Passed 5-0. 5.COMMUNICATIONS FROM COMMISSIONS AND THE PUBLIC: A. Oral Cormnunications from the Public and Commissioni Col. E.T. Barco presented an item from the San Jose Mercury News concerning '.' C0uncilmember Anderson's intervention to prevent fraudulent activities. · -Ms. Diane Siegal, 20290 Pierce Rd., Saratoga, noted problems with four wheelers driving on private property; she asked that the City intervene to solve this problem. The City Manager was directed to contact the Deputy Sherifles Office. - Mr. Dave Smith, Saratoga, addressed questions to the Council; he was invited to made a statement if he wished. The City Attorney intervened that any legal questions could be directed to the City Attomey's Office. He informed the Council that litigation was pending and advised them not to respond at this time. Ms. Ann Crosley, 20152 Pierce Rd., Saratoga, concurred with statements made by Ms. Siegal and ask,~ that speed bumps be installed. B. Written Communications from the Public 1. Lease Agreement with Historical Society - Request amend to include City payment of utilities CLEVENGER/PETERSON MOVED TO AMEND THE LEASE AGREEMENT WITH THE SARATOGA Iq~STORICAL FOUNDATION. Passed 5-0. 2. Letter from Bay Area Air Quality Management District urging support for restoration of State funds for California Occupational Safety and Health Administration Councilmember Clevenger favored support of this request; Councilmember Moyles noted concern .in supporting such requests due to budgetary concerns. CLEVENGER/PETERSON MOVED SUPPORT OF BAY AREA AIR QUALITY MANAGEMEN~f DISTRICT REQUEST. Passed 5-0. 3. Letter from Judy Cosgrove requesting support for San Jose Symphony Councilmember Clevenger stated that she had received a letter from the Friends of Music; she noted that there were many worthy arts causes and urged support of. Saratoga arts. Mayor - Hiava concurred. Consensus reached to state such in a reply to Ms. Judy Cosgrove. 4. Letter from Laura Evulich requesting traffic control at comer of Surrey Lane and Saraview Drive. Reply drafted by the City Manager notedi consensus reached to forward reply to Ms. Evulich. 6. OLD BUS]~NESS A. Ordinance 71.24 amending Article 15-56 of the City Code to modify the provisions concerning legalizafion of certain existing second units (second reading and adoption) MEETING OF THE CITY COUNCIL Page 3 APRIL 15, 1987 OLD BUSINESS Continued Councilmember Anderson noted comments made by citizens regarding the allowed grace period; she felt that such was excessive. In addition, she noted her concern regarding the enactment of legislation which would be unenforceable. She stated she would change her vote because she favored stronger enforcement and the proposed Ordinance amendment would not effect the necessary changes. Mayor Hlava felt that the disclosure law would make a significant difference. Councilmember Clevenger noted that she had not endorsed this Ordiuance amendment in the past and would not do so at this time. Col. E.T. Barco requested that this item be opened for Public Hearings and presented a statement stating his strong opposition to the proposed amendment for the following reasons: Rewarded illegal action Approval of substandard housing Legalization of housing which violated the privacy of law abiding citizens Non conformity with state laws on second unit housing for seniors Unanimous disapproval of the Planning Commission Lack of advance publicity for the first Public Hearing on this issue Ms. Diana Parham, 14613 Oak Street, Saratoga, stated that the Ordinance amendment as proposed could be a valuable asset to the City since buildings that did not meet required Codes could be taken down. Mayor Hlava noted that this Item was not a Public Hearing; further testimony was not taken. Councilmember Moyles commented that extensive public testimony had been taken on previous occasions. Responding to the above comments, he stated that cities had been required by the State to adopt second unit Ordinances and he noted the lacl~ of citizen interest in this issue. He stated that the goal of the proposed Ordinance was compliance through incentives. Councilmember Clevenger noted her concerns: The proposed Ordinance amendment would not address the problem nor encourage individuals to come forward to rectify