(Councilman Matteoni arrives) III. BIDS AND CONTRACTS A. CHANGE ORDER NO. 1 FOR EL QUITO PARK LIGHTING This change order provides a conduit for lighting and one' trial light for E1 Quito Park, totaling $3,700. It was moved by Councilman Matteoni and seconded by Councilman Brigham approval.of the change order. The motion was carried 4 to 1, CoUncilman Kraus in opposition. IV. PETITIONS, ORDINANCES AND FORMAL RESOLUTIONS A. REQUEST BY MR. HART, 14187 SOBEY MEADOWS COURTs(TRACT 5164) TO: -1) provide a survey to locate a public pedestrian and equestrian easement. at the rear of his property and adjacent properties; and .. 2) temporarily prohibit public access to the easement until the request fbr abandonment is considered by the City Council. The City Manager indicated it is his recommendation not to provide the survey at this time. With regard the'the second part of this request; the City Manager indicated he feels it may be very difficult to post this site, due to the fa6t it is very open at the corner where the easement'beginsand where it drops down behind. Mr. Hart's property, and he is not sure this would be an effective mechanism, in that there is no fencing or control of where that easement is located. ~Mayor Bridges pointed out that. there is a report<fr%~"~"'~ this It was moved by Councilman'Kraus and seconded by Councilman Brigham to defer this matter to the next regular meeting of the Council, and allow the Council an opportunity to walk over the easement and comment at the next me.eting. MINUTE RESOLUTION RE: WEST VALLEY FIRE SERVICE STUDY The City Manager indicated~ it would be his recommendation to support the analysis of alternatives which have been outlined to the JPA Policy Board, reserving the option to not~__~fie ~nicipate if all parties do not agree. It was moved by Councilman Kraus and seconded..by Councilman Brigham to support ~he study for the Joint Powers. Agreement, as recommended, and that the Mayor be authorized to support the study in his meetings~with the other West Valley Cities. The motion was carried unanimously. V. SUBDIVISIONS, BUILDING SITES, ZONING REQVESTS A. Without objection, the Mayor ordered this matter be Set for public hearing on-NOvember 16, 1977. VI.' PUBLIC HEARINGS A. CONSIDERATION OF APPEAL ON; CONDITION II-D OF TENTATIVE BUILDING SITE APPROVAL RE:.DEDICATION OF PUBLIC RIGHT-OF-WAY THROUGH THE SISTERS OF NOTRE DAME PROPERTY (SDR-1311,"DR. GREGORY FOX) The City Manager pointed. oUt'the two items of correspondence from Dr. Fox in which he States his appeall Mr. Van Duyn,_Elanning Director, explained that'what is involved in this appeal is the potehtial development of a twenty-acre site, and a division of the'property which would pr6vi~e for one potential building site with access to the proposed structure from Norton. Road. Mr. Van. Duyn outlined'Condition D of the' · Planning Commission Report, dated September 28, 1977, indicating that Dr. Fox is appealing that portion of-the condition which requires submission of-an irrevocable Offer of Dedication for the existing access road paralleling Bohlman Road and now being used to service the Novicia, plus such additional Street right-of-way as is needed to connect to Bohlman Road at the southerly end. Councilman Kraus indicated he is concerned about the fact that the Council may be considering what could turn into a four- laneroad in a very short Section of this~roadway, encouraging speeding through. this area. - 3 - APPEAL, SDR-1311, DR. GREGORY FOX 'Cont'd. Mr. Van Duyn explained that he did not believe it was the intention to make this four lanes -- rather, one lane in one direction, split by a median, and one lane in the opposite direction. Also, it was the intent to use the trees as the median area for division. The Mayor then noted the ~tems of correspondence which had been received relevant to this issue: 1. Petition to City Planning Commission opposing the dedication of public right-of-way through Sisters of Notre Dame property. f is to be a part o ~thi~g~ The City Attorney indicated there is no~question in his mind that Dr. Fox's appeal should include Conditions VIII-A and B. The Mayor opened ~he public hearing a~ 8:16 P.M. Dr. Fox addressed the Council, indicating that basically, what he is talking about is ~he dedication across private property that he does not feel_.ij~go~pg to benefit the comunitv, nor_ %h~ ~opl'e '~ho W0~la'be using the'~ad.' = 4 - APPEAL, SDR-1311, DR. GREGORY FOX (Cont'd.) He commented that one of the reasons for using the other road is the fact that som~ trees would have to be removed to widen Bohlman Road in its existing right-of-way, which is approximately 20 feet on either side of the existing road bed. Dr. Fox indicated that in his mind, there are several things that make a two-way road system a less-than-desirable thing for the City to use, and if it is not desirable at this time, he would ask; "Why would we ask_for the dedication?" ~r~. Also, on the other end that you can't see, the road comes back to Bohlman Road at a more severe corner than is already existing, thus reducing the vision of somebody trying to negotiate that corner andsmaking a worse corner than we already have. He pointed out that the Sisters' driveway is by far the better strech of road, at it would be no trick at