I. ORGANIZATION

Present: Councilmen Bridges, Brigham, Diridon, Kraus and Smith
Absent: None
II. BIDS AND CONTRACTS
A. SARATOGA-LOS GATOS ROAD WALKWAY
The City Manager indicated that three bids had been ~eceived for this pro-
posed work. The engineer's estimate for the project Fas $24,720. The
low bid by M.C. Slack Company cam& in at $39,089.50 or some 58% above the
engineer's estimate.

After further discussion, Council~n Bridges moved and ~econded by-Council-
mn Kraus that the bids be rejected ~nd the staff be authorized to review
the design of the handrail as well as an alternative to the reinforced
concrete wall. The motion passed unanimously.

The City ~nager indicated that according to our traditional procedures
that it is time to authorize the calling for bids for the annual street
sealing program. He indicated that $75,000 will be in the proposed budget
which is the same level that appeared in the previous years budgets. It
was moved by Council~n Kraus and seconded by Council~n Diriaon that the
staff be authorized to call for bids for the annual street resurfacing progr~..

The City ~nager reported that he had received a letter from Mr. 0liver
outli~ing the work which had been done on the Pace property by an anthropologist
since the last meeting. Mr. Oliver outlined what had happened on the pro~ty
and that he had contacted three or four different anthropologists concerning
this ~tter prior to hiring one. He indicated that a number of tests had
been ~de by the anthropologist and it was his indication that based on the
surface findings there was no specific indication as to whether or not there
were artifacts underneath the ground.
Judy Berchold, ~resident of the Anthropological Society comented that she
felt an E.I.R. should be done on the property. She indicated that this property
was located in a lik~~ic~l area and feels it should be further
investigated through a~tho~ough E.I.R.
She further co~ented that the City should have a policy concerning archeologica]
sloes and provide~in the planning process for the protection of arche~logical
~resources. 'She in~;~ated that the .Archeological Society had developed a
procedure which ~ght be considered and presented this for Council
After further discussidn, it was moved By Council~n Bridges and Seconded by
Councilnmn Kraus that the ~ouncil reaffirm the position taken by the Plan~ing
Director in giving this project the Negative Declaration. This motion passed
unanimously. It-was further directed that the staff revilew the recommend-
ations submitted'by the Archeological Society and shbmit to the Council
recommendations on how potential archeological sites i~ Saratoga should be
evaluated and possibly protected.
It was further directed that the Planning Coremission onsider~ s one of its

conditions of approval the provision that areas within excavation on the
property be allowed access to by~ the Archeological Society so that they
could.survey the site while construction is taking place.
IV. OTHER BUSINESS
Councilman Brigham brought up the subject of the Council supp6rting
Proposition 5 on the June 4th~statewide ballot. It was moved by Councilman
Brigham and seconded by Councilman Diridon that the Council go on record
supporting Proposition 5. This motion passed by a 4-1 vote with Councilman
Kraus voting in the negative.
