ROLL CALL Present: Councilmen Brigham, Corr, KraUs, Matteoni, Bridges Absent: None ~ B. MINUTES It was moved by Councilman Kraus and-seconded by Councilman Brigham approval of the minutes of September 21, 1977. The motion was carried unanimously. II. CONSENT CALENDAR A. COMPOSITION OF CONSENT CALENDAR It was moved by Counciiman Brigham and.seconded b~ CounCilman Kraus approval of the Composition of Consent Calendar. The motion was carried unanimously. B. ITEMS FOR CONSENT CALENDA~ 1. RESOLUTION NO. 804.1, PROVIDING FOR ACQUISITIO~ OF SURPLUS PROPERTY 2. AGREEMENT RE: CETA TITLE VI- CONTRACT MODIFICATION (January 1, 1977.- September 30, 1978) 3. PAYMENT OF CLAIMS It was moved by Councilman Kraus and seconde~ by CounCilman Brigham approval of~the ITems for Consent Calendar. The motion~i~as carried, 4 to 1, Councilman Kraus in opposition. B. CHANGE ORDER NOn 1 - AZULE PATHWAY DEVELOPMENT This change order is for ~20 linear feet of redwood header board, totaling-S298.00. It was moved by Councit~'B~~eco~dT~guncilw'~n ,~r~F~ approval of Change'~de~ ~o. f ~,~r'th~f~ ~a~way ' development.' The motion.was carried, 4 to 1, Councilman Kraus in opposition. C. ~GREEMENT WITH THE CITY OF SA~TOGA AND THE UNITED STATES ENERGY RESEARCH A~ DEVELOPMENT ADMINIST~TION FOR SA~TOGA SO~R PROJECT It was moved by Councilman Kraus and seconded by Councilman Brigham the.agreement be approved, and the Mayor be authorized to execute same. The motion was carried unanimously. IV. PETITIONS, ORDINANCES AND FO~L RESOLUTIONS A. MINUTE RESOLUTION RE: D~FT SUFACE RUNOFF ~NAGE~NT ~N FOR SANTA C~ COUNTY ,. The City Manage~ advised that it is the staffis reco~endation the Council indicate its support for the approach taken in this plan and so fo~ard to. the Boardof Supervisors. It was moved by Councilman B~igham--and~econded_bX Councilman Kraus to support thei%~l'~-~0~it~e~'~F~{~ ~?4ing ~Draft Surface ~un~ff"M~t'PTan~f~'S~'~¢~ara-:~unty. The motion was carried unanimously. B. PETITION FROM THE ~SIDENTS OF A PRIVATE ROAD OFF PEIRCE ROAD REQUESTING T~T THE ROAD BE ALLOWED TO STaY AT THE PRESENT 10 TO 12 FEET IN WIDTH ' .The City Manager brought to the Council's attention a letter from the Saratoga Fire District pertaining to this request. He further pointed out a memorandm from the Land Development CoEittee providing some'detail concerning this proposal, and indicating the CoEittee~s recoEendation for denial of this request, and a memorand1 from the Planning Co~ission advising the City Manager concerning t~e.action of the Flanning Colission endorsing the memorand~ from the Land Development Co~ittee, and indicating its strong opposition to the petition request. Mr. Shook, Director of Public Works, explained that in 1972, the City Council had agreed that public street improvements~ for this road could be deferred until such time~[~l~ith building site wa~' ~eve~oped, and at the time of"~h~t~l'f~~ 'w~ffl'd'b~in~[~'{'~'UE~~~ill.~.s;t~e~t~tan~ds. ~ · .. ~ ~ed th~ [Yi~~d~i~[~'~m ~h?~ Cit~~ ..... ~ policy of not allowing mor~ than four units on a minim~ access~ road, and in itself was something of a variance. He indicated that an application is presently before the Land Development CoEittee which would result in the eleventh unit. Mr.' Shook indicated that the Public Works Department'would also support the position of the Land Development CoEittee, and he is~~ awa~e of any instance wher~ there has been a deviation from the standards for minimum access roads, and he would recoEend ~hat the Council reject the request of the petitioners. Ralston Johnson, 13999 Pierce Road, addressed the Council on behalf of the residents onthe pEivate road off Peirce Road. -Z2 - 7 Petition Re: Private Road (Cont'd,) Mr. Johnson commented tha~ it was his understanding,.as well they have already shown tt~eir cooperation to improve this area. Also, they have spent $5,000 to. re-asphalt the road and install speed bumps, and approximately $3,000 for.bridge repair. With regard ~o the issue of ingress and egress of emergency vehicles, Mr. Johnson stated there are no rows of trees along either side of the road, it is all flat ground, and in his opinion, there would never be a problem with vehicles passing along the road. He further coEented it is anticipated the Peck ~roperty