MINUTES Minutes of February 3, 1971 approved as distributed with the following correction: Page 2, Item 5 E. Planning Committee should be Planning Commission. II. BIDS & CONTRACTS A.FRUITVALE AVENUE WALKWAY PROJECT - FINAL ACCEPTANCE Council authorized filing notice of completion. B. SARAHILLS DRIVE REPAIR PROJECT - FINAL ACCEPTANCE Contractor excused from penalty on recommendation of Director of Public Works. City to withhold final .payment until project completed provided work is completed in accord with ins.tructions of Director. III. PETITIONS, ORDINANCES & FORMAL RESOLUTIONS None IV. SUBDIVISIONS, BUILDING SITES & ZONING REQUESTS A. C-139 - MALACHY J. MORAN - SARATOGA AVENUE Public Hearing set for March 171~ 1971 on appeal from Planning Commission denial. B. SDR-876 - JOSEPH NEVILLE - CONTINUED FROM 2-3-~1 Letter from applicant included in file. Public Rearing opened at 8:02 P.M. Applicant asked that matter be referred back to Planning Commission~ so he could submit further development plans. Mr. Neville stated it wa~ impossible to come up with plans that would meet slope density requirements. There were no further questions from the Council. No one in the audience wished to comment. Public Hearing closed at 8:15 P.M. Committee report approved and appeal denied. B. REQUEST FOR CITY TO DESIGNATE MARlDON AND TORRE PROPERTIES AS AN AGRICULTURAL PRESERVE ,Public Rearing opened at 8:16 P.M. No one in the audience wished to comment. Public Hearing closed at 8:17 P.M. ADMINISTRATIVE MATTERS A. MAYOR 1. Called for Executive Session following regular meeting to discuss negotiafio~s.' 2. Announced ABAG meeting February 18, 1971. Councilman Smith directed to take a stand that ABAG budget should not be increased. 3. Policy Committee report concerning Term of Office for Library Commission ~pproved. Mayor Robbins appointed Samuel L. Tyler, John Campbell and Mrs. Phil Olsen to four year terms; and Charles Earley and Mrs. Thomas W. Falltrick to 2 year terms, beginning February 1, 19~1. 4. Announced Sacramento I.C.,C. meeting on March 3, 1971 and next regular Council Meeting On March 4, 1971. 5. Referred request from Saratoga High School Committee on Performing Arts to waive Council Chamber fees to Policy Committee. 6.Referred letter from California Citizens Committee for Protection 'from Fire to staff for appropriate action. 7.Appointed Howard Clukey as Chief of Radiological Safety for the Saratoga Civil Defense and Disaster Plan. B. FINANCE 1. Payment of Claims Approved list of disbursements dated February 17, 1971 and authorized Mayor Pro Tem to sign the warrants. 2,3~ City Clerk's Financial Report and?Treasurer's Report noted and filed. C. COUNCIL COMMITTEE & COMMISSION REPORTS 1. Director of Public Works directed to write a dissertation~to_exlain ?ecember'engi~ri~g report on Braemar Drive to complaining residents. 2. Authorized purchase of floor machine for youth center at a cost of $736.00 from Guardian Maintenance Company. 3. Public Welfare Committee ~eport on raised reflectorized markings approved. 4. Public Welfare Committee report on ambulance service for Saratoga approved. 5. Public Welfare Committee report on' updating building regulations approved. 6. Management Committee report on personnel classification study approved. 7. Management Committee report on payroll services agreement approved. Mayor authorized to execute Employer's Specification Sheet; Custom Payroll Service Agreement; Power of Attorney to file returns under the Federal Insurance'Contributions Act, Federal Unemployment Tax Act, and the Federal Income Tax Withheld from Wages; and Payroll Schedule. 8. Parks & Recreation Co~ission report on Landscaping and Beautification referred to Planning CoEittee. 10. Kevin Moran Park DedicatiOn approved subject to approval or any changes that the Moran family would like to mke. 11. Councilmn Smith to' meet with Parks & Recreation Co~ission to clarify referral with regard to pathways. D. DEP~NT ~S & OFFICERS I. City Attorney announced that Cocciardi Quarry case has been continued to March 10. E. CITY ~GER 1. Code Enforcement Officer report on Nightime Loitering problem in the village referred to Public Welfare Co~ittee. 2. Code Enforcement Officer report on animl pick-up ordinance referred to Public Welfare Co~ittee. 3. City Council-Planning Co~ission ,Joint Study Session set for May 17, 1971. 4. Ordinance 38.36~i relating to~ties of Code Enforcement Officer, introduced. ~Duties approved by minute resolution ~o~ering period until effective date of ordinance. ! VII. CO~NICATIONS A. ~ITTEN 1. Letter from San ~teo City Council urging legislation which would bring about meaningful property tax relief by means of a different assessment ratio noted and filed. 2. Letter from Beverly Hills Chamber of Co~erce Civic Assoc~tion concerning the minimal requirements for nomination for elective offices noted and filed. 3. Letter from Cupertino Union Schooli'District announcing Conference of Santa Clara County School Boards Association on February 26 and 27 noted and filed. Staff directed to notify Parks & Recreation Co~ission. 4, Letter from Saratoga Westgate Jaygees requesting a permit to sell fireworks for 4th of July referred to staff. 5. Letter from Mr. & Mrs. George Fritz~m Prospect Road referred to staff. 6. Notice of Public Hearing before ~FCO on ~kone Gardens annexation noted a~d filed. 7. Letter from Knrt Gross, PPC referring to the Bay Lands Study which is up for review noted and filed. 8. Copy of Monthly Traffic Su~ry noted and filed. 9. Letter from Prince of Peace Church indicating willingness to negotiate sale of a portion of Church property to the City referred to Parks & Recreation Commission. 10. ORAL Mr, James Mangle, 12072 Ingrid Court stated that the Prospect Road Improvement Committee has been following the grievances of the residents of San Jose just north of Prospect and would be willing to meet with them to provide background information, VIII.
