Housing Coalition for Purchase of Saratoga Court
City Manager explained that legal work had not been completed on the project. Mr.
Toppel of the City Attorney' s Office reported on progress being made.

C. ORDINANCES AND RESOLUTIONS
1. Resolution Requesting Revision of ABAG's Housing Needs Determination
for Saratoga
City ~mnager distributed a staff report written by_ Mr. Toppel as an exhibit for the
resolution. Councilmenber Fanelli ir~uired as to whether"the issue of distribution of
types of busing units sheuld he aadressed. City Manager explained that at this stage
of the process only the number of units is to be considered; distribution is to he
dealt with at a later point.
CLEVENGER/MALI/DRY MOVED TO ADOPT RESOLUTION 2097. Passed 5-0.
2. Ordinance Making Certain Changes in Park Regulations as Recommended
by Parks and Recreation Commission (second reading)
Councilmember Callon stated that she favored the ordinance ~n general but opposed the
section requiring a permit for use of alcohol in parks. She feared this would prevent

such groups as couples and famil es from enjoying' ~all amounts of alcohol in the parks
without a permzt C~ty ~nager ted that drinking has indeed been a probl~n in the
perks. CouncilmEmber Fanelli asked whether signs would be installed in all the park
entrances before enforce~ant. C~y Manager replied that this would be added to signs
already in the parks. Councilmember Fanelli suggested that that be done before any
enforcement by the Sheriff' s Deps_rtme~t so that the public would be notified.

3. Ordinance Changing M ectlon Date to November of Even-

_Mayor st~ed~E~ put On the subject frcea several parties and
thought .it fitting to schedul~ it for a noticed public heering. Councils dis-
cussed the appropriateness of conducting a public hearing on a matter for which a vote
of the people had not been felt necessary and the process by which items should be
scheduled for the Council agerda. I Mayor Moyles recognized those members of the audience
who had come to speak on the issue.

tion would at times coincide with the national elections, which he felt to be undesirable.
Further, he felt that the June election date did not in fact interfere with the budget
process.

A0 Amendment to text of Zonin~ Ordinance by adding Office/Electronics to
the list of Conditional-Uses allowed in the P-A District (Professional
Village of Saratoga/Owens ~o., Saratoga aP~ Cox Avenues)
Mr. Toppel explained that the applicant had witbdrawn his request for amerdment of
the ordinance; he reconm~nded thatl~ the noticed public hearing be conducted nonetheless
The public hearing was opened at 7:42 p.m.
Jim RUSsell of the Saratoga Perk ~DOdS Homeowners ASsociation requested clerifiCation
as to whether the applicant 's request had been for Reseerch ard Develo~e/nt or Office/·
Electronics. Mr. TODDel explained ~that Office/Electronics had been the original tenn,
but Research and DeV~lolm~n~t had been substituted during the process.
No one further appearing to speak, the public hearing was closed at 7:46 p.m.

Councilmember Callon noted' that she was voting for the nDtion with the notation that
the appliCation had already been w awn by the applicant. Councilmember Fanelli
agreed, noting that the decision was based on the Planning Commission recommendation
and that no testinDny had been heard.
VI~ NEW BUSINESS
A. Discussion of Oral ConmuniCationa, if any

Mayor ~byles stated that Norman Sorenson wished to speak on his claim, which had
been denied on the Consent Calendar. Hearing no objections from the ~ouncil he
recognized Mr. Sorenson.
Norman Sorenson, 21265 Sarabills Drive, spoke to the slippage of Sarahills Drive
during the last rainy season. He expressed concern about his property value and
the possibility of further slippage, together with his hopes that some solution
could be found.
B. Written Coxlulonications from Public
#1 from T. Walsh objecting to City staff salary increases noted and filed. Council-
, member ~nllory reported that he had spoken with Mr. Walsh to clarify the matter
#2from V. M. Greenspan encouraging Council to USe federal funds for HUD housing on
Cox Avenue noted and filed.
C. New BUSiness from Councilmembers
Councilmember Callon suggested that the Council pass a resolution conlnending
Campbell Councilmember Bill Podgorsek, who was about to retire.

Passed 5-0.
Councilmember Fanelli conveyed several questions from the Firance Conmittee. Council-
members discussed questions; no need for further land options study by the Conmittee ,
was exp_r.eSsed, but need for the Council t6 make decisions on the matter was expressed.
'Councilmembers felt that Village Parking District #3 was a worthwhile project, and
p~haps the staff could outline the steps to he taken and the Csnm~ittee could help
the Council on the matter. Councilmember Fanetli also reported optimistically on
her visit with legislators in Washington concerning the City' s appeal on FRMA funds.
Councilmember Fanelii also reported that Supervisor ~brgan and the Board of Super-
visors would soon write to the Council requesting action on the Fire District Con-
solidation Task Force.
Councilmember Mallory stated his belief that the public hearing charge was so great
as to discourage people from appealing matters. City Manager was requested to place
the matter on a study session agenda.
Mayor Moyles brought up the question of County Maasure A on jail financing.
Sheriff RObert Winter rose, speaking infavor of a resolution Supporting Maasure
A. He answered questions on possible other sources of funding for the mail, flat
tax rate per parcel, function of the j'ail, ' early release of prisoners, reasons
for jail overcrowding, and what measures might be directed to the root of the problem.
Betsy Bryant, 19001 Monte Vista, then spoke as canpaign manager for Measure A. She
focused on the issue of early release of prisoners.
Moyles/Mallory moved to adopt Resolution 2099 on jail financing. Counci~
Callon expressed a wish to amend the resolution to urge voters to consider voting
for the measure rather than urging them to vote for it.

FDYLES/MALLORy MOVED TO ADOPT RESOLUTION 2099 AS AMENDED. Passed 5-0.
Councilmember Fanelli expressed reservations about the process of taxation, since
the assessment would be the same on every parcel without regard to the wealth of
the property owner.
D. New BUSiness from Staff, Administrative Reports not Scheduled
City ~snager brought to the attention of Council a proposed tour of the Quarry Creek
area by the Soil Conservation Service to view erosion and siltation problems. He
stated his intention to inform the Council of the date and time of the tour. t, .'~.

Mayor Moyles then noted that he h~d shown the Council copies of a proposed resolution
declaring United Nations Day a~d requested that it be passed.
CAILON/FANELLI MOVED TO ADOPT RESOLbTION 2100. Passed 4-0 (Mallory abstaining).
Councilmeml~r Fanelli further explained the Upited Nations Day luncheon ar~ encouraged
members of the public to attend.
Councilmember Callon then inquired as to the proposed closing of Stelling Poad~ con-
letter to the Cupertino City Clerk.

cilmember Clevenger expressed ~be fear that several cities might close streets which
were felt to be used as con]nuter runs, and City Manager noted that cities could close
streets in accordance with prooedures specified by State law.
