C, APPOINTMENTS
Mayor Robbins commended Parks: Commissioner Rose Aberle and expressed
regret at her decision not to' serve a~other t~r~. He directed that a
certificate be issued for her service to the City and announced the
appointment of Mrs. Sarah Jane Rose for the term August 1971 to August
1973. Mayor Robbins sdministered the oath of office. Mayor Robbins
reappointed Parks Commissioners Norm Matteoni and Tom Wilberding from
August 1971 to August 1973oterms.

A. SDR-908 - JOE N, NEVILLE - PIERCE ROAD
Adopted Resolution SDR-908-l, granting final building site approval.
B, SDR-917 - DONALD TENENBAUM - SARATOGA AVENUE AND COX AVENUE
Adopted Resolution SDR-9l7-l, granting final building site approval.
V, PUBLIC HEARINGS
A. SARATOGA GENERAL PLAN
1. RETIREMENT HOUSING ELEMENT
Public Hearing opened at 8:25 P.M, No one in the audience wished to comment.
Public Hearing closed at 8:26 P,M. 'Continued to September 1, 1971.
2. GENERAL PLAN REVIEW FOR 1971
Motion carried to retain Fruitvale Avenue as four lanes on the General Plan.
Staff authorized to proceed with a study of the Foothill Lane-Pierce Road-
Ashley Way area. No one in the audience wished to comment. Public Hearing
closed at 8:35 PM. and continued to September l, 1971.
B. ORDINANCE NS-3.29
Councilman Smith read the Planning and Environmental Committee report dated
August 18, 1971 recommending a comprehensive study of the feasibility of
creating a special zoning district possibly named "Institutional Zoning
District." Public Hearing opened at 8:40 P.M.
Stan Berliner, Attorney, lOO Park Center Plaza, San Jose representing Noorudin
Billawalla strongly concurred with the recommendations of the Committee. He
requested that the General Plan be amended to designate the Billawalla parcel
as convalescent use in the 1971 General Plan. Public Hearing closed at 8:43 P.M.
Continued to October 6, 1971.
C. C-137 - ALFRED F, DUMAS, INC, - PROSPECT ROAD
Planning Environmental Committee recommended approval subject to conditions
outlined in a memo of August 18, 1971. Public Hearing opened at 8:50 P.M.
Win Westfall, B.T.N, Engineers spoke in support of the application. Art Grafe,
l212l Saraglen presented a written appeal that the application be denied.
Frank Ziegel, representing the Northwest' Saratoga Homeowner's Association,
asked the Council to approve c-137 as a "PC"concept with 17 lots. Public Hearing
closed at 9:l2 P.M. Mayor Robbins expressed reluctance to establish a precedent
of a 10% bonus. Adopted zoning change ordinance NS 3-zC-6l.
D. C-l46 - AUBREY JOHNSTON - QUITO ROAD
Public Hearing opened at 9:27 P,M. Planning Commission recommends denial.
Mr. Johnston stated he had declared hardship to the State Highway Department
which had purchased the surrounding property. He felt he could not sell his
property unless it were zoned commercial. Public Hearing closed at 9:37 P,M.
Continued to September 1, 1971 and referred to the Planning Committee to meet
with Mr. Johnston.
E. PUBLIC HEARING ON FORMATION OF SARATOGA VILLAGE UNDERGROUND UTILITY DISTRICT #4

Public Hearing openèd at 9:37 P.M. City'Manager noted one communication from
,Mrs. Frances Anderson supporting formation of the district. Mrs. W. Worden,
:jowner of the Cottage ,~roperty, stated they had not received Mritten notification.

Mr. Mason Shaw also spoke in favor of the district but asked that a'concfse estimate
of cost be determined and that the matter be continued to a later date sò'that this
information could be disseminated to interested parties. Continued to September 1
to insure that everyone within the district is notified. Public Hearing closed at
9:50 P.M. Continued to September 1, 1971.
VI. ADMINISTRATIVE MATTERS
A, MAYOR
1. Called an Executive Session following the regular meeting for the purpose
of discussing personnel matters and a pending law suit.
2. Letter from Jerome A. Smith, Chairman of PPC concerning County-wide Parks
"'and Recreation study. Without objection, referred to Parks and Recreation
Commission for their information and comment,
B. FINANCE
1. Payment of Claims
Approved disbursements dated August 18, 1971 and authorized Mayor to sign
the warrants.
2,3, City Clerks Financial Report and Treasurer's Report - noted and filed.
C. COUNCIL COMMITTEES AND COMMISSION REPORTS
1. Adopted Planning and'Environmental Committee report on Village Development
Plan, in principle and directed Planning Department to come back with guidelines
'within thirty days.
2. Policy Committee report on City consent to Sanitary Sewer Assessment District
presented for information·only.
3. Staff directed to prepare plans for Franklin pathway in consultation with
the Parks and Recreation Commission.
4. Planning"Commission report on landscape treatment along Tract 4954 referred
to Planning Committee for review and report.
5. Parks and Recreation Commission report on development of Kevin Moran and
Wildwood Parks noted.
D. DEPARTMENT HEADS & OFFICERS
1., Status report on installation of temporary pathway in front of Arenchild property,
'(Tract 4954).
E. CITY MANAGER
1. Letters from Jennie Magid, Mrs. Gladys Riggle, Mrs._ M; Durr. Mr,s..__J.,,~k T"~~s--anð

4. City Manager stated he would be on vacation from September 1-6. Planning
Director to be Acting City Manager during this time.

A, WRITTEN
l. Letter from George Kocher and Larry Tyler concerning Village Parking
District #1 referred to Management Committee for review and report.
2..Letter from H. Wayne Clay, Chairman, Physical Education Division,
West Valley College noted and filed.
3. Letter from Division of Highways announcing hearing for September 8
concerning deletion of roads in the State Highway System. Public
Works staff directed to attend meeting.
4. Letter from Los Gatos-Saratoga Community Hospital indicating the
beginning of a pilot 'program of a mobile coronary care unit
noted and filed.
5. Letter from Gerry & Madge Hall supporting a park at Saratoga Creek
noted and filed.
6. Letter from Steve Abbey'indicating that he has located a carrier
for new insurance coverage which would include errors and omissions
coverage¡ refe".rea to Management Committee.
7. Letter from the Village Merchants Association concerning traffic
situations in the Village area.
8. letter from Mrs. Hines concerning removal of a tree on Sobey Road:
City Manager directed tq notify Mrs. Hines that the city has filed
a criminal complaint in ,this matter.
9. Letter from Green Valley Disposal acknowledging the President's
message'of ,last Sunday in relation to their request for an
increase in refuse collection rates and suggesting that the
city continue the study., Referred to Management Committee and
Scavenger Review Committee.
VIII. ADJOURNMENT
Mayor Robbins acknowledged the presence of Planning Commissioner Marshall;
Mrs. Eunice Stark and Fred Hubback, Good Government Group; Ginger' Sturm,
Leage of Women Voters; and Mrs. Richard Lorraine. Meeting adjourned to
Executive Session at lO:55 P.M, Council reconvened at 11:40 and adjourned
to 7:30 P.M. Monday, August 30 at the Crisp Conference Room to hold an
Executive Session on personnel.
