I. ORGANIZATION - The meeting was called to order at ?:J0 P,M.
A. ROLL CALL - All Councilmen were present.
B. MINUTES - Moved by Councilman Sanders, seconded by Councilmen
Robbins that the minutes of November 19, 1969 be approved with the'
following amendment: Page 5, Line 1 should read "City proposes"
rather than "City forms". Carried and so ordered,
II. BIDS & CONTRACTS
A. PROSPECT ROAD IMPROVEMENT
Prospect Rd. Mr. Ruff reported tha~ bids for this project will be received in
Improvement January. The e~penditure required by the city is $55,000.00; Moved
by Mr; Robbins, seconded by Mr. Smith that the plans be approved
subject to review and approval of the Public Welfare Committee.
III. PETITIONS, ORDINANCES & FORMAL RESOLUTIONS
A. RESOLUTION NO. 516 - COMMENDING ORGANIZATIONS PARTICIPATING IN
NOVEMBER 22 TREE PLANTING IN SARATOGA VILLAGE,
Moved by Councilman Robbing, seconded by Councilman Dwyer for
Resolution adoption of Resolution No. 516 commending the Rotary Club of
516 Tree Saratoga, Saratoga Beautiful, Saratoga Horticultural Foundation,
Planting Interact Club of Saratoga High School, and the Saratoga Volunteer
Big Basin Way Fire Department who joined in the contribution of time, materials,
and labor to enhance the beauty of the village area by planting
trees along Big Basin Way. Carried and so ordered.
B. RESOLUTION NO. MV-21 - DESIGNATING COX AVENUE, BETWEEN SARATOGA-
SUNNYVALE ROAD AND SARATOGA AVENUE, AS A THROUGH HIGHWAY
Resolution Fir. Huff stated that the need for this has been increased due to
M~-21 the extension of Miller Avenue through to Cox, The City Attorney
Designating explained that term "through highway" is a technical one in order
Cox Ave. as to permit stop signs to be installed. Moved by Mr. Smith, second-
through ed by Mr. Dwyer for adoption of Resolution No. MV-21. Carried and

IV, SUBDIVISIONS, BUILDING SITES & ZONING REQUESTS ' NONE
V. PUBLIC HEARINGS ' Mayor Tyler opened the Public Hearins at 8:07 P.M.
A. GENERAL PLAN REVIEW - PARK ELEMENT - CONTINUATION
Mr. Robbins read aloud the Plannin~ Committee report of December 2.,
Park Element 1969. The Committee had reviewed certain parts of the Parks plan
of General in the context of the extensive study and work previously reported
Plan by the consultant, Royston, Hanamoto, Beck and Abey, the Parks and
Recreation Commission and the Planning Commission. The report con-
tained the committee~s recommendations and reasons as well as a
summary of all areas and a map.
Mr, Martin, 12524 Miller Avenue spoke with regard to the 5ellwood
site and noted that the subdivision plan and street had been approv-
ed. He wondered if the closing of this street would conflict with
the traffic pattern that will exist in the area when the subdivision
is developed.
Mr. Robbins replied that Brookglen would still be a through road.
Kenneth wilton, 20405 cox Avenue, Saratoga who lives across the
street from the proposed Cox Avenue and Saratoga-Sunnyvale Road
site stated that this area is very heavily travelled and he is

concerned that the park would generate an findue mount of traffic.
He suggested that if the entrance to the park were off the High-
way this might eliminate the problems: He noted also that people
use the creek bed as ingress and egress. Mr~ wilton has the only
house fscing on Cox Avenue.
MayorsTyler explained that the Council is only considering park
sites at the present time and that development plans are not
~vsilable. He added that this parcel is also bein~ considered
as a library site.
Nr. W~lia~d Heig~t~ of-Fredericksburg Drive expressed his approval
of the overall park element of the General Plan.

