A. ROLL CALL
Present: Councilmen Kraus, Bridges,~ Brigham, Diridon and Smith
Absent: None.
B. MINUTES
It was moved by Councilman Bridges and seconded by Councilman Kraus the
minutes of the Special Meeting on March 12 and the Adjourned Regular Meeting
on March 26, 1974 be approved. The motion was carried.
C. VIDEO TAPE PRESENTATION BY FOOTHILL ELEMENTARY STIrDENTS RE: BICYCLE SAFETY
The Mayor introduced Leo Landin, tealcher at Foothill School, who, in turn,
introduced some of his students who ,participated in the filming of the
video tape. He then gave a fifteen-minute video tape presentation,on
"Bicycle Safe~y".
Mr. Landin indicated that this film would be available to schools throughout
the district. He .explained that the ~l~7, t.~ies to bring out the greatest
causes in bicycle accidents.
Following the film presentation, Maybr~,Smith presented a, proclamation which
establishes the month of April, 1974 as "Bicycle Safety Month".
II. BIDS AND CONTRACTS
A. RECISION OF CROP AGREEMENT -I<EVIN MORAN PARK
Agreement between the Cit~ of Saratoga and Chris Ljepava for Farming,
of Approximately 10.3 Acres of Real Property on Scully Avenue
The City Manager explained the staff is recommending rescinding this agree-
mentas the individhal presently res'ponsible for=maintaining this property
in the prope~ manner'has not been doing so. He stated that in order to
preserve the crops this year, it is necessary to make the recommended change
and rescind the present agreement.
It was moved by Councilman Bridges ahd seconded by CoUncilman Brigham the
Crop Agreement bedween the City and Chris Ljepava for maintenance of orchards
on Keyin Moran Pa~k property be rescinded. The motion was carried. (The
City Attorney advised that the word "terminated" should be substituted for
rescinded" and the minutes should reflect same.)
B. NEW CROP AGREEMENT - KEVIN MORAN PARK
Agreement between the City of Saratoga and George J. Wightman for Farming
of Approximately 10.3 Acres of Real Property Located on Scully Avenue
THe City Manager explained this proposed Agreement has been written to
cover the 1974, 1975 and 1976 crop yearsi'

C.AGREEMENT OF SALE AND COMPROMISE BETWEEN THE CITY OF SARATOGA AND
T.YLER/KOCHER
The City Manager explained this agreement would accomplish the follDwing:
1) City to purchase 24,016' square feet of property .on the southeasterly
bank of Saratoga ~reek, together ·with 500 square feet in Parcel 1 and
4,950 square ~eet in Parcel 4, as an addition to Wildwood Park.
2) City to divide and split the'assessment between that portion of Parcel
No. 2 being purchased by the City and that portion of Parcel No. 2 being
retained by Tyler/Koc~er~
In-addition, the agreement cuts b~c~ the formerly proposed development of
parking spaces:which would have come about with the realignment of the
creek, but'provides that the City would reimburse~Tyler/Kocher for assess-
ment payments made by Tyler/Kocher for.18 off-street vehicle parking spaces,
at a sum not to exceed $15,457.38. It is also agreed that the City,at some
future date, would construct an underground .storm drain in the storm drain
easement g~anted the City.~' _-..~z~t.

