PETITIONS, ORDINANCES AND RESOLUTIONS. A. RESOLUTION NO. '799 Resolution of the City of Saratoga Acknowledging.Execution of Joint Exercise of Powers Agreement and Cooperation Agreement Pursuant to Title I of the Housing and Community Development Act of 1974 It was moved by CounCilwoman Corr and seconded by Councilman Matteoni Resolution 799 be adopted. The motion was carried. B. RESOLUTION NO. 800 Resolution of the Cityof Saratoga Approving the Priority Plan for Expenditure of Allocation of Funds to the County of Santa Clara for Parks, Beach, R~creational and Historical and Preservation Purposes - State Urban and Coastal Park Bond Act of 1976 It was moved by Councilwoman Corr=and seconded by Councilman. Matteoni Resolution No. 800 be adopted. The motion was carried. C. RESOLUTION NO. 801 Resolution Commending Joseph Long~ Saratoga Fire District Commissioner It was moved by CouncilwOman Corr~and Seconded by Councilman Matteoni Resolution No. 801 be adopted. The motion was carried. DS RESOLUTION NO. 653-3 Resolution Setting Forth Environmental Impact Report Criteria and Procedures for Private Land Projects in the City of Saratoga, Superseding Previous Resolution Numbers 653,653-1, and 653~2 The City Attorney suggested the following modifications be made in the proposed resolution: : Page 5, (7)(B), add word "prior after EIR (~econd line); add "and c'onsider" (last line). It was moved by Councilman Matteoni and seconded by Councilwoman Corr Resolution 653-3 be adopted with'the suggested modifications. The motion was carried unanimously. E. MINUTE RESOLUTION APPROVING THE REQUEST FOR ROUTING FOR OLYMPIC CHAMPAIGN MARATHON TO BE HELD ON JANUARy 16~ 1977 The Council expressed concern with the stretch along Fruitvale Avenue where it narrows before FaNwell, and also, a small stretch along Quito Road near the bridge. Also,'it suggested the possibility 6f Utilizing four police officers to regulate traffic on this route. It was moved by Coundilman Matteoni and ~Seconded ,by COunciJwoman Corr approval of a minute resolution to approve.the request of the Olympic Champaign Marathon on january 16, 1977, with the provision that the City Manager's office point out the areas discussed as potential hazard aneas because of the narrowness of the road, and the suggestionC~'6~¥~d~itio~i'~eputies toadequately police the situation. It was then moved by Vice Mayo~ Kraus and-seconded by Councilwoman Corr a policy be established requiring that the Marathon Committee notify the Council 30 days in advance of printing of their brochure prior to the next event. The motion was carried unanimously. V~ PUBLIC HEARINGS VI. ADMINISTRATIVE MATTERS Mayor Bridges A. MAYOR arrives 1. The motion was carried unanimously. B. COUNCIL AND COMMISSION REPORTS C. DEPARTMENT HEADS AND OFFICERS 1. Director of Public Works Report Re: Mr. Wolff's ReqUest to Review Policy on Repair of SidewalkstDamaged by Street Trees (Cont'd. lz/1, 12/15/76) Mr. Shook, Director of Public Works, reviewed the ~ep6rt of the Planning Commission on December 26, 1961, setting the conditions for this~sub- division, particularly,~i~h~gard' to-s~ewa~k~'and right-of-way - 2 - division, particularly with regard to sidewalk and r~ght-of~way requirements in accordance with the tentative map for Arroyo de Saratoga. The~City Manager indicated there is an item of correspondence in the packet this evening from Mr. Wolf~. Mr. Wolff addressed the Council and stated he felt the City was negligent in not informing the public that this area was of marginal dimension for trees. Mayor Bridge~ indicated that it is well established City policy that the City not interfere with what the resident wishes to do with that property between the property line and the curb, except when it is a clear public benefit to.have a sidewalk put in there. Following considerable discussion of this matter between Mr. Wolff-and the Council, it was moved by Councilman Bridges and seconded by Council- woman Corr the Council deny Mr. Wolff's request and advise hint that the sidewalk repair is his own responsibility. '.The moti~on was carried unani- mously. 