COMPOSITION OF CONSENT CALENDAR Councilman KrauS requested item number 5 be removed from the Consent Calendar, and considered separately. The City Manager requested item l(b) be pulled from the Consent Calendar, and also. be considered separateiX. Resolution No. 814, Resolution of the City Council of the ~r~'~6gi~e uesting ,Permission for Temporary Closure o'f State Highway 9 ~or Annual Rotary ~rt Show Gene Zambetti, representing the Saratoga Rotary Club, addressed the Council urging that the Council approve not only the closure of the street, but displaying the banner between the two cypress trees~in Blaney Plaza from April 15th to May 1st for the Rotary Art Show.. He commented that the banner provides a moral lift to the community, and does not affect the health of the trees., CounCilman Matteoni commented he would have no objection in the Rotary Art Show using the present hooks located in the trees for a banner this time, but felt this issue should be looked at more closely and perhaps consider adopting a policy disallowing this use for future applications. It was then moved by Councilman Brigham and seconded by Councilman Kraus to adopt Resolution 814. 'The motion was carried unanimously. IV. B Award of Contract --HCDA Urban Beautification· Project The City Manager explained that bids on this project were re- ceived up until 2:00 P.M. ~n March 31, 1977, and one bid from Palo Alto Landscaping was received prior to that time. He indicated, however, that this bid was 30 percent above the eingineeer's estimate. He further indicated a second bid was received from Hallway Contracting Company; however, this bid was unopened due to the fact it was received at 2:03 P.M. It was moved by Councilman Kraus and seconded by Councilman Brigham to reject all bids on this project and authorize the staff to re-advertise for bids. The motion was carried unanimously. V. PETITIONS, ORDINANCES AND RESOLUTIONS A. RESOLUTION NO. 812 A Resolution of the City Council of the City of Saratoga Commending Norman J. Martin It was moved by Mayor Brid~es and seconded by Councilman Kraus Resolution No.' 812 be adopted. The motion was carried unanimously. B RESOLUTION NO. 813 A Resolution Approving Annexation of Certain Territory Desig- nated as "Mount Eden Road 76-2" to the City of Saratoga It was moved ~ Councilman Brigham and seconded by Councilman Kraus ResolUtion'No. 813 be.adopted.' The motion was carried unanimously. VI. SUBDIVISIONS VII. PUBLIC HEARINGS '- A. CONSIDERATION OF APPEAL OF.CONDITIONS IMPOSED ON USE PERMIT IN ACCORDANCE WITH THE PROVISIONS OF ARTICLE 15 OF ORDINANCE NS-3 TO ALLOW FOR THE CONTINUATION OF A NON-CONFORMING COMMERCIAL USE IN A RESIDENTIAL DISTRICT, LOCATED AT 14038 SARATOGA-SUNNYVALE ROAD (LILLIAN RODONI, UP-315) (Con t'd.-1/19, 2Z16, 3/2, 3/16) 1. Resolution No. 810, Approving Terms and Conditions of UP-315,Re: Rodoni Contracting and Storage Yard The Mayor reLopened the public hearing on this issue at 8:02 P.M. 'John Ottoboni, Associate in the finn of Ruffo, Ferrari and McNeil (representing Rodoni), addressed the Council in Mr. Ruffo's absenS~e. Mr. Ottoboni indicated that,~_~is client does have-some concern with .Conditions 3, 4 and 8,~'~ l'~'~i~f~'i~-con"=--~'~=~--~ dition 8 may be moot. He in'~icated t~at' it'~~t"a'~ndi~g the City is going to decrease the amount of property it is in the process of taking pursuant to an eminent 'domain-action. He~6~the only other portion of condition 8that then would apply is putting ~edwood ~lats in the fence~ and the con- cern with this is that since the fence will be moved and the school is right'.across the cul-de-sac, it.might be.a useless and wasteful act. He indicated that since there is no break in the fence, students might have a tendancy while Waiting for buses to pick on the wood. Therefore, they would ask that this be deleted. .. With regard to conditions j and 4, Mr. Ottoboni~e~f~xp~l~i~that .this operation is run as-a"storage yard and they c~nnot fit everything they have int~ the ~hed and the warehousewhichis there. He indicated t~ey would Utilize the structures as much as possible, and would askSthat they be allowed to keep the other materials stored in the yard from time-to-time neatly stored. - 3 Mr. Ottoboni commented that the Rodoni s are further as~ed~to move their trailer, which is a mobile-home-type vehicle, and it is their