SARATOGA CITY COUNCIL
TIME: Tuesday, May 24, 1977 7:30 P.M.
PLACE: Crisp Conference Room, 13777 Fruitvale Ave., Saratoga, CalifL.
TYPE: Adjourned REgular Meeting
I. ORGANIZATION
The meeting was called to order by Mayor Cole Bridges. The
City Clerk called the roll. All Council persons were present.
II. AWARD OF CONTRACT FOR ANNUAL STREET SEAL PROGRAM
The City Manager reported that the City had received five bids
for the Annual Street Resurfacing Program. The low bid was
$91,874.54 by Leo F. Piazza Company, with the high bid being
$120,650.32 by the O'Grady Paving Company.
It was recommended by the staff that the low bid of $91,874.54
be awarded to Leo F. Piazza Company, and that the bonds be returned
to the unsuccessful bidders. It was further recommended that the
staff be allowed to negotiate up to $8,~200 ~for additional 'street
work in the H C.D.A. ro'ect area in Quito bringing the project
total to the ~0~000'~t~d.
It was moved by Councilman Matteoni and seconded by Councilman
Brigham that the low bid be awarded to Leo F. Piazza Company,
and that the staff be authorized to negotiate for additional_27
street work. The motion carried unanimously.
III. REQUEST FOR TEMPORARY "NO PARKING" AT 19646 MONTAUK DRIVE
The Mayor indicated a letter had been received by Mr. A. Nalywajko
at 19646 Montauk Drive requesting that the temporary "No Parking"
restriction be limited for one-half day on Thursday, May 26th,
in order to allow an event to take place at their house.
It was then moved by Councilman Kraus and seconded by Councilwoman
Corr that the "No Parking" near this address be temporarily re-
moved on Thursday, May 26th. The motion was unanimously carried.
IV. CONSIDERATION OF ABAG/MTC JOINT POLICY COMMITTEE FOR CITY COUNCIL
The Council again discussed the question of the alternatives
outlined in Phase 4 of the study. It was unanimously agreed that
there should not be two alternatives as specifically recommended,
but that there be one study based on the current ity .,eneral ~lans~

It was moved by Councilman Kraus, seconded by Councilman Brigham
that this position be indicated to ABAG/MTC Joint Policy Committee.
This was unanimously approved 5 to 0.
V. CONSIDERATION OF RECOMMENDATION BY DIRECTOR OF PUBLIC WORKS TO
MODIFY SUBDIVISION AGREEMENT BETWEEN THE CITY OF SARATOGA AND
DIVIDEND INDUSTRIES FOR TRACT 5944
It was recommended that paragraph 10 be deleted from the agreement
previously approved. The Director of Public Works indicated they
were working on a new design for the culvert, and it was hoped
that at a later time, we could come back with a modified agree-
ment for consideration with Dividend Industries.
It was moved by Councilman Kraus and seconded by Councilman Brigham
that paragraph 10 from the existing agreement be deleted, and the
Mayor be authorized to sign the amended agreement. The motion
carried unanimously.
VI. SENATE BILL PERTAINING TO BINDING ARBITRATION FOR PUBLIC SAFETY
SERVICES
The City Manager asked if the City Council would discuss the
recommendation to urge our legislators not to approve SB-164. He
submitted a draft letter to Senator Smith outlining the reasons
for opposition to this bill. After some discussion, it was moved
by Councilman Matteoni, seconded by Councilman Brigham that ~he
City Council oppose SB-164 in its present form. The motion carried
unanimously.
VII. ADJOURNMENT
There being no further business, the meeting was adjourned at
8:05 P.M.