illegal second units. Cited the recent appeal considered by the Council which might have been approved under this amended Ordinance. MOYLES/HLAVA MOVED ADOPTION OF ORDINANCE 71.24 AND APPROVAL OF A NEGATIVE DECLARATION. Passed 3-2, Councilmembers Anderson, Clevenger opposed. B. Sale of Property to CalTrans (Highway 9) PETERSON/IVlOYLES MOVED TO AUTHORIZE THE MAYOR TO EXECUTE RIGHT OF WAY CONTRACT AND GRANT DEED TO CALTRANS FOR TWO SMALL PARCELS. Passed 5-0. C. Letter from State Senator Bill Lockyer concerning Ring Around the Bay Bicycle Path Councilmember Clevenger favored conceptual support Of this project; Councilmember Peterson concurred but noted funding concerns. Councilmember Moyles did not favor conceptual support and expressed concern regarding the diversity of interests expressed by the Council. Consensus reached to support the concept of the Ring Around the Bay Bicyclcle Path, Council- member Moyles opposed. Mayor Hlava will convey concerns expressed in letter of reply. 7. NEW BUSINESS A. Approval of Landscaping Modification, Identification Sign andFlag Poles in Front of City Hall The City Engineer reviewed the Report to Mayor and City Council of April 8, 1987, presented the preliminaxy plans for consideration and answered questions addressed. MEETING OF THE CITY COUNCIL Page 4 APRIL 15, 1987 NEW BUSINESS Continued Councilmember Moyles cited favorable public comments received regarding sings constructed in conjunction with the Rotary Club; he suggested that similar signage be used in front of City Hall since the these signs were successful and would provide consistency. ~ CoDncilmember Peterson concurred and stated ,ihat he favored ground lighting. B. Resolutions 2420, 2420.1 for 1987-88 concerning Landscaping and Lighting District LLA- 1 ' .(existing) City Engineer Shook reviewed the Memorandum dated April 7, 1987; he noted that the Council would be holding a Public Hearing on this Item in June. MOYLES/CLEVENGER MOVED TO APPROVE RESOLUTION 2420, DESCRIBING AND DIRECTING PREPARATION OF ENGINEER'S REPORT FOR FISCAL YEAR 1987 - 1988, LANDSCAPING 'AND LIGHTING DISTRICT. Passed 5-0. CLEVENGER/PETERSON MOVED TO APPROVE RESOLUTION 2420.1APPOINTING ATYORNEYS FOR FISCAL YEAR 1987: 1988. Passed 5-0. MOYLES/HLAVA MOVED TO ALFi~ORIZE EXECUTION OF COOPERATiVE AGREE- MENT TO FUND THE PREPARATION OF A PROPOSAL FOR EVALUATION OF NON POINT SOURCE POLLUTION. Passed 5-0. F. Award of Contract for Overlay of Certain City Streets City Engineer Shook presented the MemOrandum of April 9, 1987, and recommended that Council award the Contract to the low bidder. PETERSON/CLEVENGER MOVED TO AWARD THE CONTRACT FOR OVERLAY CERTAIN CITY STREETS 1987 TO THE LOW BIDDER PIAZZA CONSTRUCTION COMPANY IN !THE AMOUNT OF $370,058.86. Passed 5-0. Mayor Hlava asked. that Items E and G be heard after Public Hearings. 8. PUBLIC HEARINGS A. Ordinance amending Zoning Ordinance Subsection 5-20.020 (a) to include bed and breakfast establishments in the definition of "Hotel;" amending Section 15.12-030 to include bed and breakfast establishments as a conditional use in R-1 zoning districts adjacent to the Village; and amending Subsection 15-35.030(e) pertaining to required parking facilities for bed and breakfast establishments. (AZO 86 003) (furst reading) (Continued from March 4, 1987) MEETING OF THE CITY COUNCIL Page 5 APRIL 15, 1987 PUBLIC HEARINGS Continued Planning Director Hsia presented the Report to the Mayor and City Council of April 9, 1987, and noted that there were only four structures in the City that would qualify for a Bed and Breakfast designation. He reviewed Options available to the Council. The Public Hearing was opened at 8:12 P.M. Col. E.T. Barco cited an articie on Bed and Breakfasts published by the San Jose Mercury News; he noted that inns cited in the article were in old, single family neighborboods which had slowly deteriorated into multiple housing and mixed comn~ercial use. All three inns lyere well mathrained; he noted that in essence, Bed and Breakfasts were simply commercial activity which eroded fine old residential neighborhoods. He urged denial of this Ordinance. Ms. Suzanne Armbruster, 21169 Canyon View Dr., Saratoga, presented a petition signed by approximately 1 I00 Saratoga residents opposed to the proposed Ordinance. While