feeling to have to build a shed around a trailer is a waste of money. Councilman Kraus inquired what the City's position was on Condition 8. Mr. Johnston, City Attorney, replied that it was his recommen- dation that the amount of the take be decreased~ He stated that the take as it now exists on paper goes 10 feet beyond the actual curb line, and by so doing, it does reduce the size of the overall parcel to a, point where a number of variances would be required in order to develop it into 2 residential lots. He indicated that if you reduce the area back to the curb line, then no variances would be required because the two lots will still be within the applicable zoning regulations in the after-condition. Mr. Johnston clarified that his recommendation does not have anything to do with whether or not under the use permit land-' scaping will or will not be required, and it does not have any- thing to do with the existing fence~h~"~ Mr. Ottoboni commented that he believes the fehce would have to be moot, and therefore,"the 10 feet spoken to in item 8 will no longer be there. Mayor Bridges asked Mr. Bu~t of the Planning Department what was the condition of the trailer. Mr. LBurt replied that Mr. Ottoboni had commented that the trailer was a mobile home, and if that is the case, tentative map approval would be necessary as it is an illegal structure~. Mr. Ottoboni commented that.it is a mobile home-type vehicle used as an offide. Mr. Burt indicated that if. the trailer is Used as an office, it would still be required to obtain tentative map approval. Councilman Matteoni asked Mr. Burt if the clean-up operation requested by the Council previously ~as been taken care of. Mr. Butt replied that somelcleanup has taken place; however, this has been a slow process. Councilman Kraus asked if Mr. Ottoboni was proposing no redwood slats in any of the fence, or just on the Saratoga-Sunnyvale Road side. Mr. Ottoboni replied that their position would be as long as there are students lingering around there, it is their experience that the redwood slats tend to get broken. He indicated they would prefer to leave the fence as it has been over the years. Councilman Matteoni aske~ Mr. B~rt if the staff had looked at an alternate to the redwood slats. Mr. Bu~t indicated that another alternative for Condition 8(a) would be that the applicant.landscape behind the fence. Mr. Ottoboni commented that~~~I~& down, they would probably have to g~nn~"~i~?lo~f~fifi, and it is very difficult for him to see what kind of landscaping the City is talking about. Mayor Bridges' commented that he believes block the view, and he would immediately think'~f~h~dge~. Councilman Kraus indicated'he has been trying to vote in favor of this request; however, Mr. Ottoboni is driving him the other way because he is taking out the very items which the City has requested so the operation'could continue. Mr. Ottoboni indicated that it was his understanding through Mr. Ruffo that there was some concern with regard to conditions 3, 4 and 8, and they would prefer these conditions not be here. However, they obviously would rather have the use permit than not have one, He commented that it was felt they did have some legitimate concerns, especially with number 8; With regard to 3 and 4, he indicated he only wanted to express to the Council / what they were trying to do -- they are-removing the chemical .I toilet facility, removing the other tanks, and will basically do what the Council requests; they would prefer that they be permitted to store some th~ngs outside as it is a construction yard and this is sometimes necessary. Councilwoman Corr commente~ that it would seem to her if they want to keep things outside, they should then try to make some attempt to try to cover them up so they aren't so obvious. Councilman Matteoni asked Mr. Burr i.f he could suggest wording in number 8 to take care of the landscpaing situation. Mr. Burr suggested the following wording: "Landscaping and accompanying irrigation of the frontage area behind the fence shall be submitted to the Planning Commission staff. Landscaping shall be sufficient to adequateiX screen storage facilities from ublic view~'nd~d~ionally be of such species ~hat it wili"~fthin~a reaso~i~ ,period of time cover the fence." He further recommended removing conditions c and d of the staff report. ___ _The~Go~ncitl-discussed the_.Droblem of storage of const~ruction materials. Mayor Bridges indicated he would be willing to go along with keeping the construction-type materials; however, he would not be willing togo along with the presence of old graders and rollers which are not going to be used again. Also, he would have no problem with the 6utdoOr storage as long as it was kept below the level of the fence. Mr. Ottoboni then commented that presently the only equipment outside are the tahks which the Planning Department staff has indicated they would like moved. The only other thing out there, which he had just obtained.knowledge about this morning, is some loose pipe. Councilman Kraus indicated'he has some concern with allowing outdoor storage, particularly in view of the use permits issued for other areas which do not allow this. He indicated he would not have any objection to pipe, however. Councilman Matteoni suggested there be wording toeallow inci- dental outdoor storage from time to time for such items as pipe, lumber or railroad ties, and require that these be in neat stacks and not ab sve the fence line. Councilman Kraus inquired what kind.of'pipe. this would be. Mr. Ottoboni replied'that typically, this would be culvert pi~e, approximately 36 inches in.length. With regard to the ~torageof the office'~trailer., Mayor Bridg'es commented he felt-the safest thing would be to have this removed. Mr. Ottoboni commented that this. trailer is behind the shed, and if they put it inside ~he shed, they would be cutting down their storage space; it iti~ removed, this would be shutting. down~here their people domuCh of their book work. Mayor Bridges indicated it'was his feeling there .are too many problems in allowing this trailer to remain, as it would require building site approval, and then Design Review.approval.. It was then moved by Councilman Kraus and seconded by Councilman Brigham the public hearing be closed. It was then moved by Councilman Matteoni and seconded by Councilman Brigham approval of the use permi.t on the basis o~' the conditions submited for UP-315, with the modificati6ns to Section 8 as suggested by Mr. Burt, and with the modification to Condition 3, as follows: "No outdoor s~tQrage is.allowed, except incidental items from time-to-time'(not continuous!) of such materials asuculver~ pipe, railroad ties, lumber, neatly stacked and not exceeding 4 feet 7in height." Ordinance NS-3-ZC-79, An Ordinance Amending Ordinance NS-3, The Zoning Ordinance, by Amending the Zoning Map (Second Reading) : The'Mayor opened the public hearing on this matter at 8:30 P~'M. Jim Harper of H.M.H., Civil~Engineers, representing George D~y Construction, addressed th~ Council, indicated he would be available to answer any questions the Council might have. It was then moved by Councilman Brigham and seconded by Council- woman corr the public hearing be closed. The motion was carried. The public hearing was closed at 8:32 P.M. It was moved by Councilman Brigh~m and seconded by Councilwoman Corr the adoption of Ordinance NS-3-ZC-79. The motion was carried unanimously. ,iv. A. AGREEMENT BETWEEN THE CITY OF SARATOGA AND GEORGE W. DAY CONSTRUCTION CO., INC. FOR INCLUSION OF LAND INTO ACITY. AGRICULTURAL PRESERVE It was moved by.CounciimanBrigham and Seconded by Councilwoman Corr the Mayor be authorized to.execute this'agreement. The motion was carried unanimously. VII. CONSIDERATION OF APPLICATION FOR REZONING FROM "R~l-40,000" (SINGLE-FAMILY RESIDENTIAL, VERY LOW DENSITY) TO "R-I-20,000" (SINGLE-FAMILY RESIDENTIAL, LOW DENSITY) THE SOUTHERLY 2.3~ ACRES OF THAT 10.7+ ACRE PARCEL OWNED BY THE CAMPBELL:UNION SCHOOL DISTRICT AND tOCATED ON THE NORTH SIDE OF ALLENDALE AVENUE, BETWEEN DOLPHIN DRIVE AND VIA.ALTO COURT - OSTERLUND ENTERPRISES, INC. Jim Herper of H.M.H. Civil'Engineers indicated he would be happy to respond to any questions. of the Council. Daniel Judd, adjacent prope'rty owner ([5) the subject parcel, addressed the Council. Mr. Judd advised.the Council that all properties on this side of Allendale Avenue are R-i-40,00o, and he believes this parcel' should remain R-I-40,000. He indicated it is his understanding the City has to be incompliance with the State filing of the Master Plan. He inquired if this is what needed to be determined this evening. Mayor Bridges replied that he believes