~eneral P,~ENDNENT TO THE SARATOGA ZONING ORDINANCE PERTAINING TO ACCESSORY
Plan STRUCTURES IN REAR YARDS IN R-1 RESIDENTIAL DISTRICTS.
Ord. NS-3-22 Mayor Tyler opened the Public Hearing at 8:43 P.M. There being no
Accessory comments or questions from the audience the Public Hearing was
Structures closed.
Moved by Mr. Robbins, seconded by M~. D~yer for Adoption of Ordinance
NS-3-22. Carried and so ordered.
C. NANOR DRIVE PARK/~AINTENANCE DISTRICT
Mr. Huff stated that this hearing was scheduled as a result of the
Manor Drive City Council~s determination that subdivision entrance landscaping
Park should be the responsibility of the residents of the area involved.
Maintenance Mr. Assaf from the firm of Wilson, Jones, Morton and Lynch was
District present to answer any questions. Mr. Huff yes in possession of a
letter from ~ichard E, Cardella, Attorney requesting that the lands
of Lyngso not be included in the Maintenance District. The Lyngso
propertyi~no=~of~d adjacent to Manor Drive but is not a portion
of the subdivision.
Mr. Clifford Sack, 20590 Nanor Drive, S~ratoga addressed the Council,
Re felt there was inequity with regard to taxation of land and
improvements and that the people in the Manor Drive area were
carrying more than their share of the tax burden. He wondered abou~
overlap of monies and felt the city should assume responsibility
for the maintenance of this area. He noted that they were unaware
that they would be required to take on this responsibility when
they purchased this property. He added that the total street area
in relation to the number of lots was small and the yield for
this particular subdivision was high. He s~ated ~hat they were
paying more than other areas in town and questioned that they might
be paying double. He felt this should be a part of the general tax
responsibility because the property owners were not the sole users.
He asked about the city~s responsibility for maintenance.
Mr. Huf£ explained that the city maintains the streets, curves,
gutters and storm drains. The normal procedure is not to assume
responsibility for subdivision landscaping. Mr. Sanders noted
that city policy was that this was a limited-service city.
Dwyer wondered whether the property owners would be willing to
maintain this on a voluntary basis,
Mr. Prank Shore, 12905 Meadow Lane, Saratoga spoke from the audience
stating that 'the developer had informed him that the. median was

deeded to the city and not the responsibility of the property owners.
The property owners are considerin~ the formation of a homeowners
g~oup and are requesting a time extension in order to discuss
these matters.
1~. Assaf stated that notice of this hearing had been posted,
mailed and published according to law and that affidavits of
posting, mailing, and publishing are on file with the City Clerk.
Moved by Mr. Robbins, seconded by Mr. Dwyer that we continue the
Public Hearing to February 4, 1970 at 8:00 P.M. Carried and so
o~dered. CityClerk instructed to post notice of continued hearing.
D. FREDERICKSBURG DRIVE PAR~ MAINT~NAI~CE DISTRICT
FP~DERICKS- Mr. Huff explained that this was a similar proposal. In this case
BURG DRIVE the landscaping has not been installed. The Developer asked the
PARKMAINT. City if he could post a cash bond in lieu of landscaping along Cox
DISTRICT until provision had been made for maintenance. Several residents
have asked that landscaping be installed. The required notices
have been posted, mailed and published as'required by law and
affidavits of posting!, mailing, and publication are on file with
the City Clerk.
Daniel Hoffman, 20276 Williamsburg Lane, Saratoga addressed the
Council. A resident and attorney he had been asked to serve as
spokesman for a group of 45 property owners in the Saratoga Creek
Tract, who had met with the City Manager on November 24. This
group is studying forming a homeownerts association and presented
a petition requesting a sixty day postponement of action by the
Council to allow time for the group to study the proposal and
make a reco~nendation representing the wishes of thepeople in the
district. He noted that conceivably Resolution MV-21 may affect
their decision in part.
Moved by Mr. Robbins, seconded by Mr. Smith that the public hearing
he continued to February 4, 1970 at 8:00 P.M. Carried and so ordered.
VI. ADMINISTRATIVE MATTERS
A. MAYOR
1. It has become apparent that we are going to have to appoint a
new Parks & Recreation Connnissioner and Mayor Tyler asked for
suggestions from the Council.
FINANCE
1. Payment of Claims
Moved by Mr. Smith, seconded by Mr. Robbins for approval of the
disbursements as listed for a total of $35,965.13 and that the
Mayor be authorized to sign them. Carried and so ordered.
2. 3ohn Williams, 15000 Springer Avenues Saratoga.
John Willjams Mr. Huff referred to a letter from Mr. Williams submitting a
Springer Road bill in the amount of $299.18 for repair of the road at 15000
Repairs . Springer Avenue. This represents damage to the road caused by
a wash=out.
Moved by Mr. Smith, seconded by Mr. Dwyer that the letter be
referred to the Cityts insurance carrier. Carried and so
ordered.

