It was moved by Councilman Dwyer and seconded by Councilman Kra~s that the
minutes of December 6, 1972 be approved. The motlob was carried.
II. BIDS AND CONTRACTS
A. QUITO-ALLENDALE TRAFFIC SIGNAL ~,__ ~-~ _ _~' .... ~
It was moved by Councilman Dwyer and second'ed by Councilman Kraus that
the COntract Change Order be issued to St~iny and Co., Inc., in the amount
of $489.66. The motion.was carried.
B. QUITO-~LLENDALE TRAFFIC SIGNAL - STEINY AND CO., INC.
It was moved by Councilman Dwyer a~d seconded by Councilman Diridon that
the Council not impose liquidated damages on the contractor and that the
work be accepted and the Notice of Completion filed. The motion was
carried.
C. SLOPE STABILIZATION - BANtq~ILL ROAD
It was moved by Councilman Diridon and seconded by CoUncilman Dwyer that
the Council accept the work on the above' project and authorize filing of~
the Notice of Completion. The motion was carried.

Mr. Walker. explained that the present use for this property is 'a combination
legal .non-conforming commercial antique store and a residence, known a~ the
Georgian House. He stated that other Structures on .the propert~de a

Mr. Walker stated that it is. the Planning Commiss'ion~s recommendation that
the application be approved subject to the conditions as outlined in the
Staff Report ~f~d~Noy~m~ 27 1972.
May'or Smith asked what the estimated number of tr~ps would be per'day to
and from a brokerage house. Mr. N,alker replied that there would be a maximum
of thirteen· employees coming to the office, and the amount of customers -

and that it has never been his intention to a aggrevate or'~in any way disturb
the other residents~in Saratoga. On the contrary, he indicated that he feels
very strongly toward the cause in ~ccomplishing the greatest amount of good
With the least amount of disturbanent Mr. Gray indicated that proposed
change as i~dicated by ~he Plan~ing Commission and staff Seems to represent
~he least amount of disturbance, and in addition,' it would provide a much
needed service in Saratoga, Mr. Gray added that when this.is. studied
logically and unemotionally, it would seem that the re~trictighs placed on
this proposal would remove all uncertainies. Mr. Gray indicated that un-
certainy causes fear and that he is quite sure that those who are not in.
favor of the proposal are more fearful of what future impact that may occur,
He stated that,~in effect, the request for change'of zoning.frgm Residential
Non-Conforming Commercial use to Professional-Administrative with restrictions
represents a~most no change in present use for future impact. He stated that
both the present and ~__~proposed uses represent low trafficS-low noise levels
uses and both revert back to residential. He stat~d.~that'.the restrictions as
outlined by the Planning Commission, there would not be any physical change
of the structure. There would be no additional buildings constructed on the
grounds and there is a limit.to the number of persons'permitted to work on
the<.R~f~ Mr. Gray indicated that it has never been his intent to destroy
this property, but rather, to upgrade and preserve it, He stated that an
investment brokerage house would be of definite.benefit to the community. He
asked, "What alternative uses could be as beneficial as this?" He stated that
most other Professional uses are out of the question. Mr. Gray asked, "Would
the addition of four or fiv~ homeszon this property actually benefit the
community?" He indicated that what these homes would do is eliminate the
present park-like grounds around the Georgian House~and idcrease ~he
intensity of traffic, thereby eliminating the tranquility presently enjoyed.
The additional traffic caused by these families and the various services
required wouldn't seem to represent an improvement to the area. Mr. Gray
stated that if this application is approved as proposed, you know that the
property will remain in its present natural state, Mr. Gray indicated that
there is no question in his mind about the permanence in their stay, but
if the city authorities wished to get a further.study of the use of the
property if it ever should revert Back to Residential, there would be ample
time to accompl ish this. In regard to the role of Sherson-Han~nill, Mr. Gray
indicated that they have fully supported this concept from the start and
they intend to spend from $25,000 to $30,000 for interior improvement. Mr.
'Gray .added that if this proposal did not 'present the right idea, it would not
have gone this far, and it has met many tests, including that of Shearson-
HammR~ and the Saratoga Planning C6mmission.
Mr. Dwyer asked Mr. Gray if he had a lease committment with Shearson-Hammitl
for any period of time. Mr. Gray ~eplied that there was a lease; hoover,
it has not yet been'signed.
Mr. Dwyer then .asked how many salesmen he would plan to have in the office.
Mr. Gray replied that he would guess nine or ten.
He asked Mr. Gray if he planned to~do cashiering? Mr. Gray replied that this
is done in the Palo Alto Office.
Mr. Dwyer asked Mr. Gray how ma~y' ~eople were in the Palo Alt'o Office. Mr, Gray
r~plied that there are approximately twenty. He further asked if this is a
typical Shearson~H~mm~_/~ office. Mr. Gray replied that it isf;much bigger and