not opposed to Bed and Breakfasts as such, petitioners felt that such establishments and all other commemial ventures must be confined to currently designated commercial zones. Ms. Marguerite Chapman, 21221 Canyon View Dr., Saratoga, stated that the majority of residents she contacted felt strongly on the folio,wing issues: Residential character of the City Traffic impacts of allowing Bed and Breakfasts in residential areas Possible lowering of property values from commercial ventures in their neighborhoods. Dr. Don Prolo, 20471 Forrest Hills Dr., Saratoga, reviewed his choice of Saratoga for his home and no~ed the benefits anticipated. However, his home is located within the 500 ft. boundary of the Village; he cited impacts from commercial development and the possible closure of Saratoga School. Ms. Diane Parham, Twin Oaks Homeowners Association, which represented over three million dollars in property value. She stated that property renovation had become one of the most profitable investment areas for private or corporate individuals; tax credits that could be claimed in commercial use of older buildings were noted. She stated that zoning was to protect the rights of property owners and urged the Council to protect these zoning designations. Mr. James Cohen, 1492 Vickery Ln., Saratoga, requested a correction in a San Jose Mercury News article and questioned the procedure to be followed in reaching a decision on this issue. Mr. Lee Grey, President, Saratoga Homeowners Association, stated that property values of Saratoga Oaks exceeded thirty two million dollars. The Association felt that any change in the R-1 zoning was not in the best interest of homeowners or the City and urged denial of the proposed Ordinance. Ms. Betty Rowe, 20360 Saratoga-Los Gatos Rd., Saratoga, noted that the most disruption a city could have was to put commercial next to residential. Conditional use was a bad self image gimmick. She was strongly 9pposed to commercial use in residential areas. Ms. Nancy AriaS, 20590 Canyon View Dr., Saratoga, addressed the history of the Valley. She cited the impact of traffic and parking from growth and added that establishments once used as inns were now surrounded by residential areas. Commercial use in a residential area would go against the heritage of the City. She urged denial of such uses. Ms. Joanne Prolo, 20471 Forrest Hills Dr., Saratoga, noted the overwhelming majority of public opinion against commercialization of residential areas and the sad recognition that some members of the Council did not seem to listen. She cited the concerns of those who live within the 500 ft. area from the Village boundary. Mr. Dennis Aidridge, 14607 Aloha, Saratoga, stated that he did not want his children exposed to threats from vendors or transients brought into the area by commercial establishments. Mr. John Schaub, 20300 Orchard Rd., Saratoga, noted that the Planning Commission had supported the pure residential nature of this area. He questioned the 500 ft. extension of the Village giying adjacent residential areas a commercial stigma and strongly opposed such action. MEETING OF THE CITY COUNCIL Page 6 APRIL 15, 1987 PUBLIC HEARINGS Continued Ms. Carol Machol, Ronnie Way, Saratoga, noted that protection of the residential character of Saratoga was a primaxy issue in designing the General Plan of the City; she urged protection of the neighborhoods of the City. Ms. Dora Grens, 13.451 Old Oak Way, Saratoga, concurred with comments already noted and reviewed the his~oi.~ of local inns. He stated that he:would be directly affected ! . mid categorically opposed the proposed Ordinance.:.. · Mr. :Bill Brown, resident of Saratoga Oaks, stated he was. in favor of Bed and Breakfast Inns · . : and cited e~periences of visiting inns in California and Europe. . Mr. Bob Renner, ~2t f31- Sullivan Way, Saratoga, related a story and noted his concern regarding "creepinl; commercialization." He felt that allowing Bed and Breakfasts would trigger a spread of.commercialization throughout the Village and urged denial of the Ordinance. Mr. Bill Thomas, Pierce Rd., Saratoga, cited a Bed and Breakfast in Pacific Grove which had existed for years; in his opinion, this Inn had not detracted in any way from the City. The fact that the Council had