all to travel 50 to 60 miles-an-hour do~ this stretch of road. Dr. Fox co~ented that he ~oes not feel we want a roadway in the hills where speeds like this are capable. With regard to the possibility of straightening out the road do~ where the Sisters' driveway comes onto Bohlman Road, Dr. Fox pointed out that this pro~ertX is_directly adjacent t0 ~he cemetary, ap~% ~1~'~ ~f~c'~r~'~d~ ~t~~~tary to straighten' this ~oadway-oUt. He indicated that the building that is cut off is 18~ to 19 feet from their existing driveway, and cars would be ~ravelling next to their residence at a high rate of speed. Dr. Fox indicated that he believes he can safely say that the neighbors in the area are Dot.interested in saying two-lane construction of roadway, and would prefer to leave the road alone. With regard to the question of sewer hook-up, Dr. Fox stated that he agreed in point with hooking up to a sewer whenever it arrived at the property, and the 300 feet as set by the Planning Co~ission seemed reasonable.. However, Dr. Fox indicated that it occurred to him, "~ere are they going to measure the 300 feet?" HeYindicated that the property is approximately 1,800 feet, and if the 300 fee t was measured do~ from the lowest end of the property, this would be talking about a sewer line that is 2,100 feet long. He cohented that he would have no objection if the sewer line was within 300 feet of the parcel he lives on, which is 11~9 acres. Therefore, he felt there should be some refinement as to where this is measured from. Dr. Fox indicated he was advised by'the staff that a proposed dry sewer line to attach to a someday-de~elopmentof a trunk sewer wasn't too reasonable. He indicated that the Sewer District h~s had three or four proposals to come into the area, and all of them are from a~different approach. Therefore, it would be very difficult for him to design when he is not sure where he is designing it to~g~7 stated he would prefer a 200-feet line; however, he would put - 5 - APPEAL, SDR-1311, DR. GREGORY FOX (Cont'd,) in whatever is necessary -- provided he knows where to put it. Donh Campion 15280 Bohlman Road, addressed the Council. He commented that over the past ten years, he and his wife have traversed this particular point on the road 30,000 times, and have never seen an accident at this location. Mr. Campio n stated that he doesn't feel it is reasonable to tear up this property because this individual is trying to develop. Mr. Campion stated that we have a great opportunity now no give some thanks to the sisters -- not o~ly because they are early Saratogans, but because of the things they have done to keep the City's tax rate down. Sue Kruse, 14220 Pike Road, indicated she is here this evening as an emotional speaker. She explained that Pike Road and Saratoga Hills Road is a continuous macadam road from her home on Pik~ Road down into Saratoga. Mrs. Kruse indicated her children cannot walk on this~road to school, and yet, the Council is thinking about'dedicating the Sisters' driveway. Therefore, it is her feeling it is unreasonable to think of taking the Sisters' driveway. Sister June Knolles addressed the Council. She indicated that she teaches at Sacred Heart School, and she, as well as the other Sisters dedicate some time at the Villa whiCh.is the road next to the rooms where the Sisters are in beds -- after they have given all the years of their lives for the people of this valley. Sister Knolles stated that she cannot believe the City would ask thes~ sister~ who have given their lives for this tow~.,~to give one more thing. Sister Audrey McGree+y addressed the Council, indicating that she sees a danger to the Sisters who are ambulatory when there is no acd'ess 'to the upper property. Also, she commented that the noise on Friday and Saturday'nights is unbearable, due to kids driving up and down that road~§~p~-~.._y_the bedrooms are on that side bf the property. Emily La Seola addressed the Council, stating that her children.attended the Montessori School for three years, and is very familiar with .the area. Mrs. La~Scola in_dic.a_ted she felt it would be a shame, to encourag~r~eoDle,~f~r~'any~/~' reason, to drive through this area ~ny If~s~ter~"[~h~ now. She fu=thez commented that theztranquility of this area is a perfect setting for the Sisters' Villa, and to take this away from them would be a grave mistake. .Also~ she felt it would be a mistake to the Icommunity to encourage people to drive faster on this road ,than they'do now, particularly since the stretch of B0hlman Road below Norton is very close to the Oak Street School area. Mrs. La Scola indicated she would like to see this preserved as af tranquil, slow-driven .area which it is currently. There being no further comments f~om the audience, it was moved by Councilman KrauS~and se~conded by Councilman Brigham the public hearing b~ closed. The motion was carried. The public hearing was closed at 8:15 P.M. Mayor Bridges asked'for clarification ~egarding Condition II-D, inquiring if this condition was an alternative to the condi'tion of widening Bohlman Road in its existing area. APPEAL, SDR-1311, DR. GREGORY FOX .