more formal.
Councilman Dwyer asked if he expected t~' have anytraineeS in th~ office.
Mr. Gray ~eplied that a ten-man office Would not be profitable if the~ had

that he intends to provid~ the very~best service, and he intends to have ~
full house of top brokers,-
Mr. Dwyer asked' if any of the salesmen sold insurance. Mr. Gray replied
that they have a program but they hive not fully implemented it ~{nt~ their
system.
Mayor Smith asked Mr. Gray if he got tolhis full capacity of nine brokers
and four support workars~ what kind~of traffic woul~ he~expect to come into
'the office on a typical day, Mr. Gray stated that it is difficult to give
a broad figure on this; however they have an average~ of five to seven people
who come into the officein Palo Alto daily, and he would guess no more than
that figure. ~
'Councilman Kraus asked what kind of improvements they would make. Mr. Gray
replied those suqh as sprinkler sys,tem, carpsting, drapes. He added thai
they had no thought of.disturbing ,the interior of the house.
'MayOr Smith commented that in h'is past experienCe,, he has noticed classes
being donducted in the evening at this.ltype of operation and asked Mr. Gray ..
if this kind of thing would be taking place. Mr. Gray repl,ied that Ehere
may be times during the year, under certain unusual circumstances, they ~ould
do this sort of th~ng; however, it,is not an individual class, but it ~Duld
be for a specific informative leCtUre.
· Ma~,pF Smith asked Mr. Gray what heland his investors would do if Shearson-
%Ha,_.~_~would want them to withdraw f~om the Saratoga s{tuation. Mr, Gray
replied that the only tfme this would be a problem would be if Shearson ~ulled
out, but if this office is going to be,like he thinks {t is'going to be, they
are going to be desirable clientS. However, if this did happen, if he couldn't
get-approval for'any other brokerage.firm', {t would go back to residential.
Mayor Smith asked if Mr. Gray has looked at other Professional space available
in Saratoga. Mr. Gray replied that he has non looked for another location as
he feels they must have something special to offer. The Mayor then- asked; if
he had understood Mr. Gray, to saX'lthat the Georgian House was important to
the production. Mr, Gray replied that "Yes, 6his would be a prestigous
place to have an'office."! Ma~or Smith st'ated that this would communicate
to him that they are going to have people there. Mr. Gray stated, however,
that what he meant was that those brokers who'were looking for a good pro-
duction were going t'o ~e attracted Eo this ho~se.
Councilman Bridges asked tHe,City Attorney if we could legall~ confin~ a
certain kype of zoning to ~ne~fir~. Mr. Giannini replied that if the applf-
cant agrees to that cohdition, he believes thislWould be valid.
The Mayor then asked for any comments from those in support. of this application.
Mr. James Benham of 20611 Ritanna Court iddieated th~tlh~ has known Batty
Gray for about five years, and stated' that he is one of the 'few people that he
can trust and believe. He indicated that he feels this~ project would have' a
good future and that it. would help Saratoga as well as himself.
Mr.l H. Mercer,~a res'ident"of Saratoga, sta~ed that he.was a friend of
Barry Gray and that he would ~ot like to stand in7 favor' of something ~fnich
he thought would be a di'sCredit to the town, but he felt this would be a
boon to the town, He indicaeed that he sees no reason why a brokerage firm
should 'not be in=Baratoga. · - -

