II BIDS AND CONTRACTS AoAgreement with P.G.& E. and Valley Title Company for Common Use of Easement.- Tract 3974 - Prospect Hills The Clerk presented an agreement with P.G.& Eo and Valley Title Company for common use of public utility easement in Tract 3974s particularly the crossing of a 'subdivision street under the tower line. This matter TR 3974 was pz. eviousty discussed at the time of approval of the final tract map° PCLE It was moved by Councilman Hartman; seconded by Councilman Burry, to Agrment authorize ~he Mayor to execute the agreement with P.G.& E. and Valley Title Company; motion carried unanimously. Bo Agreement with County of Santa Clara and Santa Clara County Flood Control and Water District for Acquisition by Flood Control District of Certain Lands in Saratoga The Clerk presented an Agreement bet~een the Board of Supervisors of the County of Santa Clara and the Santa C!,~ra County Flood Control and Water District for the purchase of tha State~s title to certain lm~ds within said County and within said District as provided by Division 1~ Part 6, Chapter 8~ Articles 1 and 2~ of the revenue m~d taxation code of the FeD State of Califo~niao He explained this covers one parcel of O=f:6 acres Agnne~t south of Scotland Drive~ within the City limits~ which was originally ~: dedicated to the County instead of the Flood Control District before incorporation of the City. The Director of Public Works stated he had checked this location and fGund it to be within the channel right-of-way of Saratoga Creek~ with all work completed and no new work proposed~ therafore~ ha reeoninended the City sign the agreement which would enable the Flood Control District to obtain title from the State. A motion was made by Councilman Hartman; seconded by Councilman Tyler; authorizing the Mayor to execute the agreement for purchase of the State~s title to certain lands by the Santa Clara Flood Control District; motion carried una~imously.' C. RESOLUTION NO. 283-D The Clerk read Resolution No. 283-D, a resolution ordering improvement of Quito Lighting District, and authorizing contract with Pacific Gas and Res. Electric Comp'~.ys a California corporation. 1t~e Clerk reported this is 283-D the final resolution for action by the Council which would maintain that Quito portion of the Quito Lighting District lying within the City limits in Lightg its present form. Previously~ action was taken to set up a new Qutto Dist. Lighting District covering tj.~-~t portion of the old district within Sara- toga~ necessitated by the fa.~ that the previous District embraced territory not in the City limits and was dissolved by the County. It was moved by Councilman Hartman; seconded by Councilman Burry; for adoption of Resolution No. 283-D and authorizing the Mayor to execute the contract with the Pacific Gas & Electric Company; motion carried unanimously. Pi~ Review SARATOGIA CITY COUNCIL MINUTES - DECE~iBER 1~ 1965 Ao GENERAL PLAN REVIEW In response to questions frem the Council.~ Mayor pro-tem Drake ~xplained that this is the annual review report of the General P!an~ the five,-year review having been de~erred due to problems presented by the proposed local. tion of the Uest Valley Junior College in Saratoga. The Clerk read the Plannfi~g Commission report dated 11 October 1965~ inc!ud~ ing the transcript of the Planning Com~nisslon public hearing held 16th and 23rd August 1965o In response to Mayor prod-tam Drake~s request for co~mnents from the auditEre: ROBERT .F_~Ajq__E,_~l. 9720 FRUITVALE AVENUE related the difficulties in attempting development of the low density area on the west side of Fruitvale Avenue from Fruitvale School south to Fadwell Avenue and suggested that the zoni,ag of this area be changed from R-1-40~000 to R-I-20,000. He presented to the Pablie Council a petition requesting such rezoning, signed by eight (8) residents Hearing of the area° General Plan MRS. SHIRLEY DIE~Z.51 WARDELL ROAD read a request from 48 citizens of Review the Wardell Road area for study of elimination of a proposed through road between Prospect and Wardell Roads west of Calabazas Creek, presented to the Planning Commission on August 13~ 1965o RICHAND BENNETT, BROOKWOOD I~&NE observed that, in his opinion~ one acre ing is becoming more a liability to the City than an asset~ with its expensive upkeep, few residents feel they c~not afford landscaping costs, etc. He supported Mr. Plane~s request for rezoning of the Frultvale-Farwell area to R-1-20~000 or R-l-.15~000~ He ~uggested that parks are regional matter and not of concern of Saratoga planners~ Ao OTTENBER.