that in order.to rezon~ this property, it must be fbund that it is in confo~mance with the General Plan. Mr. Judd indicated that the!contention is that Allendale Avenue is one of the main access routes to Saratoga, and certainly, one of the show places of the Saratoga area, Therefore, he felt it is desirable to minimize .the accesses to Allendale, and he would like to see this corridor r~main low density. There being no ~dditional comment from the audiencE, it was moved by Councilman Kraus and seconded'b~ Councilman Brigham the public hearing be closed. The motion was carried; the public hearing was closed at 8:35 P.M. Councilman Brigham commented that his reco~ie~tion of what was discussed under the General Pla~'f~i~'property was R-i-40,000 zoning, and he felt it should be kept as low a densit~ as possible and in conformance with the existing properties surrounding it. Mayor Bridges asked Mr. Burt of the Pianning Department to point out the zoning of other pardels along this s~rip. Mr. Butt pointed out on the overhead,map the zoning designations of. property along this strip, indidating that zoning was very in- consist in this area; however, it was consistent along the south side of-Allendale Avenue, which is, for the most part, R-1-40,O00. - 7 - Councilman Matteoni dommented that it was his recollection that one of the considerations in trying to fit in with the development plans on Allendale Avenue was to try and work out an overall lot pattern with an access road, and he inquired if this was part Of the consideration for this lot. Mr. Burt replied that this was generally the consideration, and also, it was found that with'R-l~40,000~! there would be as many access points onto Allendale~Avenue as with this plan. Mr. Martin, former member ofTthe Saratoga Planning Commission, indicated he~h%d~ork'~'d o'b'~"~h~.~'~'~u~i~i~~i~tee and explaine~'[ '~h~'~'~ey l ~ttem~d~'d~Y~'~o'~'0~'{'d~ ~ ' more additional access onto Allendale Avenue from those lots than if they were R-I~0,000. Also, they tried t~ work out some- thing so that the connecnion to Harleigh Drive would be a foot- path and emergency'access-type of arrangement, such that the people on the easterly side of Harleigh Drive would have access to come do~ through the subdivision over to~the park. Also, this would provide for an emergency access. Also, they tried · to work it so that people on Fortuna Court Would not have a thru street cut through, and would have the same privacy as before. He indicated another factor which was taken into consideration was than in the last General'Plan, it had been reco~ended that that side of the street be R~l~20,000 all the waX through. In the was it is now, there are:only two lots z~d-~f-~,~, up to this property; beyond this property, it i~r~g~'i~-d~-t~at it should be R-l~40,000 and wouldn't be able to be subdivided an~ay. Following some additional discussion by the Council it was moved by Council~~e~'~~nd~d by Councilwoman Corr Ordinance NS-3-Z~07~'~6~T~h~'=~zoning, be adopted. The motion was carried, 4 to 1, Councilman Brigham in opposition. VI '~ I. ~ADM~N{ST~I~V~.~RS T~i' ~ A. ~YOR B. COUNCIL AND CO~ISSION REPORTS 1. Presentation of Needs Assessment Task Force Rdport It was moved by Councilman Brigham and seconded by Councilman Kraus to accept the Needs Assessment Task Force Report, and schedule a Co~ittee of t~e ~ole Meeting f6r'discussion with the Task Force. The motion was carried unanimously. 2. Report by Chairman, Parks and Recreation Co~ission, Re: Conference Evaluation Mr. W. G. Carlson's report, dated March 22, 1977, was acknowledged by the Counc{1 and will be made a part of the file on this subject. C. DEPAR~ENT HEADS AND OFFICERS 1. Plan ~ng Director/Directo~ of Public Works Re: Consideration of Proposed Reco~endations on ABAG/MTC Corridor Study Mr. Shook, Director of Public Works, reviewed the Corridor Evaluation Study Phase III Alternatives, indicating that it would be the staff's reco~endation to proceed with some of the alternatives, but to do no further work with regard to Alternatives 1, 3, 5, 8 and 9.. - 8 - Following considerable discussion of this issue by the Council, it was moved byeCouncilman Brigham and seconded by Councilman Kraus to support the recommended alternatives, with the stipulation that the U.D.O.S. plan be taken into consideration, as well as the