Hr. Robbins reported that the Management Committee has recom=

Drapes building in accordance with the architect's recommendations at a
for City total cost of $2,306.43. Moved by Mr. Dryer, seconded by Mr. Smith
Hall for adoption of the Management Committee report. Carried and so
ordered.
D, DEPARI~4ENT HEADS A~ OFFICERS
C-117 1. C-117 - Dr. Isaac N. Abrsms - Request for Extension
Dr. Abrams
Request for Mr~ Walker reported t~at at the September 8 meeting the
Extension Planning Cou~uission voted to recommend to the City Council
that C-117 be granted a one (1) year extension from the
original expiration date in accordance with the Staff Report
dated S~_ptember 8, 1969. Moved by Mr. Robbins, seconded by
Mr. D~ryer that C-117 extension be granted to November 1, 1970.
Carried and so ordered.
2. C-106 - M.V.S. Company, Saratoga Ave. - Request for ExtenSion
C-106 Mr. Walker reported that at the October 14, 1969 Planning
M.V.S. Commission Meeting ~he Commission had voted to recommend Co
Company the City Council that C-106 be granted a six (6) month exten-
tion to July 1, 1970 in accordance vith Staff ~eport dated
October 14, 1969. Moved by Mr. Robbins, seconded by Mr. Dryer
that C-106 extension be granted to July 1, 1970. Carried and
so ordered.
3. A proposal by Nr. Rovianek for landscaping the areas that ~ere
created by the nay addition and a proposal to locate and plant
the oak tree in memory of Nayor Hartman o£ a cost estimate of
approximately $1200. was referred ~ithout objection to the
Planning Csmmittee.
4. Mr. Shook recu,~uended that the Council authorize filing notice
of completion on the following three contracts ~nich the city
'has let. All three have been completed in accordance with the
Notice of terms of the contract,
Completion
P.W. Contracts (a) 1969 Oil and Screen sealing of city streets.
(b) Completion of the asphalt cap on Fruitvale between
Allendale and Highray 9.
(c) Via Escuela in front o£ Congress Springs School.
Moved by Mr. l)~yer, seconded by Mr. Robbins that the Council
authorize filing of notice on the above mentioned contracts.

E. CITY MANAGER
1) Street Lighting Requests
(a) Walnut Avenue and Alta Vista
(b) Springer Avenue
Mr. Shook stewed that both Chese requests are within lighting
Street districts. The staff has reviewed them and finds they are in
Lighting order. Saratoga's general philosophy has been that lights are
Requests unnecessary, however, in these particular areas we find that
with the requests as strong as they are, ~he lights ere
vatranted. Mr. Shook recommended that the City Council request
that P.G. & E. install street lights on their ovn poles. He
noted there would be no capital cos~ to the city - only maint-
enance costs. Without objection the matter was referred to