It was moved by Councilman Diridon and seconded by Councilman Bridges that
the Agreement between the City and Tyler/Kocher be approved. The motion
was carried.
I!I. PETITIONS, ORDINANCES AND FORFLAi RESOLUTIONS
A. RESOLUTION ~O. 85-9.13 (Con~'d. from 3/20/74)
Resolution Amending Resolution No. 85-9.8 Adding to Basic Salary Classes,
Employment POsition Classifications and Compensation Schedule for Employees
of the City of Saratoga.
It-was moved by Counc{lman Diridon and seconded by Councilman Bridges that
Resolution No. 85-9.13 be approved, .with the adjustments to be effective
March 1, 1974. The motion was carried.
B. RESOLUTION NO. 85-9.14
Resolution Amending Resolution No. 85-9.8 and 85-9.12, Adding to Basic
Salary Classes, Employment Position ClassificatxSns and Compensation Schedul~
~or Employees of the City of Saratoga
It was moved by Councilman Kraus and, seconded by Councilman Bi~ham that
Resolution No. 85~9~14 be adopted. The motion was carried.
C. ORDINANCE NO. 38.54 (Second Reading)
Ordinance Granting a Franchise to S~ratoga Cable Television~ inc.~ to
construct~ operate and Maintain a Cable Television System within the
City of Saratoga

It was also recommended paragraph 3 in Section 6 be modified to indicate
a Line Assessment Charge, rather "the" Line Assessmerit Charge . . .
This change 'was recommended for purposes of clarification.
Councilman Bridges commented that he* feels a lot of time has been spent
by many people in an attempt to produce a quality cabl~i~system. He therefore
moved that Ordinance No. 38.54 be adopted as modified and the reading be
waived. Councilman Diridon seconded~ the motion, and it was carried unanimously.
IV. SUBDIVISIONS, BUILDING SITES AND ZONING REQUESTS
A. SDR-1085 RICHARD CALARCO, PALOMINO WA?, 1 LOT
It was moved by Councilman Diridon ahd seconded by Councilman Iraus 'that
Resolution SDR-1085-1, granting Final Building Site Approval, be adopted.
The motion was carried.
B. TRACT 4477 STONESON CONSTRUCTION CORP., SPRINGER & BIG BASIN WAY
It was moved by Councilman Dir~don and sec'onded by COunCilman Iraus that
Resolution 36-B-145, Accepting Dedication of Streets for 'Tract '4477, be

adopted and the Faithful Performanc~ and Labor Materials Bonds be released.
The motion was 'carried.
V. PUBLIC HEARINGS
A. PROPOSED LIBRARY BRANCH FACILITY
Consideration of the Reh~mmendation of the Saratoga Library Commission
Regarding the Proposed Library Library Facility in the City of Saratoga,
The City Manager brough~ the Council up to date on the status of the library
site location. He indicated that in December 1973, a public hearing was held
b,efore the Council in December and continued.'. ~f~matt~rr~as~,'r~ferred to the'~
Library C~mmission for further consideration. The i{5~r~"C0mn{~ion held a
public hearing on February 14, 1974~ at which time testimony was presented
regarding four site alternatives: !) Corner of Cox Ave. & Saratoga-Sunnyvale
Road; 2)~Congress Springs Park Site, off Cox Ave., near Glenbrae; 3) Saratoga
Avenue near Cox Ave (between Medical Clinic and Vineyards); and 4) Civic Center.
The Library Commission met again on February 19th to consider the input ~f~om
the public 'hearing on February 14th !and made the following recommendation:
Site No. 3 be selected and the CounCil~{~fze.the City's entering into a
lease agreement with the County of Sant~ Clara.
The City Manager advised that present this evening for this continued public
hearihg is Miss Barbara Campbell, COunty Librarian, and Dr. Wallace Hall,
Chairman of the Library Commission.

