ORGANIZATION A. ~OLL CALL -Councilmembers Clevenger, Fanelli, Mallory and MDyles present at 7:35 p.m. Mayor Callon absent. Councilmember Mallory presided as Mayor Pro Ten. B. ~LINUTES - 4/6 Councilmember Moyles requested that the minutes reflect that the zoning on the Teresi pro.Ferty was to be PC. (Councilmember Fenelli asked that staff report on whether it should be PC or PD. ) Councilmember Moyles COrrected the reference on page 3 to the Teresi proparty, which should read the Abramms proparty. Council- member Mallory added that he bad felt that two-story should not be allowed between the Teresi property and the existing school, as well as along Bucknail. ORAL Richard Stowers, 17089 Crescent Dr., Los Gatos, inquired as to the status of a tentative map for the Devoss residence on Farwell. Con,,~unity Development Director stated that Deputy City Attorney W-as preparing an amendment to City ordLnances to , COnform with the State Map Act, which ~Duld clarify" ~be situation. John Lathuras, 13761 Howen Dr., rose to speak about the proposed City cc~puter. He was asked to defer his COnlnemts until Item IV. D. B. WR1TI'biq #1 from D. Williamson COncerning Buddy Poppies - request granted. FA~ELLI/CLEVENGER MDVED TO PASS RESOLLrfION 2053 CONCERNING BUDDY POPPY DAY. Passed 4-0. #2 from J. Rodq~rs COncern~ing County Criminal Laboratory Financing - COnsensus to support legislation and notify appropriate state representatives. #3 from W. O. Singletary COncerning transfer of two deputies - discussed after Written Can~unications. #4 from Fargaret Dennis regarding uses for City funds other then newsletter - noted and filed. #5 from S_aratoga Fire District supporting formation of public safety task force - Mallory and Fanelli, being Councilmembers delegated to work on formation of task force, will discuss with City Manager. Mayor Pro Tea Mallory then invited representatives of the Sheriff' s Office to speak on the .. ' _~_Dending replacenent of t~D Saratoga deputies. Lt. Rich Houston explained the Sheriff' s system of rotating deputies between the .... jail snd other duties and introduced the new deputies, Steve Dennis and Steve ·Angus. Both deputies reviewed their qualifications and their cenm~hnent to Saratoga. Staff was directed to infom Mr. Singletary about the new deputies. III. SUBDM SIONS, BUILDING SITES AND ZONING REQUESTS - None. IV. PETITIONS, ORDINANCES AND RESOLUTIONS A. Ordinance amending Ordinance No. 66 by changing the number of members of the Heritage Preservation Conraission from five to seven .(first reading) Councilmember C!evenger expressed COncern that the 180-dsy demDlition delay pro- vision not be forgotten, arfi Councilmember Moyles noted that a form letter the 2-4/20/83 Cu~u~,i ssion was using mentioned that there were r~ restrictions on the properties listed on the County inventory of historic buildings. In view of the Commission's consideration of the 180-day derotion day provision, Councilmember Clevenger sug- gested that the Cal]'tLLssion take note of that fact in the letter. Resolution appropriating funds for Pavement Management System Cc~nputer In answer to Mayor Pro Tern Mallory, City Manager stated that Pavement Management ReFDrt ~Duld be available by about June 1. Mayor Pro Ten Mallory then requested that staff have alternatives reedy if it became necessary to raise funds for road · repair. City Manager confirmed that report and alternatives ~Duld be ready at the same time. John Lathuras then rose to give details abDut an alternative computer System to the one prq_mosed by staff. Councilmember Clevenger l~ointed out that Council could appropriate ~he funds without oon~nitting the City to a particular system, and Finance Director was asked to consult with Mr. Lathunus. MOYLES/Cr.RVt.I~GER MDVED ADOPTION OF RESOLUTION 1099.15. Passed 4-0. Mayor Pro Tern Mallory noted that although he had voted against the computer pur- chase in study session, he had voted for the present motion because of the City Manager' s assurance the. t the report ~Duld be ready June 1, and this would be part of the budget process. Discussion of Proposal for City-Wide Annexation to LLA District Mayor Pro Tem Mallory stated his belief that the Council' s decision not to proceed