~_jk?.8.81 FOOTHILL LANE stated that groups petitioning in matters directly concerning safety problems in their c~ areas should not be con- sidered "pressure groups" or referred to as such. MRS° W!LBL~ WORDEN, SAI~TOGA AVENUE contradicted the n~wspaper report that no one artended the November 17th meeting on the General[ Plan review and said that three residents had been present° P. Jo PASETTA~ SAP~XTO__,GA___LOS G/.~TO___S__RO_~D., a former Planning Commissioner~ said property and sales tax revenues cannot meet the City~s needs to be sustaining and rezoning should be studied with an end to meeting the mou~tiag cost of edueationo He recoumlended that consideration be given to modifying the general plan to allow controlled industrial parks to locate bet~I~een the West Valley freeway and the Southern Pacific right-of-way. RIC~i~RD BRYER~ 200_66 GLENBP~AE DRIVE poin~':ed out that ~n the 1960 General Plan there were areas set aside for parks and inquired as to ~.~ether or not there were any plans to proceed with acquisition° Mayor pro-~em Drake pointed out that the bond issue- for this purpose had been defeated but the Planning Commission had recommended that the Cout',cil proceed to acquire some of the small park sites with general funds~ Mr. Bryer also brought up the matter of police services and youth activities~ Mayor pro~tam Drake explained these matters were not related to the present review but were considered at the proper time an~ a Youth Center was in the process of development on the Civic Cen~er site~ F__LcOY,D ..JEB]__S_EN, 20755 TRINITY opposed the suggestion of rezcning fcr industrial p ark s o S&M I~RNAI, IDEZ, 14626 BIG BASIN WAY recommended the acquisition and develop- mant of the present Wildwood Park and the land at Prospect and Highway 85 as public park areas. Mr. Henley stated the annual review ~as requested of the Planning mission specifically for the reason that the West Valley Junior College plans cane forw~d at the time the Commission would normally have made the five yea~ review. The City Council decision was not to proceed with tbe five year study but~ recognizing that there were lesser prob- lems to be considered that would not wait for a decision on the college, ~ annual review to cover these matters was ordered. He explained that is why no reference was made to the college and added that he felt is tiae the question of the college be resolve.:~ and some direction giveD to proceeding with the 701 pl~. McCormack - Dour!as Lane Councilman Hartman read the report of the Planning Committee dated November 22, 1965 recommending approval of the request of Donald Re McCormack for deferral of construction of the cnrb and gutter and a portion of the street paving required as conditions of approval of one building site proposed for development on Douglas Lane until such time as remainder cf property is developed, with the performance of this condition being guarauteed by securi- ties or a savings certificate posted as a cash bond by Mro McCormack. SDR~534 Donald It was moved by Councilman Burry; seconded by Councilman Hartman; McCormack to accept the report of the Planning Cormmittee expressing the in- Douglas Ln tention of the Conncil to grant the applicant's request for defertel of the dohdi~ion of construction of curb and gutter and a portion Of the street paving for.five years or until such time as the re- mainder of the property is developed, whichever occurs first, subject to the deposit and assignment to the City of securities or a savings certificate to serve as a cash bond guaranteeing the construction of the required public improvements; motion carried unan imous ly. Councilman Hartmen snggested that a study be made to determine the necessity of requirement of curb and gutter construction in half- acre and one acre developments. DEPARIi~,ENT HEADS AND OFFICERS (1) The Planning Director quoted new State legislation regarding in- corporation in the subdivision ordinance of a requirement for Subdivision dedication of land or payment of fees for park development by Perk subdividerso Mayor pro-tam Drake referred this matter to the Development Planning Committee for consultation with the Subdivision Committee of the Planning Corfanission with a view to possible incorporation in cur Subdivision Ordinance. (2) Mr. Walker relayed a request from Mayor Inglis of Monte Serene for the City of Saratoga's support in Monte Sereno's appeal to the Board of Supervisors for removal of a subdivision sign "Hidden "Hidden Htlls"~ now installed on a County portion of the Saratoga-Los Gates Hills" Road~ with approval of Santa Clara County. With no objection~ Sign Mayor pro-tam Drake ordered that a letter be written indicating the support of the City of Saratoga, in this appeal and instructing Mr. Walker to attend the meeting of the Beard of Supervisors sched- uled to hear this appeal° E.
