Ordinance Amending Ordinance Imposing Sales and Use Tax .to ~be Administered by State Board of Equalization (second reading) CALLON/MOYLES MOVED TO ADOPT ORDINANCE 38.114. Passed 4-0. 3. Ordinance on Storage of Hazardous Materials (second reading) MALLORY/MOYLES MOVE TO ADOPT Ordinance 38. 115. Passed 4-0. 4. Report on Calculation of Public Hearing Fees City Manager explained process by which fees had been raised over the years. Council discussed other cities' fees and alternative possibilities for handling noticing procedures and costs. There was consensus to continue to contract with a noticing service rather than requiring applicants to handle noticing in order to avoid previous problems with comelaints on the accuracy of the noticing. Council- member Fanelli and Mayor Meyles felt that the City should continue to attempt to recover 80% of the costs, which is the basis for calculating this and other fees. Councilmembers Callon, Clevenger and Mallory felt that such a calculation resulted in a fee which was too high and thus discouraged citizens from appealing issues. Councilmember Callon suggested a conpremise by which appellants would be charged .. a $50 fee plus a $50 refundable charge for mailing notices. CALLON/FANE, LI.I MOVED TO ADOPT RESOLUTION 780.20.1, CHANGING APPEAL Fkn~S TO $50 PIES, IN THE CASE OF PUBLIC HEAF~INGS, A $50 FEE FOR COST OF ~RILING NOTICES, ANY UNUSED FORTION OF WHICH WILL BE REFUNDED; IF THE COST OF MAILING NOTICES IS GREATER THAN $50, THE CITY WILL ABSORB THE Pa~4AINDER. Passed 4-1. (Mallory opposed). Councilmember Mallcry explained that he opposed the raption because he felt the fees were still too high. 5. Report on Possible Increase of Cable Television Rates City Manager explained report, noting that there was as yet no formal request for a rate increase. Councilmember Mallory brought up the possibility of redefining a pertion of the contract dealing with progranlning, with the idea of actually using the provisions later. City Manager noted that as far as content is concerned, the City is not ~red to regulate cable television. There was consensus to request from Saratoga Cable Television the information outlined in the Administrative Services Director's report dated 12/9, as well as information on rates of neighboring cable television services. Councilmember Callon requested that the Council be notified in a timely manner if there were difficulty in obtaining the information so that attorneys would not need to spend a great deal of time in obtaining it. 6.