The Mayor opened the public hearing:at 8:40 p.m.
Mr. G. Carlson~ 12334 Brookglen Drive, indicated he had spoken.at the
previous public hearing regarding this matter, primarily for the purpose
Of achieving a'three-!ibrary systemsinstead of tw0.._H_~_j~a~ed, h___o. wever,
that after reviewing the 'cost analysis inf0rmation'proy~ b7 the~County,
he no longer feels the three-systemlconcept would be practiCal'~ Therefore,
he indicated the Saratoga Council of Homeowners' Associations, which group
he is representing, would agree with the recommendation of the. Library
Commission,'but ~ith slight reservation. He stated that before the Quito
Branch was opened, the City of Saratoga'was contributing money to the County
for which they were not receiving services back; therefore, it was his con-
tention we should "use everything on the table", and also, the City should
work through the County to see that ~this situation' doesn't~st in the future.
Mrs. U!mer, 13004 Paseo Presada, commented that she artended the first City
Council'Meeting when this matter firsE came up, and she could affirm the
whole process which has been undergone. She stated it had been.requested
that the Quitoarea be investigated for a possible site location, and she
felt this was a very consistent resdlt.
Dr. Hall stated this determinati'on qomes as a result of a good deal of'~ive~
and-take" by the Council, as well as the Library Commission. He felt that
minds of the commissioners were open at the preEious public hearings, and<as
a result, some minds were chan~ed
A resident of 19804 Colby Avenue ind, icated he supported Mr. Carlsongs state-
ment that since Saratoga.has been '~s~ort-changed" in the past~ precautions
should be taken!in the future.
It was moved by Councilman Kzaus ~nd seconded by Qouncilman Diridon the
public hearing be closed'. T~e motion wa's carried. The public hearing was
closed at 8:50 p.m.
Councilman Bridges asked if this site location lies within the zones of the
Transit District..~ Mr. Shook, Directlot of Public Works, indicated this has
been discussed wit'h the Transit District staff and they anticipate no
problems with this location With regard to transportation as the dial-a-bus
system would be operable in this zone.
Councilman Diridon commen~ed that he would share the concern voiced by two
homeOwners this evening with regard to the City's l~o~[~bUt~o~~ t~'~h~ C6unty
!~_~b~.a_~;~y~C~mT/~ervices which it never received.' '~e°[h~f~re'fndicated
he,woUld!=~ket~'caution very vigorously against this type of ret~u_~n~
and he felt this surplus shoul~ be Utilized by the C6unty to provide better
service to Saratoga.
It was then moved by Mayor Smit~ and seconded by Councilm~n Diridon that the
one major site be located at the Saratoga Avenue-CoxAvenue location, as~
recommended by the City's Library Commission,,and theICiYy~'~M~g~ 'be ~Uth~rlzed
to enter into negotiations regarding ~th~ ~6h~eI ~f~[~p~0~erty .and~_t~ ~enter
into!!a lease agreement With the Count~ ~rl~
carried unanimously.
Dr. Hall commented he would urge t~a~ the City proceed, with more than deliberate
speed so construction can begin and the facility ready by the termination of
the Quito Library lease in 1976.
B. ALLEN DE GRANGE, COX AVENUE
Request for Change of Zoning from "P.A." (Professional Administrative) to
"R-M-4,000" (Multi-Famil~ Residential) 1.284 Acres Fronting on the North
Side of Cox Ave.~ Immediately East o'f the Prince of Peace Lutheran Church

Mayor Smith advised that this is a.~earing de novo set as a result o~
an appeal ofthe Planning Commission decision to deny this re,best for
rezoning.

~t~ R~i, dated Februray 14, 1974. Reasons given for this d~'nial ~e~ as follows: 1) the application is ~ot timely relative to on-going studies;
2) ~he request, as presented, cannot' demonstrate that the intent of objectives
contained in the Zoning Ordinance will be met; and 3) the request would not
be consistent with the pending Gener'al Plan which recommends'the property retain
its currently zoned land ~se. AlSo,~ it'was fel~ that a precise plan of the area
would be needed be£ore rezoning courd occur. Mr. Rowe advised this property
was rez~ned in 1973 from ~I~l~8~i~g to't~'%ts present "P.A." (Professional
~dministrative) zoning, and at ~e~im~ 0f'this Change, it was ~irected that
the p~rcel be retained in the designSarid zoning ("P.A.").
The City. Manager indicated there hadl been a communication received from
Reverand Stanley B..Andersen, Prince! of Peace Lutheran Church, in support
of this.change of zoning for the purpose of coRstrncting an apartment complex
for 'senior citizens. ~!