(Cont'd.) Mr. Van Duyn replied that the Planning staff had recommended 18-foot improvements on Bohlman Road, and the two-lan~ split was presented as an alternate and accepted by the Planning Commission. tte further explained that the right-of-way is existing, and the dedication is conditioned as an assurance that the City does get the minimum 20 feet. What they were asking for is 'that within this 20 feet, there be at least 18 feet of minimum improvements. Councilman Kraus inquired of the Planning Director where the 300 feet for the sewer lineC~ouTd'b~"~bu'FFd'fF~m."' Mr. Van Duyn replied that it is intended that the 300 feet'be within the location of the parcel which is bounded by Bohlman and Norton Roads, and is not intended to be reflective of the ~C~th~mRr~'~_vements be constructed so that the ~rX-p~ugg~'d sewer be placed at the particular home and when sewer does become available, the connections are readily available to be hooked up to the home. It is nQt intended that the dry plug be placed an~here out on N6rton Road, and does not have to extend beyond the structure. Councilman Kraus inquired if the Council was considering only Condition II-D at this point relevant to the dedication of right-of-way, and not the issue of the sewer line. Dr. Fox indicated he was satisfied with Mr. Van Duyn's explanation concerning the sewer line hook up, and therefore, no further considerationSneed be given to this issue. It was, therefore, moved by Councilman Kraus and seconded by Councilman Brigham to grant the appeal on Condition II-D, specifically with regard to the submission of an irrevocable Offer of Dedication for the existing access road paralleling Bohlman Road now being used to service the Novicia, plus such additional street right-of-way as is needed to connect to Bohlman Road at the southerly end. The motion was carried unanimously. Recess and reconvene CONSIDE~TION OF APPEAL OF CONDITION II-F OF TENTATIVE BUILDING SITE APPROVAL RE: DEDICATION AND I~ROVEMENT OF S~TOGA AVENUE (SDR-1321, BARRET-HIBB~D CO~ANY) Mr. Van Duyn, Planning Director, explained that this appeal centers around an application for a 4-lot land division - 7 APPEAL, SDR-1321, BARRET-HIBBARD C0. (Conttd.) of property located at the northwest corner of Saratoga Avenue and Worden Way, specifically.with regard to Condition II-F of the September 12, 1977 staff report, which requi~es: "Dedication and improvement of Saratoga Avenue as required by the Official Plan Line for Saratoga Avenue (including pedestrian walkway)" He explained that the applicant'is not objecting to the dedication of the proposed street rights-of-way, but is not acceptable to entering into the improvements for the Saratoga Avenue right-of-way and would prefer to have this placed under a Deferred Improvement Agreement. Mr. Van Duyn indicated that the Land Development Committee had considered the Deferred Improvement Agreement request; however, they experienced a problem with this in that this area would simply be offered for dedication, left unimproved, and would be left under title to those two property owners which abut the Saratoga Avenue frontage. This frontage area would then be left as an unimproved,~ unmaintained area, similar to that portion of right-of-way east and west of Shadow 0aksWay. The Mayor opened the public hearing on this issue at 9:43 P.M. Jack Reeder, representing Barret-Hibbard Company, addressed the Council. Mr. Reeder indicated that he would like to make "'~ ............. it ~l~t' ~h~y ~r~L'6~ly'~s~ing' fb~'7~' a~f~' 6f ~h~ improvements. He'further pointed out there are a number of deferments a.long SaratogaZAvenue at this!time. Mr. Reeder indihated that' he has presented to the Council photographs of the trees that would be required to be removed as a result of this improvement, and he felt this should be considered by ~he Council.. It was hislopinion that a buyer of a home would readily.understand that he is accepting re- sponsibility for this improvement, as it is shown on his Title Report and is similar to a bond. Mrs. Hogle, who resides on the corner of Worden Way and Saratoga Avenue, addressed the Council. Mrs. Hogle commented that she does not see the necessity for this improvement at this time. She indicated that Saratoga Avenue has become a speed trap, and we are destroying our environment. She indicated she has lost one animal because of speeding cars and has buried three other animals that did not even belong to her. Therefore, it was her feeling widening of the road wasn't going to help the situation. Wilbur Worden~ 14204 Squirrel Hollow Lane, commented that he feels this requirement should be put aside at the present time because of the trees that would have to be removed. There being no further comments from the audience at this time, it was moved by Councilman Brigham and seconded by'~ Councilman Kraus the public hearing be closed. The motion was carried. The public hearing was closed at 9:46 P~M. Councilman Matteoni inquired if there was any way to defer the improvement against the four lots. In this way, the City would record the Deferred Improvement Agreement simultaneously with the recordation of the final map for all four parcels. Further, the Preliminary Title Report sets this up as an encumbrance against this land. The mot~oh Was csrr~ed tmanimously. C. THE HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 - FOURTH YEAR PROGRAM 1. Presentation of the City's Participation under the HCDA to date, with a sunnnary of Community ,~ev'~'&'f~pment ' Program Activity. \ ~-~S~ta~=C~rne~ie, Administrative' Assistantin the City Manager's Office, addressed the Council indicating that the five projects that' have been in existence as the Saratoga Community Development Plan were: 1) Demolition of a nOn-conforming structure on city property (Arco. Station)-(completed) 2) Urban.