Oliver It was moved by Councilman Tyler, seconded by CoUncilman Burry, and
Bond unanimously carried to authorize release of the $850.00 Surety bond
release posted in connection Y~ith SDR-234, as recommended by the Director of
Public Works.
C. SDR-514 - MIJO CORPORATION
SDR-514
MiJo Corp. Mr. Henley read a request from Archiile Menard on behalf of MiJo
denial of Corporation for a one year extension of final site approval and noted
site approval that the request was received prior to the actual expiration date of
extension October 7, 1966.
After discussion, during which the City Attorney advised that the
Subdivision Ordinance makes no provision for extending final building
site approval, it was moved by Councilman Tyler~ seconded by Council-
man Burry, and unanimously carried to deny the request. It was noted
that the applicant must re-apply to the Planning Conmission for site
approval and that the recent emerRency ordinance relative to uses in
the C-S zone ~.muld require that a use permit be obtained for any use
of the property.

Town & Mr. Henley reported that the new o~.mer, Dr. Meleyco, has filed a new
Count~'y application for rezoning with the Planning Connnission and that the
Realty Staff recommends a continuation of this hearing on appeal from the
rezoning Planning Conmission recommendation until such thne as the Planning
hearing Conmission has acted upon the ne~.~ application. This recommendation,
Mr. Itanley indicated, is based on the premise that, should the Plann-
ing Commission reject the new application, the new o~mer would un-
doubtedly wish to continue the appeal on C-90,
Dr. Isaac Abrams, who previously objected to the rezoning application
C-90, stated that he has no objection to a continuance on this hearing.
Planning Commission Chairman Norton stated that notice has been pub-
lished for a public hearing on the ne~.~ application and that the hear-
ing has been scheduled for October 24, 1966 and the Mayor notad that
the entire matter had been~ at the last meeting~ referred to the Plann-
ing Commission for revlew.
After ascertaining that none of the interested parties objected to
continuance, it was moved by Councilman TyleE, seconded by Councilman
Robblns, and unanimously carried to continue this hearing to the meet-
ing of November 16, 1966~
VI ADMINISTRATIVE MATTERS
A. ~YOR
The ~ayor noted that a letter has been received from the ~st Valley
West Valley Junior College Bond Committee requesting use of the Council Chambers
Junior College for a meeting to explain the issue and, after discussion and Council
Bond issue reaffirmation of its previous approval of this bond issue, the Mayor,

with Council concurrences directed the City Administrator to make
arranaements for the City of Saratoga to co-sponsor the requested
meeting, to be held in the Council Chamber (at no cost to the College
bond Committee) on l.lednesday, October 26, 1966,
B, FINANCE
(1) It was moved by Councilman Burrys seconded by Councilman Tyler,
and unanimously carried to approve the disbursements on the list
Bills dated October 19, 1966, and authorize that warrants be drm. m in
payment for e total amount of $39,817.30.
(2) The City Clerk's FInancial Report and the Treasurer's Report for
Finance the month of Septe~beri 1966 were submitted and ,acc'sI~ed and
Reports Mr. Henley reported that the Series E and It United States Savings
Bonds which the City holds will be redeemed and the money re-de-
posited in time deposit accounts in order to receive the himher
rate of interest available.
Budget (3) The first quarter budget report for i966-67 was distributed for

C. COUNCIL CO~4ITTEES
(i) Councilman ~urry reported that the Management Cornittee had met

addition to the Hakone property that could provide additional room
for development as well as buffer the park from abutting .private
residential euns~ruction~ it was moved by Councilman Burry,
seconded by CounCilman Robbins, and unanimously carried to authorize
the City Admi~istrator to employ }lalter Doyle to make an appraisal
as recommended at a coat hot ~o exceed $200,00.
(2) Mayor Pro Tern tlartmans as Chairman of the Planning Committee,
Oliver reported that the Committee met October 17 with the Subdivision
Pet Clinic Committees Dr. John Oliver and his associate, officers of the
complaints Northwest Saratoga Homeowner, Associations end residents of the
neighborhood adjacent to Dr. 01iver's Pet Clinic on HiEhwey 85,
to discuss and analyze problems associated with the Pet Clinic
operation. Agreement was reached regardinF~ the action to be taken
to correct the problems and the Mayor indicated that no action is
required of the Council but the Committee had wished to report as
a matter of interest and information.
(3) Mayor Hartman also reported that the PlanninE Comittee revie~ed
Plannin~ an underground utilities problem, the question of a boundary
Co-~nittee agreement with Monte Sereno and the Qui.~o Road Plan Lines and that
progress as soon as these matters reach the point of Council action the
reports Committee will submit its reports and recommendations.