with City-wide annexation to the Landscaping and Lighting District was not consistent with the best interests of the City. He believed residents would support reasonable assessments to maintain parks and .medians and improve City entrances, medians and major street landscaping add noted that the Council had placed medians among its top five priorities. He regretted that the issue could not now be considered for another year. 2. Report from Parks and Recreation C~Yu~',~ssion on Replacement of Member Of Sister City CuL~ttee Councilmember Moyles reported that the Commission was withdrawing its request because there was nothing more for the Steering Cc~mittee to do. 3. Report of Findings re: Sister City Cu~u~,~ttee Council discussed findings and accepted report. · · ~ MDYLES/~,RVENGER MDVED TO APPROVE C0~'41TI'EE RECO~EM3ATIONS AND R~UEST STAFF TO PREPARE RESOLUTIONS FOR NEXT M~wl'/lqG AFFIRmrING SISTER CITY RELATIONSHIP AND CDM- MISSIONING THE ESTABLISPLMENT OF AN INDEPENDENT SISTER CITY COM~/TFEE. Passed 4-0. In response to Councilmenher Fanelli, Councilmember Moyles stated the steering cc~rnittee could continue to work until the permanent conmittee is ready. In answer to Councilmember Clevenger, he stated t_bat other citizens could also be encoura_,eed to apply for membership on the permanent con~Littee. Councilmember C!evenger asked about the procedure for donating a tree in memory of someone. City [~3nager stated that the interested person could consult with Roy Swanson on the matter, then bring the proposal to Council for approval. Councilmember Far~l!i reported on the Plee~ing Cul~,~ssion meeting and urged Councilmenhers to attend according to schedule. She also stated that the Com- mission was solicitin~ ideas for some sort of written memorial for Rob Robinson, the Planning Director who bad recently died, so that people could make personal expressions in his megDry. Cc~munity Development Director added that Cathy Dunlap of his department was coordinating the various suggestions. D. CITY b~ANA~R 1. Repert on Implementation of Cc~munity Services Officer City Manager descriked anticipated benefits of CSO program and noted that there would be no conm~tment of funds until the progain returned to the Council in the budget process. Councilme~nbers commended City ~nager for his work on the p~o- ject. Councilmember Fanelli expressed some concern as to coordination between the City Manager' s office and the Sheriff's dep~rh!ent. She then brought up the possibility, discussed in a goals and objectives session, of having.. an officer start early to develop some of the basic procedures. City Manager stated he 4/4/20/83 ~Duld want to discuss the matter with the Sheriff's Office. Mayor Pro Tem Mallory cautioned that the City should he involved in directing the proposed services rather than turning it over to the Sheriff's Office. Transmittal of Report prepared by City Volunteer on False Police Alalm Ordinance Maurice Philleo presented the report he had prepared recul~lending various chan'ges for the False Police Alarm Ordinance. They included streamlining the appeals and fee collection procedures, deleting interest charged on the fee, and requiring the investigating officer to leave a copy of his investigation report at the residence. Council questioned him on details of his report and reached consensus to accept it. Council set date for hearing false alarm fee appeals for May 18, 6:00-7:30 p.m. D. CITY MANAGER City Manager requested Council consensus to oppose AB 1599, which would change procedures for cities' housing needs determination. There was consensus to do so, and Council directed City .Manager to write letter of opposition. City Manager then reported on staff investigation of apparent discharge of water by San Jose Water Works which might have caused scme damage near Michasls Drive. He stated that discharge appeared to be'minimal, but San Jose Water Works was being requested to provide further information. .Mayor Pro T~n Mallory inquired as to the Parks and Recreation Comission tour and barbecue. City ~tnager stated Council ~Duld he informed as to details. Mayor Pro Tern Mallory then noted that the City Manager and Council should have their dinner meeting May 10.
