I. ORGANIZATION
A. ROLL CALL
Present: Councilmen Bridges', Diriden, Dwyer, Kraus and Smith
Absent:. None
B. MINUTES
Mr. Diriden commented that undar Public Hearings, WILLARD H~ LYNCH, it
should be specifically noted that the~p~operty would be secured against
entry during the 60-day period that w§s granted for submitting plans~
The minutes of July 5, 1972 were approved with the above addition.
II. BIDS AND CONTRACTS
A. HAKONE GARDENS JAPANESE TEA ROOM LEASE AGREEMENT

B. KEVIN MORAN AND WILDWOOD PARKS - COLLISHAW SPRfNKL~R dO., INC.
Councilman Dwyer ~oved that the work on these projects be accepted and that
the Notice of CompletiOn be filed and, the ~I0~'f~e~ee be rel'eased;
Mr. Kraus seconded the motion and it Was carried.
C. AGREEMENT BETWEEN CITY OF SARATOGA AND STATE OF CALIFORNIA FOR WIDENING AND
IMPROVEMENTS OF A PORTION OF STATE HIGHWAY 85
The agreement provides that the State shall submit plans and specifications~
for review and approval by the City, 'and the City shall deposit the amount of
$9,300 with the State within 30 days of receipt of billing, and the remainder
of the City's share will be determined after completion of the work. Con-
struction on this project is estimated to begin next summer. ,~~
Councilman Dwyer moved that the agreement be approved; Councilman Diriden
seconded and the motion was carried.

B. RESOLUTION N0. 622
Resolution Authorizing Execution of an Agreement with the County of Santa
C~ra;'for Transfer of TOPICS Funds

C. RESOLUTION NO. 624
Councilman Bridges moved for adoption.of Resolution 624, a Resolut'ion.
Supporting the Proposed Five-Year county Library Capital Improvement Program;
Councilman Kraus seconded the motion and. it was carried. There will be a
hearing before the Board of Supervisors on Friday, July 21,. 1972.
D. ORDINANCE NO. 38.48
The proposed 'ordinance relating to City Parks was introduced and will be
discussed at the Committee of the Whole Meeting on July 25, 1972; it will
then be agendized forB[~'~l~guiar-meeting of August 2, J972.
E. ORDINANCE NO. 38.49
Mr. Beyer explained that the propos~d~Noise Ordinance draft is of the same
basic format as that u~ed by the CityZof Palo Alto. The approach outlined
is that of measuring sound levels with a decibel meter.
Councilman Diriden commente~ that his primary concern is that the City would
take too long on this matter and that. it has already been two months in the
making. He further. commented that hei felt we should devise a sXstem!whereby
sound levels could.be measured and then updated periodically.
Mr. Beye~ was of th~ opinion that the~City would-be able to get.albetter idea
of how to approac~ this.. matter after.discussion at a Committee of the~Whole
Meeting.

Mayor Smith commented that the matter is-going to require some serious
study as well as more-technicali~for~ation.~
Mr~ Diriden commented that the City h~ ~o power to act~-i~ some-of the nois~
offense cases and that enforcementlis the important point.
Mayor Smith ordered the introdUhtion ~f the proposed Nois'e Ordinance an~
indicated that it would be further discussed at the July 25t.h Committee of
the Whole Meeting. -

Councilman Bridges moved that Resolution No. 36-B-140 b~ adopted; Mr. Diriden
seconded the motion and it was carried.

1. Mro Shook, Public WOrks Department - Plans for Saratoga-Los Gatos Road
'walkway have been completed and approved. Thi~ was originally planned
for funding through TOPICS funds..
Mr. Beye~ indicated that we will now be using Gas Tax money for funding
· of. this project.
Councilman Bridges moved that the City be authorized to go to bid on the
first portion of the walkway; Coungilman Dwyer seconded the motion.and it
was carried. e~f~' was ~'~k~d to communicate with the State regarding~j
lowering of~he'~e~d'fi~i~i~i~ ~o'n~ ........

D~mon~t~a~j~n~ Bicycle Route System report.and voice their comments.
City~Manager advised that this matter would be discussed at the
August 8th Committee of the Whole Meeting.
E. CITY MANAGER
1. Request for Funds by Parade Committee for 7th Annual Fall Festival Parade -
Councilman Dwyer indicated that he .is of the opinion that there is enough
participation in this activity that it could be put into a classification
with symphonies.
Councilman Diriden'inquired if it ~ould be appr6priate to underwrite the

Mr. [Craus commented ~hat in talking with some Of the members of the Chamber,
there seems to be some disagreement as to whether this is a community affair
or not.

Mr. Bridges indicated that the Chamber "festival" has been a proud affair
up to this point and-he would liketo see it continue. He~therefore
moved that the~City approve the amoqnt of $615 for the parade; the motion
was seconded by Mr. Diriden and carried.

Councilman Diriden stated that he would like the City Manager to bring
before the Council a proposal for an~a~'~l~'B~'in~Lf~n~e"tlax.
Mayor Smith advised that he would dot want th~proposal.to,be,,.a,:vehicle
for study for an Ordinance.
Councilman Bridges agreed that he would be opposed to a business taxation
ordinance. He continued by.saying'that he feels the City should take a
good look at its intent and where ~hese funds will be funneled to.

3. Reco~endat{on~ for Parameters on ~raffic 'Study.of Problem Intersections -
The Council reviewed City Manager's.reco~ndations. Some additional
reco~endatiO~ m~nti0ned were: Herriman Ave., :Reid Lane, Quito Road
at'Vessing and ~royo De ~guello.~
~. Beyer advised that the staff will be discussing this matter with
consultants once the study is actually begun.
4. Public Hearing Re: County Sanitation District No. 4
It was approved to set the Public Hearing to discuss Sobey Road and
Saratoga Hills Road/~s areas to beincluded into ~ouRty Sanitation District
LNo. 4, Sanitary Sewerage Project 1972-2. ~
5. ~. Beyer advised that the Rizo family has moved from the,property at
Saratoga-SunnyVale Road and are, a~ the present ti~e, living with their
son.

1. Letter from Attorney Rolf Bondelie ~Re: Relocation and ~andonmen~ of
Portion of Wardell Road - City Manager'will refer to staff and a report
to follow.
B. OR~
1. ~S. Mary Owen, 14180 Victor Place,~ brought to the Council's attention
that there were several students present tonight from West Valley College.