Mr. Allen De Grange, the applicant, addressed the Council and advised he
is making thisrDr~p~.l/forchange,0t zoning for'thelpurpose of constructing
a r~tirement h0~s%~gT~O~Ct.~ He Indicated that mahy p~ople upon reaching
retirement are having'to leave thelC~ty in order tozlocate adequate housing
with low maintenance reqUirements.~t~'~'j~ed~tha~[~& proposed project ~ould
consistof fourteen units on two acres of ll~nd~ ~welve of these units would
be on the ground floor, and the desig~of the complex would resemble a group
of cottages, rather than apartments.z Mr. De Grange described the proposed
project and indicated he felt this w~s~i~t~i~'°~ood planning.
Mr. DeGrange commented that there. is~presently an over-supply o~ "P.A."
zoning in the area, and some of thes~ office buildings are suffering from
large vacancies, referring .specifically to the Abrams and Ramona office
buildings. Mr. DeGrange further poiBted out that in the proposed General
Plan Objectives, Policies,'Actions one of objectives is to provide housing
alternatives for Saratoga senior citizens. Also, under Community Planning
Policies, it is/~e~o~'nde~ that the, City encourage development of residential
· h~using for senior citizens.
· The applicant continued in stating there are very few housing units in.S~ratoga,~~
~7_an~~ gld~I~il±~en~fw~o.~ish to rent ~eally don't have the opportunity. 'Wi~'-
~g~ra~'th~'I~r~viSu~ ~zoning, Mr. DeGrange commented that he felt this had
been recommended by the City. Mr. DeGrange was of the opinion that because
the Zoning has changed recently~_~ ~.~.~ ~I _ ..... ~-.

this application for 'change of zoning from "P.A." to "R-I-~'~/~
Councilman Kraus inquired what ~m~'~t~ 7~Ofi~a'b~"~g~i~d~ ~0~ -"~6~e
elderly in this proposed housing project. ' ""
Mr. DeGrange stated there a~e many amenitieso He indicated that according
to FHA requirements, 10% of theunit~ must be set up for the handicapped,
such as bars in the bathroomsI, etc. ~HoweVer, he indicated that he was assuming
mostof these people would be healthy and vigorous. Mr. Degrange stated that
the proposed housing would ~e~designed for upper-middle income people who are
living alone. He further stated that the average monthly rental would run in
the neighborhood of $300.

Mr. Rowe, Acting Planning Director, pointed out that the Pi'anning Commission
considered only the'matter of land use on this application, and not housi~ng
for senior citizens -- this was not an issue at the time. Mr. RoweI~it {t
~nnc~'£~a~f~ih~"this may be an'ideal use for this parcel; however,~'[~''~
Y~r~'ff"Y~7o"~lT'~':~o~sidered under a comprehensive plan.
Councilman Kraus asked Mr. Rowe if ~e had received any homeowner input with
regard to this proposed change of zoning· Mr. RowF, reported there was no
organized appeal filed against the ~roposed zoning change; however, there
were three or four letters received pertinent to this issue.
The City Manager, in reviewing this file, advised there was'a petition,
dated February 13, 1974', ~ith approximately six signatures of residents in
the area of Cox Avenue and Radoyka,.indicating their concern that the
essential character of this parcel remain the same and they be notified of
any proposed zoning changes. He again made reference to the letter from
Reverand. Anderson on behalf of the Prince of Peace Lutheran Church, expressing
' support of~d"[~j~fn~-."pf6]ect for senior citizens. He also noted a
letter from~s.'Ba~ka~,'~entin~ Challenger Pre-School On Cox Avenue,
appealingto the Planning Commission to deny this request for rezoning.
The Mayor opened the public hearing:at 9:05 p.m.
Mr. Fred Christiansen addressed the"Council and stated he has been a member
of this church for approximately fourteen years. Mr'. Christiansen advised
that approximately sixteen years ag6 he purchased eight acres of this property,
and it was.the Church's desire that'Zthree acres of this property be retained,
and the remaining two s'egments, one !of which the Presbyterian Church is now on
and the segment Which is under discdssion at this time. He stated that the
r~zoning which took pla~e approximaeely two years ago~from Agricultural to