2.Director of Public Works Report Re: Annual Revision to F.A.U. Program in Santa Clara County Mr. Shook advised that review of the eixsting F.A.U. program is before the committee, consisting of County of Santa Clara, Cit~ of San Jose, MTC and Cal-Trans. He~l~iTed~that the City had entered into an agree- ment with the County to ~6_c~h~e~Ci~t~'~_h~_~f"F'.~_.'.'__f~d~S for' ' "washed" gas tax money; th~'~'~r i~'g~'f6g to brough't'~b~6~e the Board of Supervisors this month to determine if they are gofng to be able to continue with this "washing" project. Mayor Bridges indicated on this program at a hearing before ~ Trans~r~a~o~T~i~. D. CITY MANAGER REPORTS 1. Detachment of City of Saratoga from the Black Mountain Conservation District Mr. Hendrickson, Assistant to the City Manager, reported this matter was before the Local Agency Formation Commission this afternoon, at which time the City made its presentation. He reported that LAFCO's ruling was consistent with the policy established in May, 1976, which provided that the sphere of influence should be extended to eventually encompass all ci ties. Eurther~it was ~_h~_~g~ment of the Commission to allow the Black Mountain Conservation District additional time to prove its worth tothe residents. Wolff, 19793 Via Escuela Drive, requesting documentation by appropriate city staff Re: responsibility for lifting of sidewalk on residentia 1 properties. - Noted and filed. 2. Mrs. Henry Nettesheim, 13625 Surrey Lane, urging the Council to approve closing the pedestrian path adjacent to her driveway. - Referred to staff for a report back at the January 19th meeting. 3. Eric S. Grube, 18681Harleigh Drive, urging that the Council not raise ~he speed limit on Allendale Avenue, as per the recommendation in the traffic consultant's report. - Continued for discussion at future Committeeof the Whole Meeting. 4. Robert F. Elswood, Pres'ident, Blue Hills Homeowners Association, ~2135 Saraglen Drive, Re: plans for widening Prospect Road near the State of California corridor property. - Public Works staff directed to communicate with San Jose t6 find out their position with regard to this particular prolem; report to follow. 5. James J. Lenihan, Chairman, Board of Directors, Santa Clara Valley Water District, presenting a water savings program for all new buildings in the county. ---Referred to staff fo~ a report back to the Council. 6. City of Palm Desert, California Resolution No. 76-149, a Resolution Opposing the Redistribution of. Sales Tax Revenues on the Basis of Population - No a~ion taken~ hoted and filed. 7. Norman J. Martin, 12524 Miller Ave., expressing his gratitude for being able to serve on the Saratoga Planning Commission. - Noted and filed. 8. City of Compton, California Resolution No. 11,524, a Resolution Opposing the Redistribution of Sales Tax Revenues onthe Basis of Population - No action ~aken; noted and file. 9. Sandi Cuenca, Executive Director, Saratoga Chamber Of Commerce, requesting receipt of City Council and Planning Commission agendas at no cost. It was moved by~or .'~ridges and seconded by Vice Mayor Kraus the City communica~'~'~ the ~hamber of Commerce advising that the Council can make no exceptionsto its original policy, as there are other similar organizations providing a similar service that are re- quired to pay for the agen~as. The motion was carried unanimously. -4- B. ORAL 1. Raymond ~zzy, 19518 Eric Drive, indicating his concern with regard to the TJKM traffic report and.increasing the speed limit on Prospect Avenue. He requested that prior to the Council taking any action on this report, copies of ,the report be sent to representatives of the local homeowners groups (Brookview, Prides Crossing, Blue Hills), as well as to Hanson School Home Room Club, Blue Hills School Home Room Club, and Miller Jr. High School Home Room Club. Mayor Bridges advised that the~e would be a Committee of ~he Whole Meeting before the time the Council takes any action concerning the report. He indicated the staff would notify the above representatives pridr to any meetings on this ~ubject. VIII. ADJOURNMENT TO EXECUTIVE SESSION It was then moved by Mayor Bridges and seconded by Councilwoman Corr the meeting be adjourned to Executive Session_~n~d~jiscussion.of~poten~ial-litigation, ~"~ .....