Mr. Buford Bissell of 12790 Ions CoRrt indicated that he was here to speak
in favor of Batty Gray's application. He stated that he has visited the.
office in Palq Alto and it is iB an isolated area. He 'commented that he
has been to this-0ffice~probably three times in two years, and the people.'
he has found there have usually been brokers, usually on the telephone. He
felt that this would be to Ithe advantage of. our town.
The Mayo~ then asked for any comments on opposition to this application.
Michael Mahoney of Saratoga stated ~ha[ he would like to speak.in opposition,
mainly because of the traffic problem it'would c~se. He further stated that
he felt there were other type~ Of u~es available which w~uld not change the
zoning. , -. i .
Mr. Craig Moss of 20360tSara~oga-Los Gatos Road felt that ff this change of
zoning were granted, this house. wouid never.be suitable for ~esidential
zoning again. He stated that he believes the General Plan was created for
a specific reason, and that was to control Saratoga's growth, and that thid
application would help tO destroy this concept. 'He felt that the Planning
Commission approved this on the grounds that it is already under a Use
permit, and now they are trying to get out of the use permit for antiques
into a~brokerage finm. He further stated that this kind of strip zoning
would be bad in that Since 1967, the accident rate has ~ncreased to 466%.
He further stated that Saratoga and Los Gatos are becoming.known nationally
because of their antiques and historical monuments and. he doesn!t feel the
reality of the Georgian House has rdally been brought out. In conclusion,
he stated that he feels there is really only one way to. go on this and that
is to deny this request and any othdr application on the grounds that
residency is the best way to go.
Mr. Ed Mathiss of Westcott Drive stated that before the Council makes a
'decision on this application, hewould like them to give serious cbns~der~
ation to the wishes of the majority of the property owners surrounding the.
Georgian House.
Mr. Perrivani of Oak Place stated that he would like to khow what would be
done with the alley going into the ~lace. Mayor Smith commented that he
had heard the suggestion that the alleyway~ not be used, except for emergency
purposes. This would have to be written in the site approval. We 'would have
to specify,~also that better access be arranged to the property. This would
include acceleration and deceleration.
Mr. Perrivana further stated that he finds it hard to believe the earlier
discussion about the number of trip,s which would be taken by residents per
day and that he would assume that the ten or twe}ve people at thi~ estab-
lishment would be making a lot ~ore tri~s than this. Also, there would be
no definite insurance as to how many customers would be coming to this place,
Mr. Ralph Ramonaof Casa Blapca Lane'indicated.that he has reviewed' the file
and this application. He found in .this review that the existing .owner has
only signed a document for a lease purchase, so the leSal owner would no
doubt be retained as ~he present owner. He furtherDindicated that at the
last meeting,- there was no mention;of any ~fate.planning, andLestate~plann~ng
is going to involve interviewing with many different people. Anpther point
made was that thefelectrical requirements under the 1970 Code are fantastic
as far as costs are concerned. Also, in reviewing the proposed plan, he noted
there were only twelve parking epa~es shown on the plan itself. He stated that
the requirements to subdivide a piece of property such as this are very severe
and could be faced with the requirement that it include two additional lanes
for the reason tha~ it was essential to the safety for ingress and egress..
Fir. Gray advised the Council that he had met with the Fire PErshall and
reviewed all the professional requirements for this property. In addition,
he advised that the number of parking spaces that were intended numbered
about eighteen. Fir. Gray indicated that the State planning which is done
in their Palo Alto office does not really add to' the traffic flow. With
regard to the alley, Fir. Gray stated that it was decided they would not use
it. Concerning the traffic, Fir. Grgy felt that this would not create a
-problem as their hours would be fro~ about 6:30 in the morning to about
12:30 in the a~ternoon.
Fir. Peter J. Passetta of 20251 Saratoga-Los Gatos Road voiced his opposition
to this application for change of zoning.
It was moved by Councilman Dwyer an~ seconded by Councilman Kraus that the
public hearing be closed. The motion was carried. 'Public hearing closed
at 9:35 P.M.
Mayor Smith commented that it is e~ident to him there is a very difficult
traffic problem here. In addition,I he stated that he feels the very best
use for this area has already been designated, that being "R-i".
Councilman ~D~rT~was of the opini'on that this office w6uld eventually
generate a lot of traffic. He further commented that we haven't begun toj
exhaust the ideas of creativity in Saratoga and thatto.his knowledge,
there have been bnlyth~ee' pr6posa~s'for the Georgian-House in the 'last
five years. Councilman Dwyer indicated that he felt very strongly opposed
to the Planning ConEnission~e~6m~e~dation.
Councilman Bridges stated that he ~as opposed to ~ny type of strip zoning,
and even if this property were to be developed into "R-i", there ~ou~d still
be a very bad traffic situation to!correct.
Councilman Kraus commented that he,was very concerned about the traffic in
this area, and therefore, his vote would be to deny this application.
Councilman Dirid'on moved that the recommendation of the Planning Commission
be denied; Councilman Kraus seconded the motion, and i~ was carried.