growth-with-energy use, job growth, population growth.,, and a definition relevant ~o. retaining both the freeway corridor and light rail system in the plan. The motion was carried unanimously. This position will be-forwarded to the ~BAG/MTC Study.St~ff~ 2. Public works, Re:.Quito-vessing Inter~ection (Application fQr Funding under Section 209. of the State-Federal Highway Safety Program) .It was the consensus of the Council to follow through regarding the application for funding on this project. .CITY MANAGER 1. Requested an Executive Session following the Reg,]ar this 'evening for the purpose of discussing potential lit~gat~sn. This was acceptable to th~ Council. 2. Consideration of Change Order'.No, 2 fo~ the Saratoga Commnn{ty Library The City Manager explained that this change order is essentially for the purpose of modifying the specifications to provide for h&avy-duty door butts'ahd two threasholds which were added, amounting to $745.20. It was moved by Councilman Kraus and seconded by Councilman Brigham Change. Order No. 2 for the Saratoga Community Library be'approved. The motion was carried unanimously. 3. Report Re: Proposed Changes in Santa Clara County Re: Pr6vision of Fi~e Marshal SerVices The City Manager indicated it would be his .recommehdation the Council support the position that the City does not wane any increase in cost';, however, if the service is transferred to the Central Fire District, the only cost the City bear in the district be those which a~e absolutely necessary'for the purpose of fire prevention in the 'Central Fire District. It was moved by Councilm~n Kraus and seconded by Councilman Brigham to suppor~ the City Manager's recommendation in this matter, and communicate_ this' position ~o. the Board of Super- visors. Metcalf, former Planning Commissioner, 14150 Douglas Lane, expressing concern regarding'the recent appoi~tmenn of Shelley S. Williams to the Saratoga Planning Commission. Mayor Bridges indicated he'would reply to this communication, 9 3. Mrs. John A. Williamson, 13852 Upper Hill Drive, requesting "No ' Parking" signs in the court above this area. This was referred to the ~taff for a reportCback to Council at its next regular meeting., 4. Mrs. Thomas A. Bredis, 13762 Orleans Court, requesting "No Parking" signs be covered on Thursday, May 5th, for the Sacred Heart ~ Church Women's Club House~and Garden Tour.~n.~v~- .--=~ ~-v~~ It was moved by Councilwoman Corr and seconded by Councilman Kraus this request be granted, to cover the period between 11:00 A.M. and 5:00 P.M. on May 5th. The motion was carried unanimously. 5. Signed petition from the Neighborhood Coalition for Protection of Children,~ting the installation of stop signs at Lexington CoUrt and C~alet Lane to control traffic speed. - Referred to the staff for a report back to the Council. 6. Judy Rickart, former reporter, Los Gatos Times Observor, farewell letter. It was moved by Councilman ~atteoni and seconded by Council- woman Corr to direct a special thank you letter to Mrs. Rickart, for her attendance to City Council.meetings during the past year; also, a letter to the Los GatSs Times Observer thanking them for sending a reporter to cover Council meetings. The motion was carried unanimously. 7. Allen Dyer, P. O. Box 2156, Carmel, expressing concern Re: Ordinance 3-E.14, dated M~rch 14, 1977, relating to the Bohlman Road Study Area building moratorium. Following consideration of th~request by Mr. Dyer concerning plans for improving his a~ready-existing home in the Bohlman Road Study Area, it was moved by COuncilman Brigham and seconded by Councilman Kraus to approve the plans as submitted to the Planning Department staff, based on the findings that this construction would not conflict with the terms of Ordinance No. 3-E.14. The motion was carried unanimously. 8. City of San Mateo, expressing concern Re: revised policy 2.3 to proposed revisions of the Transportation Plan. - Noted and filed. ~ 9. RECONVENE The City Council reconvened into an Executive Session at 10:15 P.M., and upon the motion of Councilman Kraus, seconded by Councilman Matteoni, adopted the City Attorney's recommendation to alter the take in the Rodoni condemnation for a cul-de-sac opposite Reid Lane by reducing the take some 1,472.9 square feet, and approving the settlement for the cost of this land not to exceed $5,600.