· . , was done primarily to dispose of the property to.comply with the
wishes of the Church. Mr. Christiansen advised the Church has no future
plans for this property and they do not wish to be saddled with taxes. He
stated he would'be ful.ly in favor of the use which Mr. DeGrange is proposing
for this property.
Mr. R. E. Kaufmann, 20700 Fourth Street, indicated he didn't know Mr.
DeCrange per,sonally and does not have an interest in this matter for himself~
However, he commented' he felt this ~ocationwould.=be !good for retirement
housing since it is near a shopping center, a library, it is on a public
· thoroughfare where publ. ic transportation is available, and there is no place
in the City where one can"find all.~hese a~sets together.
Councilman Kraus asked what Mr. Kauf~ann's feeling was regarding the proposed
rental fee. Mr..Kaufmann'replied that it is not the range he would like to
see, and one-woull~ ~e&d~ .'iH~e . ~to~$!~,200.
Mrs. Katherine Sturges, a member of'the Prince of Peace Lutheran Church,
statedshe felt the proposal is an e~cellent one; however, she agreed that
$300 per month is onre~sonable. She'suggested allowing more units to hel~
lower this amount.
Mr. Charles Huff, 12725 Miller' Avende, commented 'that he felt $300 per month
would be out of line, and he inquired about the possibility and economic
advantages to allowing for a larger facility.
Mr. DeCrange indicated he didn't feel a larger project would necessarily
lessen the rental to any great extent, unless there is some future reduction
in land cost.

Mr. Kaufmann asked if ~it is possible the City has made its restrictions
so tight that it is impossible to put up ~ building for any .less than $300
per month rental. He-suggested that the City consider a revision to its
Zoning Ordinance.
Mayor Smith felt there-were m~ny factors involved here, and pointed out that
it ~ould ~ake a substantial change ~f attitude by .residents to allow a change
~h density.
Charles Smith, representative,zfrom the Planning Commission, pointed out to the
Council tha~f._~j~pproval hasn't ~et been given for fourteen units of
retirement housing on this property,' and he questioned if fourteen units
could even be built on this parcel of land.
Mr. Diridon indicated that the Good .Government Group reported a couple.of
years ago the ideal price range for ,this type of ~ousing!would be from $150
to $200 per month. He felt $300 would be well abo~e this'amount and didn't
feel the Council should relax its stand and settle for anything less than the
senior'_citizens could use. He felt .it might be good for the 'Council to look
at higher density for a price that would be compatible with that which could
could be paid by senior citizens in,Saratoga.
Itwas moved by Councilman Bridges and seconded by Councilman Kraus the
public hearing be closed. The moti6n was carried. The public hearing.was
closed at 9:35 p.m.
Mayor Smith commented he felt further consideration of this proposal, as well
as the whole question of "retiremen~ housing" should be considered during the
General Plan~d£~u~'ions. ,
Mayor Smith asked theirCity Attorn~y~if there would be any prejudice to. denying~'I"~
this application and raising it at ~ later time?
~City .Attorney Faber Johnston ad.vised that the Council could deny the appli-
Cation with prejudice or without prejudice. Without prejudice you could
prevent the application for the sam~ or similar request within a year. If
deniedwithout prejudice it permitsithe rezoning.application to come up
a~ain.
Following a brief discdssion'byt~e~Counci!, itwas moved by Councilman Diridon
and seconded by. Councilman Kraus that this application for rezoning be denied,
without prejudiqe. Themotion..was carried..
VI. ADMINISTRATIVE MATTERS

2. County of Santa Clara Proposed Ordf~nance Relating to Containers, i.e.,
Litter Control (Referral from Mayor's Committee,..Ineer-City Council).
It was moved by Mayor Smith andiseconded by Councilman Bridges that the
Council go on record in favor of the legislation as outlined in the pro-~)~
posed. County Ordinance and itslenactment.on a regional basis. The motion
· was carried.