C-160 - GEORGE W. DAY, FRUITVALE AVE. - Request for Change of Zoning from
~ ~'q~"A" (Agricultural) to 3FR~l-40,O00 P.O."
(Single-Family Residential-Planned Community)
The Ci~ty~Manager,!Fir. Bey~r~_expl~ined that this matter was first .scheduled
on December 6, 1972, and it was then continued to a Committee of the Whole
Meeting on December 12. He stated that there was no new information sub-
mitted and no new staff recommenda'tion since that time.
Vice MayOr Dwyer opened the public' hearing at 10:10 P.M. There were no
comments from the audience; therefore, Councilman Kraus moved that the
public hearing be closed.' Council.man Bridges'seconded the motion and it was
carried. Public hearing closed a~ 10:12 P.M.
Councilman Diridon asked if there had been any additional thought given to.
making a right-of-way into Herriman. Fir. Beyer replied that the concept was
that this would be left in some type of green space and thatI~!~Dwould be
used as an emergency access road.
Councilman Diridon stated that it is his recollection that this road,is much
wider than is needed for emergency access, and if the rest of it could be
made into some type of formal green area, it would be minimum maintenance.
P~anning Director Stan Walker advised that this particular metter would come
under Design Review for th~ devel6pment of the landscaping of this particular
area.

Councilman Bridges moved that this request for rezoningbe granted and
that the staff be asked specifically to follow the treatment of the
access road through Design Review. Councilman Kraus seconded the motion
and it was carried.
B. RESOLUTION NO. 650 - Resolution Approving Form of Resolution of intention
and Boundary Map and Granting Consent of the City Council
to County Sanitation District No. 4 to Undertake Proceedings to Construct a
Sanitary Sewerage Project
The City Manager explained that this was an informational public hearing
to provide citizens of Saratoga to express anyL,opposition prior to the
City Council adopting the resolution granting consent to the .Sanitary
District to proceed. He asked Fir. GOodman of Sanitation District No.-4
if he would like to make any specific comments about this project and the
area to be covered. ~
Mr. Goodman explained that this is ~!~project which was initiated by six
of ten residents in the area. 'He stated that he has aIletter from the
County Health o£ficer~ recommending sewers in this area. M3c. Goodman
explained that there would be a public hearing on the project probably in
February 1973, and at that time they will present the cost of construction;
however, what the District is asking for tonight is approval of the Resolution
of Intention.
Councilman Diridon asked M_r, Goodman if the construction of the sewerS. line
would follow the water course of Wiidcat Creek. Mr. Goodman replied that
most efficient sewerage system would follow the drainage, and they do
follow the creek fairly close. Counc~!man Diridon asked if this w~uld
require them to dig up portions of the creek. Mr. Goodman replied that
it~would!hot~but that they would be.crossing the creek and paralleling it,
and they would design the sewer to be of the minimum 4epth.
The public hearing was opened at 9:25 P.M.
Richard McEllowin of 15255 Peach Hill Road stated that he recently purchased
this property, and one evening he'came home and found sdrvey stakes 6n his
property. On another occasion he came home and fnund holes dug in his
driveway. He indicated that he called the city offices, and they didn't
know what this was about. He then called ~S~E'~.~J'~/l~t~o_?~,_a.~_~.~_t~ey ex-
plained that it was ~art of the sewer project. Dr. McEllowin stated that
at no time was there notification that this work was going to be done. He
stated that on another occasion he ~had heard posts bein% d~iven and he asked
[ the workmen very promptly to leave. The Sanitary District~esponded to this ~

tinue the work. He advised, however, that he feels he now has a working
relationship with the Districts, '-".~ He suF~ed that there be some method

