HomeMy WebLinkAbout04-12-1988 City Council Minutes MINUTES SARATOGA CITY COUNCIL TIME: Tuesday, April 12, 1988 - 7:30 p.m. .- · - PLACE: Arts and Crafts Room, 19655 Allendale Avenue TYPE: Regular Adjourned Meeting Present: councilmembers Anderson, Clevenger, Hlava, Moyles, Mayor Peterson Absent: None Staff present: City Manager Peacock, Assistant Planner calkins Mayor Peterson called the meeting to order at 7:35 p.m~ 1, Appeal of denlai of request for use permit approval of plans to~ legalize an'existing 12.5 ft. high gazebo which encroaches 1.5 feet into the required .15 ft. setback at 19337 Lisa .Marie Ct.(Applicant/appellant, Bowman)(continued from 4/6 with hearing closed) It was moved by Hlava, seconded by Anderson that the appeal be granted finding that 1) the shape of the property, resulting in an irregular side yard lot llne because of the cul-de-sac in.the street resulted in a unique problem in siting the gazebo' outside of the setback and 2) the encroachment represented a deminimus intrusion because of the octagonal shape of the gazebo. 3) Because of the heavy screen by vegetation and the location of the gazebo. on the lot no impact on surrounding properties would result. However, the gazebo as proposed is to be modified so as not to exceed the allowed height limit for accessory structures or 12 ft. The City Attorney is directed to prepare a resolution overturning the decision of'the Planning Commission based upon the above findings and subject to the above conditions. Passed 5- 2. Discussion of T2000 with county Transportation Agency Staff The Council welcomed James Lightbody, the T2000 project director, and disouusud thu following points rulntivu to thu T2000 Phnuo III Summary Report -An Implementation Strategy for the Transportalton 2000 Plan." a. There must be an assured continuation of both current Federal and state funding before another local funding commitment of the magnitude of Measure A is attempted. b.. Paratransit funding should be included or should be guaranteed .through a re-prioritization of the existing 1/2 cent sales'tax override for. public transit in the MTC area. C. New funding should be specifically tied to specific infrastructurey there should be a specific time limit on the funding~ there should be specific defined responsibility as to who would administer the program and funding. d. A long term strategy should be developed for the extension of the federal gas tax extension which would tie funding to local matching efforts. e. The tie in between transportation and land use is viewed most suspiciously by Saratoga if it would promote density and commercial and industrial development into current areas of low density and predominant. residential development such as saratoga. f. consideration of a parking space tax.to help fund part of the T2000 projects should be given. g. TDM and a shuttle system in'large industrial and office areas p~e~-~bly should be -first efforts- wc=~ before plunging into freeways a~ X:l=ght tall expansion. h. Transit emphasis should focus on transit dependent popula~ien~, fc~ example, east San Jose. .I~ 3'. Discussion of Various Legislative Bills concerning Trans- .'. portation and Telecommunication Issues Vice Mayor Anderson reviewed with theCouncil a number of bills being · discussed by the League Transportation Committee for the purpose of establishing a League position on these various pieces of legislation.. Council concurred with Vice Mayor Anderson,s conclusions on the various ,bills, and she was authorized to take positions as she deemed appropriate. 4. Use Permit for Warner HuttonHouse By unanimous consent, this matter was added to the agenda, having arrived at city Hall on Monday, April 11, 1988, subsequent to the agenda. being posted. It was moved by Hlava, seconded by Mouyles that the City Manager be authorized to execute a letter agreement between the City and CalTrans allowing the City to take over interim use of the Warner Hutton House until it is relocated onto the Civic Cetner site in approximately six months. Passed 5-0. 5. Curbside Recycling Program By unanimous consent, this item was added to the agenda, the matter being brought tO-the attention of the City Manage= on Monday, April 11, .1988, subsequent to the agenda being posted. The City Manager reported that the City of Campbell and Town of Los Gatos are suggesting that a further testing of the market for recycling proposals be conducted prior to making a decision on the curbside recycling proposal received by the several cities from Green Valley DiSposal Co. Since a public hearing on the proposed program and options for funding had been planned for May 4, it was the City Manager's suggestion that: 1. Saratoga agree. to a further testing of the market, since the cities had been in the process of doing just that when the Green Valley Disposal proposal had been received. 2. That the planned public hearing be delayed until June or July to allow time for other possible proposals to be received. Theseactions were endorsed by the council by unanimous consent. 6. Closed session to discuss personnel matters .The Council adjourned to closed session to discuss recent complaints regarding public relations problems betweeen certain departments and the public. Upon. concludinag the closed session, the City Manager was directed to investigatge .the validity of the complaints and take corrective action with the identified departments and individual per~onnel~ The meeting was adjourned at 9:25 p.m. ReSpectfully submitted, Harr~ R.