VII. Ca~1dUNICATIONS

1~ Letter from Saint Andrews Episcopal Church requesting per-
mission to hold a second procession on December 15Oh as part
Moratorium of the observance in Saratoga of the Moratorium, and thankin~
Procession the City for its assistance in permitting the procession in
November. Since there had been no unfavorable comments on the
prior procession, it was moved by Fir. Sanders, seconded by
Smith that permission be granted. Carried and so ordered.
Landscaping 2. A letter from Hrs. Mildred Plane, 14452 Nut~ood Lane, Saratoga
Saratoga Ave. requesting that the city take some steps to landscape the
& Woodlands median between Saratoga Avenue and Douglass Lane was referred
without objection to the Planning Committee.
3. Letter from ~lr. V. Donald Jecobsen, 20290 Edinburgh Drive,
Saratoga complaining of the early garbage pick-up (staring at
Garbage 3:00 A.M. on Thanksgiving morning). Mr. Huff noted that the
Pick-up Scavenger Service had informed the Assistant to the City
Complaint Manager that they had allowed their employees to pick up
-V.D. Jacobsen earlier on Thanksgiving so that they could be free earlier in
the day. They plan to follow the same schedule for Christmas
and New Year*s Day. It was the consensus of the Council that
the City inform Green Valley Disposal Company that it was
necessary that they abide by the terms of their contract. City
Clerk was instructed to forward e copy of the letter to t4r.
Jacobsen.
Proposed 4. Letter from !its. Dully commenting on the design of the propesedd
Pathway pathway alon~ Saratoga Avenue. This was referred to the
Saratoga Planning Committee who will meet with Mrs. Dully to discuss her
Avenue suggestions as the bids have already been let. Mr. Shook
stated that no one has taken a bid form out although this has
Walkways been advertised and contractors who have bid previously have
Saratoga- bean notified. This is possibly due to the good weather. Mr.
Los Gatos Rd. huff noted that we have budgeted funds for walkways on Saratoga-
& Fruitvale Los Catos Road and Fruitvale. It is .ns a matter of prioriti.es.
5. A letter from the American Lawn Bowlers Association was referred
to the Parks & Recreation Commission,
B. ORAL
1. Richard Green, Coleta Avenue, Saratoga addressed the Council
Street with regard to the construction talcing place in the Ditz-Crane
Repairs Development and recent Blue Hills School. He presented a
Seagull letter signed by residents on Goleta Avenue, which stated that
H~y there were holes in the pavement which were not present before
construction, There are areas where the surface has been re-
moved and not replaced. There are a large number of cracks,
The approximate wei~iht of the semi truck trailers is 70,000
lbs and most of them are 5-axle rigs. There is an excessive
amount of speeding through the Blue Hills Zone. He asked that
the semi*s be rerouted and that the streets be repaired by
the paving contractor or Ditz-Crane rather than by the homeowners
or the city, This involves mainly Seagul Hay.
Mr. Shook stated that currently there are no so-called truck
routes through the City which prohibits trucks of certain
weights on any given streets. It is possible that if we wish
to that the vehicle code allows us to limit the load carrying
capacity on certain streets, Rowever, there would be
difficulty if this was the only route in. It would be possible
to draft an ordinance to prohibit truck traffic on Seagull
or any other street. On City contracts there is specification
that the contractor shall repair all access roads to their
original condition. There is no such condition on the subdivision
general construction notes, however, it may be covered by the
State Standard S~ecifications which are referred to in these'
specifications. Mr. Shook had observed the problem on Goleta
Avenue but was surprised that the truck traffic over such a.
short period of time would have created any real damage.

The City Attorney noted tha~ t_he matter of truck routes had been
considered a number of years ago in relation primarily to the
gravel trucks which were going through ~own at the time.
VIII. ADJOURNMENT
Mr. Tyler acknowledged the presence of Planning C~mmissioner Lively,
Pits. Brand and Ru~h Owen of the Good Government Group.
There being no further business to discuss, it was moved by l~r. Robbins,
seconded by Mr. Sanders that the meeting be adjourned. The meeting
adjourned at 10:03 P.M.
