HomeMy WebLinkAbout03-28-1989 City Council Minutes MINUTES SARATOGA CITY COUNCIL TIME: Tuesday, March 28, 1989 - 7:30 p.m. PLACE: Community Center Senior Room, 19655 Allendale Ave. TYPE: Adjourned Regular Meeting The meeting was called to order at 7:38 p.m. by Mayor Anderson. Council Present: Clevenger, Moyles, Peterson, Mayor Anderson. Staff Present: City Attorney Toppel, City Manager Peacock, Maintenance Director Trinidad, Finance Director Shriver 1. Utility User Tax Sunset Clause Repeal The staff' made a presentation on the pavement management program and the need to continue the utility user tax by repeal of the sunset clause. After extensive discussion with members of the public who had been invited to discuss this issue with the City Council, the City Council directed the staff to: - Seek an Attorney General opinion on the status of property tax transfer funds under the trial court funding act where a local tax is automatically repealed by a pre-existing sunset provision. - Prepare a report on how much work has been done each year under the street maintenance budget and the pavement maintenance program, how much work is left to do before the program has run a complete cycle, and what the costs are per lane mile for each type of work. - Poll other cities in the area to determine what they are spending on street maintenance. - Determine what problems exist with the seal work done on Norada Ct. - Prepare a five-year projection on the entire City budget and the utility user tax. - Postpone the hearing scheduled for April 19 on this matter until the directed staff work has been completed. 2. Adoption of Water Conservation Ordinance (continued from March 15) The City Manager and City Attorney discussed the two versions of the draft ordinance submitted on March 24 and March 28 respectively. Council declared its intent to consider the March 24 draft which keeps violations as infractions and did not contain an appeal process. Mayor Anderson declared the public hearing open at 10:43 p.m. Bob Bostead, 12894 Pierce Rd., asked what rules applied to rental property when the tenant may have changed since 1987. Mayor Anderson explained the appeal process being established by the San Jose Water Company to deal with such cases. Mayor Anderson declared the hearing closed at 10:47 p.m. Vice Mayor Clevenger suggested amending the ordinance to change the outside watering hours from 9:00 p.m. to 7:00 a.m. to 8:00 p.m. to 8:00 a.m. Council agreed to the change. Councilman Moyles moved and Mayor Anderson seconded the motion to · adopt Ordinance 71.61 as amended. The motion carried 4-0. Councilman Peterson moved and Vice Mayor Clevenger seconded the motion to adopt the City Water Conservation plan as presented by staff to cut back water usage by 25%. The motion carried 4-0. Inassociation with the adoption of the ordinance, Council directed that: - City write letters to hotels and restaurants in the City concerning water conservation notices they should prepare for their patrons. - Staff issue a warning to all pool permit applicants concerning water allocation rules. - A letter be sent to the Public Utilities Commission objecting to the San Jose Water Company's past practices of providing free unmetered water to Company employees. - Letters be sent'to the Water District and Intergovernmental Council regarding the need for long range planning for an adequate water supply for Santa Clara County. 3. Policy Development Conference Notes The Council directed the phrase "as needed "be removed from Item 10 relating to Hakone Gardens funding.
