Councilmenber MallOry absent. II. DISCUSSION OF ~ETION ON CASE OF SARATOGA VS. FLOYD F. GAINES City Manager explained history of case, noting that the settlement had been discussed at a litigation session and at?the'regular nL=eting of 4/21, at which Council had directed Special Counsel Faber Johnston to file motio~for~new trial°after a-m6tion~t6'accept a settlement had not passed .' ' ' J~NSEN/WATSON MDVED TO RECONSIDER MOTION TO ACCEPT S~.TrLalMENT. Passed 4-0. City Manager and Special Counsel Johnston explained further details of settlement, noting that Mr. Gaines still must meet" ordinance requirenents for construction of access, and the stairway would re]nain public right of way. Mr. Johnston cu~,l~ented that Mr. Gaines had one year until his lease expires, and the work must be accoa'Lkolished within that time; he felt that Mr. Gaines would sell the property within that time. NATSON/J~NSEN MOVtD TO ACCEPT S~'ITLMMENT. Passed 4-0. Councilmember Jensen noted that when she originally agreed to the idea of a settlenent she was agreeing to the idea of t~o units similar to the ori ginal. four units, not condominiuns or townhouses. She favored saving the small buses that were available for low-incc~e people.and believed that should Be '" investigated before their removal. She also felt the access was inadequate frfml Fourth Street, but she did not want the merchants to have to pay more honey for parking. Councilmember Clevenger stated that she had become familiar with the 'o details of the settlement since the vote at the previous neering and no longer felt it necessary to abstain. Counci~ Jensen cu,u~ented that she had cu~romised in changing the. two year period of time to one year; she felt the City would have to live with the situation. III.
