B. MINUTES
Councilman Kalb suggested it be indicated that Councilman
Matteoni was absent at the meeting on August 16, 1978.
It was moved by Councilwoman COrr and seconded by Councilman
Kalb the minutes 6f August 8 and AugUst 16, 1978 be approved,
as corrected. The motion Was carried unanimously.

It was moved by Councilman Kalb and seconded by C~uncilwoman Callon
approval of the Consent Calendar, with the exception of items B and
E. The motion was carried ~animously.

A. RESOLUTION NO. 545-1, RE: DESTRUCTION OF USELESS RECORDS
Councilman Kalb discussed his concern regarding complaints of
disappearance of records. The City Manager explained that

The City Manager replied that~t was proposed ~the Maintenance Man II
position be created because of t~e structdre the City is using
in the Parks and Landscape Maintenance Division, and the~e is
more responsibility assigned to ~ leader of a two.or three-man
team and would require a higher level of expertise in the field.
It was moved by Councilwoman Corr and seconded by Councilman
Kalb to adopt Resolution 85-9..38. The motion was carried
unanimously.

A. REQUESTS RE: RECONSIDERATION OF FUNDING FOR SCHOOL CROSSING
GUARDS (taken out of order)
The City Manager referenced those items of correspondence re-
ceived on this issue, as follows:
Henry H. Dacuyan, Principal, Hoover SchOol, requesting
reconsideration of funding for a crossing guard at Prospe'ct
and'Galway Avenues.
Mrs. BrUce Kenner, Mrs. Patrick Holloran, and Mrs. Karl
Melcher, express.ing concern re: pedestrian safety in
certain defined areas on Quito Road.
Mr'. and Mrs. Gary Andersen,'requesting reconsideration
of funding for crossing guard at Prospect Avenue for
Hoover Elementary School.

It was moved byeCoUncilman Kalb and s~conded by Councilwoman Corr
that the Ci'ty of Saratoga pick up the cost of the crossing guards
for a 60-day period, with the inte'ntion of negotiating permanent
solutions to this problem during this time frame.
Councilman Matteoni indicated he would~f~K~a 30-day period to
allow the schools to explore a means of funding crossing guards.
The Council then voted on Councilman'Kalb's motion, and it was
carried, 4 to 1, Councilman Matteoni voting in opposition.

B.CONSIDERATION OF REQUEST BY U.S. POSTAL SERVICE RE: LOCATION
OF POST OFFICE FACILITY
The City Manager acknowledged receipt of a letter from
John J. McMahon, Field Supervisor-Real Esta6e, U. S. Postal
Service, requesting consideration be given toa new postal
facility on City property near Saratoga Avenue and Fruitvale,
and further requesting time be allotted at the City Council
~eting to speak on this issue.

'-CounCilman Matteoni offered an amendment to the motion to state
that in spite of the City's preference that the'Post Office
facilit~ remain in its existing location, the Council consider,
subject to appropr'iate city planning review, the sites on Saratoga
Avenue in the vicinity of Cox Avenue, as well as the Quito Market
vicinity. Councilwoman Callon seconded the motion. The motion
failed, CouncilmeD Kalb, Corr and Kraus voting in opposition to
the amendment.
The Mayor then called for a vote on Councilman Kalb's original
motion, and it was carried, 4 to 1, Councilman Matteoni vo~ing in
opposition.

Councilman~M~tC~oni that if..:the Post Office finds it absolutely
necessary to 'leave the Village site, alternative locations in
General Plan designated ~rofessional-A~inistrative or Co~ercial
zones be given appropriate consideration by the City, and there
be Som~ design review proce,ss, at minimum, over any building
located in one of these zones. The motion was carried, 3 to
Councilmen Kalb and Kraus in opposition.
C. ORDINANCE 38.90 (Second Rea~i~g)
AN ODINANCE OF THE CITY OF SA~TOGA ~MENDING C~PTER 9 OF THE
SA~TOGA CITY CODE BY DELETING A CERTAIN BUS LOADING ZONE ON
THIRD STREET (Co~t'd. 8/2~78)
It was moved by Councilman ~alb af~d seconded by Councilwoman
Callon to adopt Ordinance 38.90 and waive the reading. The
motion was carried unanimously.
D. ORDINANCE 38.91
AN ORDINANCE OF THE CITY OF SA~TOGA ~NDING ARTICLE V OF
THE SA~TOGA CITY CODE, RE~TING TO LICENSES TO SELL CONCEALED
WEAPONS~
It was moved by Councilwoman Corr and seconded by Councilman
Kalb to introduce Ordfnance'38.91. The motion was carried
unanimously.
VI. SUBDIVISIONS, BUILDING SITES, Z~NING REQUESTS