control over these establishments had been overlooked. Mr. Shelly Williams, former Planning Commissioner, noted that the City had an area that could handle the particular problems of Bed and Breakfast Inns with adequate protection for both the neighborhood and the residents. He was in favor of allowing Bed and Breakfasts in the City. Ms. Jackie Welch, 20925 Jacks Rd., Saratoga, noted irrelevant arguments and questioned how an application for two establishments could lead to rampant commercialization. She noted that Lundblad's Lodge was already zoned for multiple dwellings. Mr. Noel Kane, Lowell Ave., Saratoga, noted Code enforcement problems of the second unit Ordinance and questioned the ability to monitor activities of commercial establishments. Mr. Greg Grodhaus, 20379 Saratoga-Los Gatos Rd., Saratoga, stated that he opposed the proposed Ordinance and asked the Council to please, not approve it. Mr. Jack Christian, 19022 Brookhaven Dr., Saratoga, stated that a 500 ft. area of commercial- ization was under consideration; who would he address in the future regarding this area? Ms. Magdalene Lavine, Oak Street, Sitratoga, stated that she fh'mly oppose 'ed and Breakfasts and asked that residents be given full consideration. Mr. Jeffrey Braun, 20220 La Paloma, Saratoga, cited previous testimony and noted opposition the proposed Ordinance; such was only the first step in an encroaching commercial use. People are strongly opposed to this Ordinance. ,PETERSON/ANDERSON MOVED TO CLOSE THE PUBLIC HEARING AT 9:05 P.M. Passed 5-0. Councilmember Peterson noted the intensity of this issue; he clarified misrepresentations made by a member of the public and restated his position on the status of Saratoga School. Questions consider,~ by the Councilmember were: Need for Bed and Breakfasts in Saratoga; he felt that there was not such a need and that he would not commercialize any part of Saratoga. Need for the City to provide a vehicle to save signi~can~y historical resources in Saratoga; based on public input, there was no such need. He noted the community's pemeption that an amendment to the R-1 zoning would be "spot zoning" and such would commercialize residential areas. He stated that he would move to deny this amendment. MEETING OF THE CITY COUNCIL Page 7 APRIL 15, 1987 PUBLIC HEARINGS Continued Councilmember Moyles stated that upon consideration, he would deny the recommendation of the Heritage Preservation Commission. He commended the Commission for seeking ways to preserve the character of the community. However, he knew of nothing more important in the · relationship between a municipality and its citizens than the Council's commitment to the preservation of neighborhoods for the service of homes and families. She reviewed her concerns: ,!; - Will the proposed Ordinance preserve Older buildings; she felt it would not. . ! - Would such an Ordinance enhance neighborhood quality; again, ~he felt it would not. She added that approval would ease the way for additional commercial use and noted the purity · of R-1 residential zoning. She stated that she would support this concept. Councilmember Anderson commended the Heritage Preservation's work; however, She noted her commitment to the General Plan and the right of homeowners in R-1 zoning areas to have their residential area preserved and protected. Mayor Hlava noted disappointment at the unwillingness of the community and the-Council to consider a compromise on this issue. She did not feel that heritage preservation issues had to be sacrificed; this was an example where a compromise would have been appropriate. She repu- '~ dialed the idea that this project had been promoted by developers and noted that historical aims of the City might have been served by the proposed amendment. Since no compromise was possible, she would vote against the amendment as presented. PETERSON/ANDERSON MOVED TO DENY ORDINANCE AZO 86 003. Passed 5-0. The Mayor recessed the Meeting from 9:17 - 9:35 P.M. B. Ordinance amending Sections 15-80.020 and 15-80.080 of the City Code pertaining to radio and television antennas. City Attorney Toppel presented the proposed Ordinance, cited considerations of the Planning Commission and reviewed the definition of "antenna" for the purposes of this Ordinance· Correspondence