading problem adjacent
to his lot and was referred to the Director of Public X~orks for assistance
and advice.
Councilman Hartman moved, seconded by Coancilman Tyler at 8:30 P.M. to
close Public Hearing. }lotion carried unanimously.
Councilman Burry moved, seconded by Councilman Hartman to adopt Ordinance
No. 38.3 and to waive the reading thereof. Hation carried unamimeusly.

V~arrants (1) It was moved by CouncilmAn Tyler, seconded by Coun,c~.lman Hartman
and unanimeusly adopted to approve the July 15, 1964 disbursements
for the total amount of $18,898.33 and authorize warrants be drawn
in payment.
(2) ~layor Pro-tem ordered City Treasurer*s Financial Report and City
Clerk's Financial Report filed as submitted.

(1) Mr. Stanley Walker, Plan, Pi~.'ector,report,~d that th~ proposed research
laboratory off Bohlman Road was denied by the Saf, ta Claire County Planning
Connnissions as a result of protest by tile City of Saratoga and neighboring
property owners.
Tract (2) The Director of Public Works presented a request for construction
3454 acq~ptance of Tract 3454, the Second mlit of Medical Village at Cox and
Sa~'~tog~ AvenUes.
It was moved by CoUncilman Hartman, seconded by CoUncilman BUrry, .and
unanimo~tSly app~oved to accept Tract 3454 for construction as reconnn&nded.
F~ank (3) The City Attorney ~ointed out that the ~rdnk Haven Nursery located,
Haven on HighWay ~9 has ~xpa~ded on to adjoinin~ ~esfd~ntially zoned land. The
Nursery Planning Director has written a letter requesting them to discontinue this
expansion, but the request has been disregarded;
Mri JohnstOn asked the City CoUncil if he should file a civil O~ criminal
suit in this matter and indicated that he felt that a hivil Suit ~ould
probably be most effective in getting compliance. .
Councilman Burry suggested it be left up to the City A~orneye's discretion
and, with no objection~ Mayor Pro-tem directed the City Attorney to proceed
on that basis. '

Cancell. (1) City Administrator stated that Mr. Plane, who had filed re~oning
of Zoning application C-12, does not wish to go through wlth it and had submitted
App. Plane a~ritten request for return of his fees. He recomme._ndea that the fees
be refunded less costs of publication of the notice of Public Hearing.
Dr. Kellum of the Planning Comm4ssion indicated that since no work had be'an
done there was no reason .for not returaix~ the fees.
Councilman Hartman moved, seconded by Councilman Be~!:~ to return the fees
less publication costs. Motiou carried unantmously~
Auction (2) Mr. Hanley acknowledged receipt of a letter em~v~xcing the auction of
State excess property o~med by the state on Saratoga-I~s Oatos Road.

(3~ Mr, I. H. ~ttelman submitted a lottcr aa~oa July 14,'1964 fromRoss
Hall Corporation requesting an offset of certain credits against storm
drainage acreage fees still o~ed by the firm on its Deerpark subdivision:
and requesting construction acceptance of the deceleration lane at Highway
9 and Reid Lane. Upon the recommendation of the Director of Public Works,
it was moved by Councilm~.n Tylers seconded by Councilman Burry and unani-
mouslyadopted to accept the deceleration lane for construction. The Mayor
Pro-tem directed that the n~tter of the requested offsets against the
storm drainage acreage fees be referred to tbe planning Committee for study
and recor~,endation.

Mayor Pro-tem acknowledged, with pleasure, the presence of Planning
Commission representative Dr. Wilbur E. Kellum.
