SARATOGA CITY COUNCIL
TIME: Tuesday, January 22, 1991 - 7:30 p.m.

TYPE: Adjourned Regular Meeting
1. Roll Call
The meeting was called to order at 7:35 p.m.
Councilmembers Anderson, Clevenger, Kohler, Monia and Mayor
Stutzman were present. Staff members Harry Peacock, Todd Argow,
.and Isabel Gloege were present.
2. Report of City Clerk on Posting of Agenda
The city Clerk reported that pursuant to Government Code 54954.2,
the agenda for this meeting was properly posted on January 18.
The notice of adjournment from the January 16 Council meeting was
properly posted on January 17.
3. Oral Communications from the Public
Bob Swanson, 19305 Crisp Avenue, requested that since the traffic
barriers for the San Marcos Heights subdivision have now been
installed, they need to be locked off by City staff and the keys
not given to the developers. .Staff was so directed.
Dom Richiuso read a letter from the neighborhood members of the Odd
Fellows Senior Housing Task Force expressing concern over the
reactions of some of the other members of the Task Force.
4. Resolution Appointing to the Planning commission: Start
Bogosian (4-year term), Matthew Durket (4-year term) and
Malcolm Forbes (Z-year term)
MONIA/KOHLER MOVED TO ADOPT RESOLUTION 91-06. Passed 5-0.
5. Administration of Oath of Office to above
The City Clerk administered the Oath of Office to Commissioners
Durket, Bogosian and Forbes. The City Council welcomed each to the
Planning Commission.
6. Freeway Walls and Berms in Quito Area
The City Manager introduced Will Kempton, Executive Director, Santa
Clara County Traffic Authority, to present plans for sound barriers
in the vicinity of the Quito Road area of Route 85.
The Traffic Authority was asked to respond to the potential impact
of earth berms as sound barriers on drainage and potential flooding
in the area near the proposed berms. The Traffic Authority was
asked to do a cross-sectional drawing of the freeway at Quito Road
to show the elevation of the railroad crossing the Quito Road
overpass at the freeway.
Returning to the items contained in the January 2, 1991, staff
report, the Council discussed financing an increase in soundwall
height in the area designated as Section 6. A petition from the
neighbors in this area was received asking for a-16-foot wall
rather than the Traffic Authority's proposed 12-foot wall.
MONIA/KOHLER MOVED TO APPROVE FINANCING OF THE 16-FOOT WALL AT AN
ESTIMATED ADDED COST OF ABOUT $80,000 FOR THIS 1400-FOOT SECTION.
One resident expressed concern over the amount of overlap between
this wall and the wall to the west; it seems to be inadequate.
This factor to be considered as design is finalized. Councilmember
Clevenger expressed some concern over the potential sound
reverberation to homes on the north side of the freeway from a wall
which will be 6 to 8 feet higher on the south side.
MOTION PASSED 5-0.
The City Council requested the Traffic Authority provide it with
the updated sound study sections which deal with walls and berms
in this area of the freeway, a copy of the hydrology study on
Wildcat and San Tomas Creeks, and information on the potential for
sound reverberation of the berms to the residents to the south from
the Sailroad traffic which goes through the area.
Staff was directed ask the City Attorney to research the authority
of the Traffic Authority, the State and the Federal government to
build facilities which exceed the general plan standards related
to noise. It was agreed to continue discussing these issues at an
adjourned regular meeting on March 12, 1991.
KOHLER/MONIA MOVED TO ACCEPT THE WALL HEIGHT ADJUSTMENTS AND FUND
SAME IN THE SECTION 12 AREA AS PRESENTED IN THE JANUARY 2, 1991,
STAFF REPORT AT AN ESTIMATED COST OF $30,000. Passed 5-0.
Discussion on the changes for Section 3, Congress springs Park,
were not finalized. Again Councilmember Clevenger expressed
concern over sound reverberation if the south side walls were
raised to 16 feet, making them 6 to 8 feet higher than the north
side walls.
7. Proposal for Televising Council Meetings on Cable Channel 6
The City Council'reviewed the letter from South Bay Cable regarding
the proposed equipment for live broadcasting.
MONIA/KOHLER MOVED TO ACCEPT THE PROPOSAL WHEN IT IS PRESENTED TO
THE FOUNDATION BOARD. Passed 5-0.
The City Council acknowledged the generosity of the offer made by
South Bay Cable through its General Manager, William Haggerty. Ben
Strong, Foundation Board member, expressed concern over being able
to produce the live broadcasts with volunteers and suggested the
City may need to fund personnel for that purpose.
8. County-Wide Household Hazardous Waste Collection Program
The City Council reviewed the recommended course of action proposed
by the Intergovernmental Council.
MONIA/KOHLER MOVED AND SECONDED THAT SARATOGA JOIN THE PROGR/~M AT
ITS JULY 1, 1991, START DATE AND DISCONTINUE THE LOCAL PROGRAM ON'
THE SAME DATE. Passed 5-0.
9. Report from Planning Director on Landtech Environmental Impact
Report
Council reviewed the staff memorandum of the insufficiency of the
Environmental Impact Report prepared for this project in the
unincorporated area west of the City. Staff was directed to put
the memorandum in final form and refer it and the EIR documents to
the City Attorney to be put in final legal form for presentation
to the County as future hearings are scheduled.
KOHLER/MONIA MOVED THAT THE ABOVE BE DONE. Passed 5-0.
10. Adjournment
The meeting was adjourned at 10:25 p.m.