received from Mr. Kennedy and Mr. Stafford, Radio Relay League, noted· The philosophy of the Ordinance was that antenna could only be installed on lots which could accommodate them; thus, in the R-1 zoning, antennas could not be installed at the height claimed by the operators to be necessary and still be within what the City defined as public safety considerations i.e. if the antenna fell over, it would fail on the owners,property. The Public Hearing was opened at 9:45 P.M. Mr. Bill Robinson, District Emergency Coordinator, Amateur Radio Services, noted the role of radio operators in the Lexington fire. He asked that the Ordinance as written not be approved and noted the foliowing concerns: Amateur radio towers rarely fail down; he noted that the towers were engineered structures and would stand even in the face of high winds. Proposed setback requirements would prohibit amateurs from erecting effective antenna structures in 80% of households; he questioned an Ordinance written to apply to an exception; there was no technical, engineen;ng and safety reason to require setbacks. In response to Councilmember Moyles' question, he clarified setback requirements which addressed the rotation of an antenna; in his experience, setbacks were not required due to the possibility that if an antenna would fall, it would .fall on one's own property. Councilmember Anderson noted the visual impact of these towers; Mr. Robinson recommended specific towers due to least amount of visual impact on the adjacent neighborhood. Mr. John McCall, 13290 Pierce Rd.;.Saratoga, concurred and emphasized that properly built antennas would not be a safety hazard. He added that amateurs resolve any interference, whether they caused it or not. MEETING OF THE CITY COUNCIL Page 8 APRIL 15, 1987 PUBLIC HEARINGS Continued Mr. Frank Nernic,' Emergency Coordinator for Saratoga, noted that amateurs:were being asked to solve interference problems from other sources. He concurred that higher antennas would cause less interference and minimal visual impact. Mr. Gary Sigans, Dagmar Dr., Saratoga, recommended that the proposed Ordinance, Section .... ,: :E:i~;. be ,increased>to,'3,~ .~t;.qn,height and,~hat~-info~ma~i~a ~n .the failur~-of.~ocf mounted antennas or support structures be obtained from manufactures. The City AttOrney noted~that therc hadybeen no;Objection nor testimony regarding proposed setback requirements until this .Hearing; he suggested thaf further information be obtained. . . Councilmember Moyles questioned whether setbacks requirements could address aesthetic concerns; the City AttOrney concurred that FCCRegulations addressed aesthetic and safety concems. The Councilmember suggested that the Planning Commission be given guidelines on variances which would allow the creation of a viable emergency network without excessive visual impact on the community; the City Attorney questioned the manner of determining a level of adequate emergency communications. Councilmember Anderson requested additional information; Councilmember Clevenger concurred and added her concern regarding the visual impact of antennas;. she favored · variances to address the installation of antennas. The City Manager suggested a guideline, · allowing a fixed nnmber of antennas per square mile of the City. .'. Councilmember P&erson favored rctuming this Item to the Planning Commission for further consideration; he noted that differing views were being expressed.. The City Attorney stated that the Staff would be interested in reviewing the information presented. He emphasized, however, that there may be lots that remain inappropriate for the installation of an antenna. MOYLES/HLAVA MOVED TO CLOSE THE PUBLIC HEARING AT 10:45 P.M. Passed 5-0. The City Attorney suggested ihat the Planning Commission report back to the City Council by the second Meeting of the City Council in June. MOYLES/PETERS ON MOVED THAT THIS ITEM BE REFERRED BACK TO PLANNING COMMISSION FOR FURTHER REVIEW, ESPECIALLY ON SETBACK REQUIRE- MENTS, RECO1VIMENDATIONS TO BE FORWARDED TO THE CITY COUNCIL BY THE SECOND COUNCIL MEETING IN JUNE. B. Possible Agenda Items for Joint Meeting with Public Safety Commission The City Manager informed the Council of the upcoming dinner with the Public Safety Commission and the 8:00 P.M.