B. FINANCE
It was moved by Councilman Bridgesland seconded by Councilman Kraus that
the list of disbursements, 19019 through 19110, be approved. The motion
was carried.
C. CQUNCIL AND COMMISSION REPORTS
A. Parks an~ Recreation Commission - Recommendation that the City enter
into negotiations with West Valley College to preserve and maintain
the t~ail ~long the eastern perimeter of the College. The City
Manager was directed to talk with the President of West Valley College
to see if the installation of the fence could be delayed~
Following.~a dis~ussion'6f. thislmatter by th~ CoQncil, it was suggested
by Mayor S~ith that a citizens committee similar to the committee for
"bike paths" be formulated for implementation of a trails system. The
Council concurred'with this suggestion, and-it Was indicated that
further discuss{on regarding the Ci~y~s trails system would take place
at the Genera~.-Plan hearings.
B. Councilman Diridon - Suggested s r~solution be prepared' naming Lois
Burke as "1973 CITIZEN OF THE YEAR". The City Manager advised this
resolution would be prepared.
D. DEPARTMENT HEADS~AND OFFICERS
A. Director of Public Works'- Repqrt Re: Long-term'bond posted for
improvement of Saratoga &ve. f~ontage, Saratoga Creekside Associates-
SDR-764.
It was moved by CouBcilman Kra~s and seconded by Councilman Brigham
the Council' approve th~ extensfon of this bond for one year. The
motion was carried.
E. EITY MANAGER .~ -
Second Quarter Cr{meReport - ~rime statistics reflect a significant
increase in most areas compared to the same period of time last
year. He indicated there was 1~2% increase in burglaries; however,
he pointed. out a large percentage of these were petty burglaries.
He indicated the value increase was 39%, but the average cost per
. burglary was lowered by 46%.
Councilman Kraus ~sked if the City Manager could make available
the same information to the Council on a monthly basis. The City
Manager advised this would be d~ne.
VII. COMMUNICATIONS
A. WRITTEN
1. Communication from Stephen H. I~odman, Manager and Engineer, County
Sanitation District No. 4, requesting the Council adopt the Resolution
Supporting the 1974 State Water, Bond Issue.

B. ORAL
1. Charles Huff, 12725 Miller Avehue, suggesting the City look into
the previous financial data [o'find out exactly how much the CiFy
~as short-changed in County librarF services during the past years.

Mr.~G~ Carlson suggested, End the~ Council concurred, that the County be
required to provide a cost audit ito the various cities in the Iibrary system
on an annual basis.
2. Cheriel Jensen, indicating she has not been successful in reachingan
agreement with the County Flood Control District regarding access to their
property for flood control purposes and proposing that the City take
action to accomplish one of the following alternatives: 1) allow dedi-
cation of the flood control' easement to the City for control of access.
2) continue to allow Flood Control access for maintenance purposes only.
Mayor Smith suggested Mrs. Jensen put into writing for the Council her
specific request and advised that this would be reviewed by the staff
for a report to the Council.. He ~indicated this would allow the Council
an opportunity to establish a guide for dealing with future problems of
this nature.
3. Dr. Isaac Abrams, requesting if a joint meeting has yet been scheduled
between the Council and the Planning Commission to discuss "Retirement
Housing".
Mr. Beyer advised that this discussion would be scheduled for the first
Committee of the Whole Meeting in May.
VIII. ADJOURNMENT
It was moved by Mayor Smith and seconded by Councilman Bridges that the meeting
be adjourned to an Execdtive Session for ~discussion regarding "Personnel". The
motiom was carried. The meeting was adjourned to an Executive Session at 11:00 p.m.
