Mrs. Rawak introduced Nina Kerste~n, age 9 and presentedíthe Council a petition prepared by Nina and ¡containing signatures of 60 people ,many in-her age bracket,wno-favored thè park~ :on Brookglen. Mayor ,Robbins noted that the City is present negotiating for this particular piece of property. REqU~S~,FOR CITY TO DESIGNATE FRANK C. NELSON PROPERTY AS AN AGRICULTURAL PRESERVE, ' Public Hearing opened at 8:22 P.M. No one in the audience wished to comment. Public Hearing closed for the evening at 8:23 P.M. and continued to April 21, 1971. C, UP-l89 - JAMES R, DAVI - SOUSA LANE Public Hearing opened at 8:55 P.M. Applicant was present accompanied by Ray Johnson, Architect; Bill Kuhns, Executive Administrator in Extended Carè Facilities; and Ben White, Engineer. Mr. Davi was requesting an extension due to difficulties in funding of this project. John Hampton, l3402 Sousa Laneisupported the construction of the convalescent I hospital but expressed concern for the future status of Sousa Lane. Mr. Walker, advised that upon completion of the Davi project Sousa Lane would be accepted as :a public street. Public Hearing closed for the evening and continued to April 21, 1971. Councilman Smith abstained from discussion. Mayor appointed a special committee of Mr. Bridges and Mr. Sanders to consider the ßppeal. D. Directed city staff to prepare two resolutions, one for and one against revenue sharing and ro agendi~e this item for April 2l. 3. Council adopted Resolution No. 566 designating the weeks of April 12 to 25 as Fair Housing Week~,. 4. Announced dedication of Cupertino County Library .on April 10, 1971. 5. Referred resolution endorsing the Inter-Faith Religious Arts and Music Festival to the Policy Committee. 6. Announced de~ication of Kevin Moran Park on April lO, 1971. B, FINANCE 1. Payment of Claims Approved list of disbursements dated April 7, 1971 and authorized Mayor to sign the warrants. C. COUNCIL COMMISSION AND COMMITTEE REPORTS 1. Parks and Recreation Commission report on Saratoga Campus Recreational Facilities Assessment District noted. 2. Parks and Recreation Commission recommendation to contact Eldon Beck for a proposal for El Quito Park program approved. Agreement with Moreland School District referred to Management Committee; 3. Public Welfare Committee repor~ on Sheriff's services approved. Ma~or authorized to direct letter to Howard Campen expressing the City's reluctanc~ to accept a significant increàse in cost without any increase in the level of service. Mendenhall request for waiver of $6500 bond referrèd to Planning Committee for study and recomm7ndation. 2. City staff authorized t%btain proposals for soils study at Pierce Rd. slide. 3. Mayor appointed a special committee consisting of Councilmen Smith and Dwyer asõP.G, & E. negotiating committee.;:.to work toward adequate landscape screening for the transmission line towers. 4. Director of Public Works reported removal of a sight hazard at Farwell and Fruitvale. 5. Director of Public Works reported on status of Quito Road repairs between Cox and Sara toga Avenuef,Jn the area within the jurisdiction of the Ci ty of San Jose. E. CITY MANAGER 1. Staff authorized to take appropriate legal action to abate violation of Saratoga City Ordinance 3-37iin the case of the moving of a large barn by Nick MHjevich. ''(, 2. March l7, 1971 letter from United Pacific Insurance Co, regarding accident damage claim referred to city's insurance carrier. 2. Letter from League of Cities announcing Mayors' and Councilmen's Legislative Institute noted. 3. Letter from Jada Development requesting reconsideration of pathway along Saratoga Creek referred to Parks and Recreation Commission. 4. Letter from Mr, & Mrs. Jordan, Manteca Way,commenting that the current City Ordinance controlling solicitors is inadequate. This is cur- ' rently under study in the Public Welfare Committee who have instructed staff to draw up proposed amendments. 5. Letter from Chamber of Commerce indicating that Cupertino Chamber of Commerce has recommended that Saratoga-Sunnyvale Road be changed to DeAnza Boulevard noted. Sam Serchia stated the Chamber did not endorse this proposal and suggested a change to Highway Nine. 6. Letter from Ross and Mary Dorsa, l48l0 Fan,ell Ave., opposing formation of an assessment district for recreational facilities on the West Valley College Campùs. 7. Letter from Mrs, M,S.Wade opposing formation of an assessment district for recreational facilities,on the West Valley College campus. 8. Letter from Cupertino Union School District concerning integrated housing noted. Mayor Robbins indicated that this matter Was consiqered by the I.C.C. Mayor's Committee on April 1. 9. Letter from Cupertino Union School District requesting support for Cupertino School Tax election noted. 10. Letter from Charles Guichard, 21130 Wardell Road appealing a decision of the Chief Building Official referred to the Planning Committee. Dr. Guichard spoke on his own behalf. 11. Letter from Oz Chapter, Children's Home Society requesting that Brockton Lane at Prides Crossing South be closed to through traffic from 9:00 a.m. to 4:00 p.m. on May 5 for a charity fund raising approved, upon staff determination that homeowners and homeowners associations in the area d9'not object. 12. Letter from Mr. & Mrs. Frost and several neighbors com~enting on the restriction which .has applied to accessory structures in rear yards and requesting review so that detached garages can be constructed referred to staff for consideration and recommendation to the Planning Commission and the Council. 13. Letter from M,J. Donohoe, 20217 Franklin commenting on Joseph J. Sunseri's letter noted. 14. Letter from Town of Los Gatos attaching letter from residents of Rinconada Hills calling attention to the condition of Pollard Road refferred to Public Works Dept. for study and report. l5. Letter from Saratoga City Employees Association commenting on salary proposals considered. B . ORAL 1. Sam Serchia commented on his letter concerning obstructions at Highway 85 and Blauer. The City has contacted the State since this is within their jurisdiction and will follow up with Division of Highways if a response is not received soon.
