II. BIDS AND CONTRACTS
A. CONSIDERATION OF REQUEST FOR RECONSIDERATION OF BID REaECTION FOR SEAL
COATING AND OVERLAYING CERTAIN CITY STREETS'- 1975
Mayor Bridges asked if there was a representative of McCarthy and Spiesman
present to comment on this matter. Mr. McCarthy, representing McCarthy
and Spiesman, identified himself and indicated he felt that the procedure
that the Council had followed and the decision made was unfair to him.
He further commented he felt that it set a poor precedent':for the City
and accepting bids for construction work. He thinks that possibility
we might have an unfair procedure here. He claims that they:had ~t. the
Piazza Paving Co. men in the parking lot after they had left their bid
off.
At this time, Councilman Matteoni came into the meeting at 7:45 P.M.
Mr. McCarthy in his closing remarks requested the City to reconsider
the original bids.
A representative of the Piazza Paving Co. claimed that the bid was late
due to the change in the specifications.
After some further discussion on the part of the Council, Councilman Kraus
moved and seconded by Councilman B~i'gham to rescind the previous action
of August 20th, rejecting the bi.ds. The motion was approved 4-0, with
Coundlman Matteoni abstaining.
Councilman Kraus further moved that the bidFconsidered at the August 20th
meeting be awarded to McCarthy and Spiesman, seconded by Councilman Brigham.
The motion carried 5-0. It was then moved by Councilman Brigham and
seconded by Couneilwoman Corr that those bids submitted on September 8, 1~75,
be rejected and returned to the bidders.
III. OTHER BUSINESS
_c~ Councilman Brigham indicated that he would like the Council to go on record
supporting the purchase of the E1Cerreno Open Space Preserve by the Santa
Clara Regional ParkiDistrict. After some discussion, it was moved by

Councilman~B~g~hd_seconded by Councilwoman Corr, that the Council
go on record supporting this purchase.
Councilman Matteoni then asked that there be some corrections in the
minutes of the previous meeting,[fA~s~"20~"lg~ and these were made.
The meeting was adjourned to Executive Session at 8:00 P.M.