'~ oQners at le~St"be given notification that this sort of thing is going to be
going on. Fir. McEllowin's second request was tha~ the Sanitation District
consider whether their present method is the only way to construct this project.
Mr. Goodman stated that on October'2, the District addressed a letter to
Dr. McEllowin indicating that six out of ten property owners in the area
wanted the sewer, and they assumed!that he knew there was going to be a
survey. Mr. Goodman explained that in ~egard to'the second point, they cQn~
make any proposals until they haveLcompleted the survey. He stated that they
have considered other alternatives and have made some concessions. Mr. Goodman
stated that the only inteiEuptions that might,.be made are during the construction
when there might be.some removal of trees. However, if'this did occur, they
would make arrangements for early replacement of any shrubbery. He indicated
that the District does attempt to put in the sewers in the most economical
fashion with least {amount of impact on the property owners.
Councilman Bridges suggested that the Sanitation District in the future
send the City a copy of the letter w~ich is sent to the property l. owners
prior to the undertaking of these projects. This was agreeable with
Mr. Goodman.
.Councilman Bridges moved that the public hearing he closed; Councilman
Kraus seconded the motion and it was'carried. Public hearing .closed at
9:40 P.M.
C~uncilman Bridges moved that Resolution No. 650 be adopted, with.the
provision that the District be given. permission to open the public streets
subject to coordination with our Public WorksCDepartment. CodRcilman Di~ldon
seconded the motion, and it was carried.
IV. SUBDIVISIONS, BUILDING SITES AND ZONING REQUESTS
A. SDR-922 DR. RICHARD WALLACE, PIERCE ROAD - 3 LOTS
It was moved by Councilman Iraus and seconded by Councilman Diridon that
Resolution SDR-922-2, granting final building site approval, be adopted.
The motion was carried.
B. SDR-IO04 BRUCE OWENS, LOMARIO DRIVE - 1 LOT
It was moved By Councilman Diridon,and seconded by Councilman Kraus that
Resolution SDR-iO04-1, granting final building site approval, be adopted.
The motion was carried.
C. SDR-1013 JACK L. BARTON, PIERCE RO.AD - 1 LOT
It was moved by Councilman Iraus that Resolution SDR-1013~i, granting con-
ditional building site approval~ be.adopted, with the compliance~fL~he
three conditions as outlined in the ,Building Site Approval Agreement. The
motion was seconded by Co'uncilman D~ridon and carried.

1. Payment of Claims - It was moved.by Councilman Bridges and seconded by
Councilman'Kraus .that disbursements 16424 through

C. COUNCIL AND COMMISSION REPORTS
1. Planning Commis~ioh - Report on P.P.C. Housing Plan ~ City Manager requested

withheld on this topic tonight and that it be referred to the~n~m/lttee
of the Whole Meeting. This was acgeptable to the Council.
2. County Drug Abuse Coordination Con~nission - Drug Abuse Priorities for 1973 -
Councilman Diridon moved that a statement endorsing the;~fforts of Mr.
Garner and his staff and communfcating the City's support of.theprogram
be submitted. The motion'was seconded by Councilman Bridges and carried.

1. (~arles Huff, President Prides Crossing Homeowners Association, regarding
the additional tennis courts at the "mini-park". He felt that the people
with plans to purchase homes inlthis area should have been forewarned be-
fore the use permit was issued. Vice Mayor Dwyer indicated that there
had been several public hearings regarding this subject over a l~ng period
of time, and there was a lot of citizen inpub during this time.