would develop into 5.to 7 units, and it is hoped this would develop off of Mr. Eden Following consideration of' this petition, it was moved by Councilman Matteoni and seconded by COuncilman Kraus to deny this request. for waiver of the City's minim~ access standards on this private road. The motion was carried unanimously. C. RESOLUTION 780-2, RESOLUTION ALTERING AND ESTABLISHING FEE SCHEDULES Mr. Van Duyn, Planning Director, reviewed the proposed fee schedule for various applfcations affecting the Planning Department. . Councilman Kraus questioned the wording contained in the pro- posed fee schedule for Des'ign Review applications. Mr. Van Duyn, therefore,:.-revised this to' read as follows: $50/lot for 1st four lots; $250 for major sub- divisions of five to ten lots; $10 per lot thereafter. It was moved by Councilman~ Kraus and se'conded by Councilman Brigham Resolution 780-2, as modified, 'be adopted. The motion was carried unanimously. D. PETITION FROM THE RESIDENTS OF SHORTHILL COURT REQUESTING THE CITY OF SA~TOGA TO DESIGNATE BOTH SIDES OF SHORTHILL COURT AS "NO PARKING" - ~EKDAYS FROM 8:00 A.M. TO 4:00 P.M. It was moved by Councilman' Kraus and Seconded by Councilman 'Brigham to direct the staff to draft the necessary resolution for implementation of this. "No Parking" zone, to be consistent with the no parking restriction in the surrounding area. The motion was carried unanimously, and this resolution be available for Council consideration a~ the regular meeting on October 19th. The motion was carried un~imously. V. SUBDIVISIONS, BUILDING SITES AND ZONING REQUESTS A. FINAL ACCEPTANCE, T~CT 5150 - GEORGE DAY/FRUITVALE AVE. The City Manager advised thai it is the staff's recoEendation final acceptance be g~ante~. T~d~O~~e_~ developer of ~is responsibility fSr maintenance' of the land- scaped area. Further, there is a Landscape Maintenanc~ Tract 5150 (Cont'd.) Agreement which the developer has entered into with the City bonded by a $12,000 bond, which provides for continued main- tenance of the area until ,such time as a homeownersassociation is formed and an agreement entered into between the City and the homeownerSaSsociatio~ for maintenance Of theco~"~.~oj~'~v green area's. With regard to the street improvements on this tract, one concern was brought forth by Marion Welch, 19502 Kenosha Court. She indicated that the~c~urSi_~'~hich had been replaced by the ' developer was~a~d~~~' ~"~'g~%~[~'~an that ~hich Charles Ware, Construction Engineer for George Day Construction, addressed the issue of the concrete discoloration, stating tha't this concrete would bleach out in 2 to 3 years to blend with the~other concrete. Following further discussion, it was moved by Councilman Matteoni and seconded by Councilman Kraus to adopt Resolution 36-B-174, Accepting DediCation of Streets, and consider the matter of landscape maintenance of this tract at a Co~ittee of the ~ole Meeting on October llth~ The motion was carried unanimously. VI. PUBLIC HEARINGS. A. CONSIDE~TION TODEC~RE PROPERTY AT 12155-12241 SA~TOGA- SUNNYVALE ROAD AS A "PUBLIC NUISANCE" BECAUSE OF CONDITIONS EXISTING ON T~T PROPERTY ~ICH CONSTITUTE VIO~TIONS OF CERTAIN FIRE, H~LTH AND CI~ STATUTES AND REGU~TIONS The City Manager called upon the Code Enforcement Officer to define the violations currently existing on this property and the sections of the Zoning Ordinance which the City feels~ in violation. Mr. Upson, Code Enforcement Officer, indicated that this is the same piece of propert~ which was brought before the Council in 1974 fo~n?'gY~Yh~mDreasons. The City Manager indicated that on September 7th, the Council had considered a petition f~om Mr. Stiles representing a n~ber of homeo~ers on Ri~anna Court, and also, presenting photos of debris on the property. The Mayor then opened the public hearing at 9:00 P.M. Jack Stiles, 20626 Ritanna. Court, addressed the Council. He indicated that there is..broken glass and nails on the property which represent ahaz~rd to the children who occasionally play onthe property. Mr. and Mrs.'Douglas Cheeseman, 20800 Kittridge Road, in favor of keeping the population in Saratoga stable. - Directed the City Manager to respond and advise them of the City's General Plan process as it relates to this issue.