D. DEPARTMENT lIEADS AND OFFICERS
John (1) Planning Director Stonley l.~alker raporated that Dr. John Oliver
Oliver had requested a waiver of requirement for underground utilities

to serve a building to be constructed at the rear of his property
on llighway 85 and that, after reviews the Planning Cor~mission
recommends to the City Council that the request be %ranted as it
involves only the service drop from the rear of the property,
does not involve installation of any additional poles ands if
required to ~o underground, would not provide any aesthetic
benefit to the area, Councilman Tyler agreed that it falls
~lthin the policy of the Council regardin~ underground utilities
for individual sites, and he therefore moved, seconded by Council-
man Burry, to grant the request and waive the require~n~
underground utility installation for SDR-644; motion carried
unanimously.
Tract (2) The Director Of Publid Works recounended acceptance of the street
3736 improvements in Tract 3736, Medical Village of Saratoga, subject to
Improvement the Developer posting a bond to guarantee the one year maintenance

Robbins and unanimously carried to accept the street improvements
in Tract 3736 for construction,
E, CITY ADMINISTRATOR
Council (1) Upon the recommendation of the City Administrator, it ~as moved
Chambers by Councilumn Tyier, seconded by Councilman Robbins and unanimously
track rollers adopted to authorize the purchase of $153,50 worth of curtain track
purchase rollers for th~ C6uncil Chamber stage from the Federated Drama
Group.
Loudspeaker (2) The City Administrator was dlre~ted by the City Council to have
plans plans prepared for the purchase and installation.of a loudspeaker
system in the Council Chambers for use durin~ Planning Commission
and City Council meetings.
VII CO~IUNICATIONS
A. WRITTEN
(1) The City ~dministrator presented a letter ~ro~ ~he Saratoga Village
Merchants' Association, dated October lO, !966s protestin8 the
Village addition By th~ Plann~n~ Con~nission of "Retail Specialty ShopDing
Merchants Center" t~ the list of conditional uses in the C-S Zoning district
protest to and an appeal filed October 19, 1966 by J, Rainey Hancoc~ on behalf
addition of of twelve signators requesting the City Council to set aside this
conditional action of the Planning Cot~ssion and to instruct the Cormnission
uses in C-S to hold public hearings and to revie~ the General Plan before
zone -and taking the action objected to. Mr. Hancock argued that the action
legal appeal taken by the Planning Commission was illegal on the Zrounds set
of action of out in his petition of October 19s 1966. After discussion of the
Planning legal aspects of the problem with ~fr, Hancock and William Clarks
Commission by Attorney for U. C, Garcia and Associates, the Mayor directed,
J. Rainey without objection, that the legal question raised be referred to
Hancock the City Attorney for his review and report at the City Council
meeting of November 2, 1966.
(2) A letter from Mrs. Laura C. Bertelsen requesting prohibition of
Bertelsen parking on one side of Oak Street was referred to the Public
request re Welfare Committee by the Mayor and the City Administartor was
Oak Street requested to notify Mrs. Bertelsen of t.he City Council's study
Parking of her request. Mr. Hanley stated that a staff report and recom-
mendation on this request would be ready for Committee review
shortly,
(3) In response to a letter from the San Jose City Council it was
Phase II moved by Councilman Tyler, seconded by Councilman Robbins and
Trafficways unanimously adopted to authorize the Mayor to send a letter to
endorsement the Board of Supervisors expressing the support of the Saratoga
& request for City Council for Phase II of the Trafficways Program and urging
Bond election the Board to set the election on this proposed bond issue of
$114,000,000 for February 7, 1966.

B. ORAL
(1) ~r. Ted Gabeb inquired about the status of design stmidards for
tlig~ay 35 north of the Southern Pacific Railroad right of way
Highway 85 and was informed by the ~yor that a plan proposed by the staff

Standards - and the Planning Committee of the City Council and would be acted
