A Resolution Amending ResolutionlNo. 85-9 ana 85-9.4, Revising Salary Ranges,
Personnel Policy and Fringe-B'enefits :for .Employees of-.the. City'of Saratoga
City Manager Robert F. Beyer-explained that this resolution pertains to two
categories of city employees -- manag'ement employees and non-management
employees. He explained th'aE the first diScusSion this evening would pertain

January 2nd, he and the Salary Committee had been discussing a twelve-month
proposal with the hope of signing a Memorandum of Understanding' however,

The City Manager indicated that On January 9th, the employees' representatives
submitted an eighteen-month proposai. This proposal was r.eviewed,~
and he submitted an answer to it, which was basically an expansion of the
original twelve-month proposal. He explained that the latter proposal was

Mayor Smith asked for any co~ents from the 'audieRce.
DaVid Leahy, Attorney representing the Employee's ~sociation, indicated that
the two areas of disagreement between the City Manager .and the ~sociation
in,~the eighteen-month proposal are as. follows: 1) One-percent increase for
the Maintenance Man Iposition; 2) &oSt of living increase would be based
on the Consumer ~ice Index for one-half veer. He pointed out that {t was
the ~sociation's feeling that the~livf~g~i~e~S~Y~'B~based on
the Cons~er Price Index for a full'[~f~2~[' pe~iga, ~'~i~B', 'that the
Maintenance Man position be given thi~ cost of living increase.
~. Leahy indicated .that one of the other points .that made the e~ghteen-month
proposal' attractive wasthe increase in health insurance. He pointed out that
the resolutioh which hap been presented~ to the Co~cil thi~ evening does not.
, include. a provision for any change in~ overtime compenpation for a n~ber of
- cl~asses in the professional +and technical positions, whereas the eighteen-
month proposal tnclude~ a provxs~on f~r changing the overtime compensation to
equal thdse benefits of other employe~s.
Mr. Leahy stated that what he would like to see the Council do this evening
is not to take any action, but ~irect~[he City Manager to meet again with
the Salary Committee and come back w{th a proposal which is jointly agreeable
to the employees and the City Manageri
In.regard to,~the_c~st'!of tivihg increase, Mr. Beyer '~ndicated that the
adjustment for the cost of living to be made a year from now for the ~rior
six months would be made on the basisof the previous six months.
Mr. Leahy stated that the 'six-month cost of living ihcrease doesn't make
sense in that what the Council would be doing is picking up a compensation
package which is going to be changed within the next six months. He felt
that to dse the cost of living .was fine, but to cut it in half does not make
sense.
Bill Fritz, Business Representative o~ the' A.F.L.C.I.O., commented that in
December, 1972, Local 101 requested r~cognition for the purpose of meeting
and confering in good faith on behalf~ of .six employees in the Public Works
Department in the Maintenance Man ser~es. The City Manager 4ha~?~d~.n~ied this
request and pointed out that the individual employees .could epr sent them-
selves. Mr. Fritz stated that last Friday.two of these employees had met with
the City Manager, and after the City Manager had listened to these employees,.
he announced that they would receive ~what the Association is receiving and
nothing more. Mr. Fritz felt that th~s was bargaining in bad faith, parti-
cularly since what the management team was proposing was. only a 1 percent
increase for the Maintenance Man II. He pointed out that the Consumer Price
~a?~r~47-~lh~eL"~t'S~b~r'D Mr. Fritz stated that he would
like to j~..'~L~[y~i~equ~s~' th~'~he Council not take action on this
resolution tonight.
The City Manager indicated that when he had originally presented his counter-
proposal and until just recently, it' was his understanding that the 1 percent
increase was acceptable. It wasn't until he and the Salary Committee started
talking about the eighteen-month proposal that they'started discussing the
Maintenance Man s~lary. The City Manager indicated
his proposal, he felt the increase was reasonable.based on competitive positions.
He stated. that it wasn't until last Friday that these two maintenance employees
came in and presented him with a letter with "contract demands" pertaining to
the six employees involved, and this was the first time he had received any
information particularly about what these six people wanted.
Mr. Fritz commented that he doesn't ~nderstand how the City Manager can say
the salaries are competitive for the .Maintenance Man position. He again
stated that the cost of living has gone up 4%, and it is his feeling that we
have to look at the needs of these men.

Understanding by January.
Mayor Smith stated that as he understands the eighteen-month proposal with
regard to the cost of living based on the Consumer Price Index, there would
be an increase, effective January, 1974, for a six-month period, which would
be determined in the cost of living for the six-month period between July, 1973
to January 1974.
May~r ~mith asked if the City Manager~had an a~erage increas'e for the
!twelve-month proposal. i~r. Beyer replied that the twelve-month proposal~
ba~ed on salaries and benefits is 5.59%.
Councilman Dwyer asked if the beRefits for the Maintenance Man were included
in th~ 1% increase or if they were ab6ve that figure. The City Manager re-
.plied that th~bene£its were on top of this 1%, which would amount to an
Overall 3%.
It.was moved by CoUncilman Bridges ~hat this matter be~coDtinu~d to
January 30th and the C~ty Manager be directed to again meet with the Salary
Committee in the hopes of reaching an zagreement. Councilman Kraus seconded
the motion, and it was ~carried. Th'e adjourned meeting will resume on
Tuesday, January 30, 1973, in .t~e City Council Chambers.
