SARATOGA CITY COUNCIL

1. ROLL CALL: Mayor Hlava, Councilmembers Clevenger, Anderson, Moyles,
Peterson present at 7:11 P.M.
2. CEREMONIAL ITEMS: None.
3. ROUTINE MATTERS
A. Minutes of the Meeting of December 3, 1986, approved with the following changes:
Councilmember Clevenger asked that in the first paragraph, seventh sentence, deletion of
"Clevenger" to mad, "Councilmember Anderson stated that ghe prefers..." In the fourth
paragraph, second sentence, delete "Council" to read, "The Authority has already considered.."
Minutes of the Meeting of December 17, 1986, approved with the following change:
Councilmember Moyles asked that on Page 6, Item F., fourth paragraph, delete the f'trst
sentence and add, "Councilmember Moyles was not favorable to relocation of the driveway;
however, he was favorable to landscaping if it provided the needed screening."
Councilmember Anderson asked that on Page 2, final paragraph, second sentence, to read
"...with 900 million projected over a ten year period."
B. Approval of Warrant List: Consensus to approve except for Warrant 31605,
which was voided.
C. Report of City Clerk on Posting of Agenda:
Pursuant to Government Code 54954.2, the agenda for this meeting was properly posted on
December 31, 1986. The City Manager noted for the record thgt the agenda was properly
posted as required by State law.
4. CONSENT CALENDAR - OTHER ITEMS:
A. Heritage Commission Minutes, December 10, 1986, - Noted and filed. ·
B. Acceptance and Acknowledgment of Donations to Hakone Gardens
(J. and R. Wade, R. and T, Gunter, M.A. Wolf, and M. Stanton, Donors)
C. Report on Impact of Bottle Bill (AB 2020) on Local Zoning - Staff and Planning
Commission directed to prepare an amendment to the Zoning Ordinance when
regulation guidelines are received from the State.
D. Ordinance 71.14 amending the Zoning Ordinance to allow commercial parking lots
as a conditional use in the R-1 zoning districts under certain conditions. (AZO
86-001) (Saratoga Avenue Associates) (second reading and adoption)
E. Ordinance 71.15 amending the Zoning Ordinance by amending Sec. 15-12.160
pertaining to storage of personal property on residential sites, amending Sec.
15-30.100(c) to permit monument signs on commercial sites that have 5 or more
uses; amending Sec. 15-50.020(c) concerning the def'mition of street trees;
amending Sec. 15-50.090 conceming appeals from administrative decisions under
tree regulations; amending Sec. 15.56.050 concerning property inspections on
applications for second unit use permits; amending See. 15-060.010 concerning
temporary uses;

F. Ordinance 71.16 amending the Zoning Ordinance by adding Sec. 15-80.110

Subdivision Ordinance concerning easements and Sec. 14-03.060 of the
Subdivision Ordinance concerning trees (AZO 86-005) (second readidg and

G.Renewal of Village Library Lease for One Year with No Changes in Terms or

H. Authorization for City Manager to Attend Annual League of California Cities City '
Manager Department Meeting in Monterey, February 18-20, 1987, with reasonable
and necessary expenses
I. Final Map Approval for SDR 1623, Miljevich Dr., 1 lot, (D. Coffey, Developer)
J. Final Adjustments to Contract for Congress Springs Park Landscaping; Approval of
extra work order to install undergrotmd electrical service ($7893.56); Approval of
adjusm~ents totaling $6,121.34; Approval of final payment to Cagwin and
Dorward ($431.76); Acceptance of work and Appi:oval of Notice of Completion for
the project.
MOYLES/PETERSON MOVED TO APPROVE CONSENT CALENDAR. Passed 5-0.

6. OLD BUSINESS
A. Resolution 2347.8 Adjusting Budget for Additional Improvements to Congress
Springs Park Appmved December 17, 1986.
PETERSON/ANDERSON MOVED ADOPTION OF RESOLUTION 2347.8 INCREASING
APPROPRIATIONS AND AMENDING 1986-87 FISCAL YEAR BUDGET. Passed 5-0.
7. NEW BUSINESS
A.Resolution 2395 approving application for grant funds under Community Parklands
Act of 1986
The City Manager reviewed the p~oposed Resolution for the Council.

8. PUBLIC HEARINGS
A. Ordinance amending Section 10-05.030 of the City Code concerning obstructions to
streets and sidewalks and amending Article 10-20 concerning issuance of
encroachment permits (fast reading)
The City Attorney presented the Report of January 7, 1986, reviewed proposed changes and
answered questions on procedures to be followed in applications received and fees to be
charged. He noted that there was no change in the type of review of Applications. The City
Manager noted advantages of changes in fee schedule.
The Public Heating was opened at 7:26 P.M. There were no speakers.
PETERSON/CLEVENGER MOVED TO CLOSE THE PUBLIC HEARING AT 7:27 P.M.
Passed 5-0.
PETERSON/CLEVENGER MOVED TO INTRODUCE AN ORDINANCE AMENDING
SECTION 10-05.030 CONCERNING OBSTRUCTIONS TO STREETS AND SIDE
WALKS AND AMENDING SECTIONS 10-20,070, 10.20.080(b), 20-20,090, 10-20,100
AND 20-20.110(a) CONCERNING ENCROACHMENT PERMITS. Passed 5-0.
B. Ordinance adding Sections 9-15.055 and 9-20.035 to the City Code relating to
designation of no parking areas by the City Engineer (first reading)
The City Attomey reviewed the Report of the City Engineer, dated January 7, 1986. In
response to Councilmember Peterson's question, he cited an application of the proposed
Ordinance.
The Public Hearing was opened at 7:29 P.M. There were no speakers.
PETERSON/MOYLES MOVED TO CLOSE THE PUBLIC HEARING AT 7:30 P.M.
Passed 5-0.
MOYLES/MOVED TO INTRODUCE AN ORDINANCE ADDING SECTIONS 9-15.055
AND 9-20.035 TO CHAPTER 9 OF THE CITY CODE RELATING TO DESIGNATION OF
NO PARKING AREAS BY THE CITY ENGINEER. Passed 5-0.
9. CITY COUNCIL ITEMS:
A. Reports from Individual Councilmembers
Councilmember Peterson noted that a number of editorials have appeared on acquiring
additional funding of transportation costs through levying of a tax on gas; he supported
such a tax. He suggested that the Council consider support for such a tax. The City
Manager noted that a procedure is already in place to levy such a tax.
In response to Councilmember PetersoWs question regarding the institution of pay
parking on the West Valley College Campus, the City Manager stated that he requested a
meeting with the Chancellor of West Valley College; a reply to this request has not been
received at this time.
The City Manager will attend the College Board of Trustees Meeting, January 15, 1987,
to discuss the City's '. view on the proposal.
Councilmember Moyles will report on the Traffic Authority Meeting at a later date.
Mayor Hlava asked that the Limitation of Tracks on Route 85 be addressed.
Councilmember Moyles asked that Staff prepare a letter on behalf of the Council
requesting introduction of a Resolution in the State Legislature on this Item.

The Mayor noted receipt of letters from the Chairman of the Organizing Committee for
the World Exposition of Historical Cities asking the City of Saratoga to participate in an
exposition at this event. She asked for confn'mation that the City would not be
participath:tg in this event; Staff will draft an appropriate letter.