~ beautification in the Village (completed) 3) E1 Quito Park (anticipated completion prior to end of year) 4) Senior Citizen Housing 5) Saratoga Housing Assistance and Rehabilitation Program 2. Presentation of Proposed Fourth Year Community Develop- ment Projects and Planned Activity Mr. Carnekie pointed out that the two programs remaining to be completed in the fourth year program are: Senior Citizen Housing and the Saratoga Housing Assistance and Rehabilitation Program. He pointed out that the Senior Citizen Housing Task Force has completed a Needs Analysis for Senior Citizen Housing, and it remains to be decided as to the disposition of these funds. Mr. Carnekie indicated that the Saratoga Housing Assistance and Rehabilitation Program is fully operational, and there are currently 18 properties involved in that program. This program could be expanded possibly in the fourth program year to include additional target areas,'and it also could be expanded to include, spot rehabilitation throughout the' City on an as-needed basis to the extent of 25 percent of total program activity. He indicated that the development of a comprehensive housing strategy would be an allowable expense, thereby updating the Housing Element to, the General Plan.. Also, removal of architectural barriers to the handicapped has been suggested for the Village area, and designation of certain areas in the City for "Handicapped Parking". The motion was carried unanimously. VII. ADMINISTRATIVE MATTERS (Cont'd.) B. COUNCIL AND COMMISSION REPORTS 4. Recommendation from the Planning Commission Re: Ordinance NS-3.37, Planned Residential Development Without objection, ~he. Mayor set this matter for public hearing on November 16, 1977. C. DEPARTMENT HEADS AND OFFICkRS 1. Reports from Director Of Public Works Re: · a) Request for "No Payking" Zone on Portion of Reid Lane Mr..Shook reported that signs for the extended parking prohibition have recently been received/and would be implemented to allow the Traffic Engineer to conduct the study relevant to the effect these signs have on the parking pattern in this area. He anticipated a report would be forthcoming at the November 16th meeting of the Council. The Traffic Engineer has recommended.forwarding the exhibit which he has prepared outlining what he feels to be the safest routes to school to Marshall Lane School for their deliberation and input. It is further recommended to participate with the school and the California Automobile Association for disbursement of literature concerning the Safest Route to School, and also with regard to proper use of pedestrian facilities. Mr. Shook further indicated that this study ties into the request of Mr. Hart regarding abandonment of the walk- way easement. Therefore, it is recommended this item be continued to the next regular meeting of the Council for consideration in conjunction with the request by Mr. Hart. This recommendation was agreeable to the Council. 2. Report from the DirectOr of Planning Re: Annual Review of Urban Service Areas (LAFCO) Mr. Van Duyn reported the Planning Commission's recommen- dation is to not amend the Urban Service Area or Sphere of Influence boundaries at this particular time. CITY MANAGER 1. _Report Re: Process for Possible Disposal of Arco Site It was moved by Councilman Kraus and seconded.by Councilman Matteoni to direct the City Manager to obtain appraisal of the site, and to outline a specific process for disposal, which would include a public hearing, re- taining th~ ingress and egress to the Parking DistriCt within the property. The motion was carried unanimously. 2. Report Re: Resolution No. 778-5, Resolution of the Board Declaring Its Intention to y The City Manager indidated it would be his recommendation tO indicate to t~e School District that the City is not interested in purchasing this property. He further indicated that the Parks and Recreation Commission has recommended the City work with the developer, once the property has been purchased, to get the appropriate dedication and attempt to purchase the additional 2 or 3 acres from the developer.in order to implement the General Plan. TheCouncil concurred inthis recum~ndation. It was moved by Councilman Kraus and seconded by Councilman Brigham to~advise the'Fremont Union School District that the 'City is not interested in purchasing this property. The motion was carried unanimously. 3. Summary of Annual Crime Incident and Traffic Incident Report ~ The City Manager reported that Burglary has declined by 12 percent, and by '40 percent over the last ~ years. Assaults have increased by approximately 53 percent over the last year. Auto thefts have increased by 47 percent. Malicious mischief has increased by some 16 occurrences, or ~ni-increase of 5 percent. · Traffic accidents have decreased 3 percent over the past year, and by 20 percent over the last 3 years. VIII.