It was moved by Councilman Kalb and seconded by Councilman

Lane property, on the condition that the applicant agree to
move the building do~ the hillside by five feet, and instruct

the staff to execute the appropriate paper work and conditions.
The motion was carried unanimously.
VII. PUBLIC HEARINGS
A. CONSIDERATION OF CHANGING SPEED LIMIT ON PORTION OF PROSPECT ROAD
FROM 35 MPH TO 40 MPH
1. ORDINANCE 38.75-2, AN ORDINANCE OF THE CITY OF SARATOGA
Ai~ENDING THE SARATOGA CITY CODE, SPECIFICALLY REPEALING
AND AMENDING. PORTIONS OF SECTION 9-51 THEREOF, SETTING
AND ESTABLISHING PRIMI FACIE SPEED LIMITS FOR MOTOR
VEHICLES ON CERTAIN STREETS OF THIS CITY, BASED ON AN
ENGINEERING AND TRAFFIC SURVEY CONDUCTED WITHIN THE
LAST FIVE YEARS (Cont'd. 8/2/78)
The Mayor opened the public hearing at 10:10 P.M.
Susa~ne Mallory, 12258 Kirkdale Drive, requested consideration
be given to the need for bike lanes along Prgspect for the
saf~I of children going to Miller Jr. High~-and..L~n~r~Ok~Hi~'
D~0~hy?Maie~-'i20~53~!Knollwood Drive, commented that she fails
to see how increasing the speed limit is going to remedy this
situation, and it sounds like a "Catch 22", that in order to
regulate speed, you have to increase speed.'
Mayor Kraus explained that because there is no radar at this
location, the'Sheriff will!not arrest anyone as he knows the
case will be thrown out of court.
It was then moved by Councilman Kalb and'seconded by COuncilwoman
Callon the public hearing be closed. The motion carried; the
public he~ring was closed at 10:14 P:M.
~t was moved by Councilman Matteoni and secoDded by Councilman
Kalb to adopt Ordinance 38.75-2 and waive the reading. Further,
the staff be directed to communicate with the Sheriff's Office
regarding the City's expectations for surveillance. The motion
was carried unanimously.
B. CONSIDERATION OF APPEALS RE: TENNIS COURT VARIANCE APPROVAL,

2.APPEAL RE: ISSUANCE OF VARIANCE FOR TENNIS COURT

Upon the recormnendation of the City Manager, ~nd agreement by~
the two appellants in this matter, it was moved by CounCilwoman
Corr and seconded by Councilwoman Callon to set this matte.r for
a de novohearing on November 15, 1978, to allow for.review and
consideration of this entire issue, and to enable the appellants
to present new evidence than that presented to the Planning
Commission. The motion was carried unanimously..
C. CONSIDERATION OF PROPOSED FUTURE USE OF CITY-OWNED SITE ~T COX
AVENUE AND SARATOGA-SUNNYVALE ROAD
The City Manager acknowledged items of correspondence received
on this issue, as follows:

Stan Marshall, representing the Saratoga Planning Commission,
requested that some thought be given to doing this project in
conjunction with the land on the backside of the creek on the
adjacent parcel. He pointed out that the creek acts as a
natural barrier to the development of the backside, and the
most logical development in the minds of the Planning Commission
was to tie this property to the city property so there is a more
optimum'geometry of the portion behind the creek.
.Stan Carnekie,.HCDA Coordinator on the City Staff, advised that
should the City pursue senior citizen housing or family and/.or
multi-family housing mix on:thissite for low to moderate income
individpals, HCDA funds would be available for site improvements.
The Council discussed the idea of integrating this parcel with
the parcel to the south, and various methods for accomplishing this.
It was then moved by Couniclman Kalb and seconded by Councilwoman
Corr the ~b~ic hearing be closed. The motion was carried. The
public hearing was cl~ed at 10:48 P.M.
It was moved by Councilwoman Callon and seconded by Councilman
Matteoni to either lease or sell the property for senior citizen
housing, given some configuration that the front of the corner
· of the property be retained in open space, and consideration be
given tO connectin& with the adjacent parcel. The motion was
carried unanimously,.
Staff will be reporting a specific course of action to use land-
bank funds relevant' to this~ site.'

A. MAYOR
1.' Re-organiZation of CommiSsion for Central Fire District
The City Manager transmitted his report of September 6, 1978,
recommending support of the proposal as approved in concept
~_~by the Board of Supervisors.
~t was the concensus of the Council to-accept this recommen-
dation and direct the City Manager to communicate same to the
County Board of Supervisors and County E~ecUtive. City to
advise regarding council representation during the next
three weeks.
B. .COUNCIL AND COMMISSION REPORTS
1. PLANNING COMMISSION RECOMMENDATION RE: PROPOSED AMENDMENT
TO SECTION 18.13 OF ORDINANCE NS-3 BY DELETING "R-i-40,000"
AND ADDING "HC-RD" FOR ALL LANDS ANNEXED TO THE CITY OF
SARATOGA
Mayqr Kraus ordered this ordinance be introduced and set for
public hearing ~ctober 4, 1978.
2. COUNCilMAN KALB - MODIFICATIONS TO USE POLICIES INTENDED TO

1. DIRECTOR OF PUBLIC WORKS - REPORT RE: USE OF TRANSPORTATION
DEVELOPMENT ACT FUNDS
It was the concensus of the Council to-support the staff report
ated August 16, 1978, expressing specific interest to allo-
cating funds on a population basis.
2. DIRECTOR OF PUBLIC WORKS - REPORT RE: REQUEST FOR RELINQUISH-
MENT OF EASEMENT, WILLIAM C. QUACKENBUSH
It' was moved by CouncilWoman Corr and seconded by Councilman
Kalb to deny this reqUe~t and direct the staff to prepare
Re~olutionAcce~ting Dedication of Easement for consideration
by the Council on September 20, 1978. The motion was carried.
D. CITY MANAGER

2. RECOMMENDATION RE: CRIMINAL JUSTICE PLANNING AGENCY
It was the consensus of the Council to support the recommen-
dation of the City Manager, that'Lthe City of Saratoga not
adopt the proposed resolution to form ~_third mini-grant
agency (Report of August 31, 1978).

PLAN COMMITTEE

It was moved by Mayor Kraus, seconded by Councilwoman Corr, the
