Arts and Crafts Rm., 19655 Allendale Ave. TYPE= Adjourned Regular Meeting 1. Roll call The meeting was called to order at 6:35 p.m. Councilmembers Anderson, Clevenger, Kohler and Stutzman were present; Councilmember Monia was absent. 2. Report of City Clerk on Posting of Agenda Pursuant to Government Code 54954.2, the agenda for this meeting was properly posted on February 8. The notice of adjournment from the February 6 Council meeting was properly posted on February 7. Oral Communications Larry Fine requested that if the Planning Commission hearing on designating Saratoga Avenue south of Fruitvale as a Heritage Lane was rescheduled from February 27 that the staff mail notification to the approximately 1200 people he had notified. Council agreed the City would do so if the staff work cannot be completed in time for the February 2V Commission meeting. Councilmember Monia arrived at 7:20 p.m. 3. Interviews with Applicants for Library commission 4. Red Cross Memorandum of Understanding Rex Painter, Director, Emergency Services, Santa Clara Valley Chapter, American Red Cross, discussed how the memorandum of understanding between his agency and the City, approved by the City Council on November 7, 1990, is put into effect during times of a declared emergency or disaster. The Council thanked Mr. Painter for coming to the meeting and putting a face and a program behind this most important disaster preparedness document. 5. Joint Meeting with Planning Commission Commissioners present: Bogosian, Caldwell, Durkett, Forbes, Moran, Tucker a. Air Quality Plan Presentation by Air Quality Management District Thomas Perardi, Director of Planing for the Bay Area Air Quality Management District, discussed the role of the District in implementing the 1988 California Clean Air Act and the 1990 Federal Clean Air Act. He explained that the Bay Area still does not meet the Act's standards for ozone and carbon monoxide, and by 1997 measures must be enacted and implemented which will bring the Bay Area into attainment status. A three-phased approach will be used, and a draft plan is scheduled to be released for comment in March~' Local agencies will have a role to play in meeting the program requirements of the plan. Chief among them will be efforts to improve operation of existing roads and strategies to reduce vehicle miles traveled so that the average occupancy per vehicle during commute hours goes from the current 1.3 person to a 1.5 person level. The Council and Commission thanked Mr. Perardi for an excellent overview of the air pollution problem and the role Saratoga will be asked to play to improve the air we breathe. b. Discussion of City~s Practice of Granting Variances The City Council and Planning Commission held a general discussion on the findings necessary to grant variances. It was stressed that grounds for a variance are based on considerations limited to the physical conditions of the property which are unique in that other property in the area does not have the same conditions, which must cause a hardship and which, if granted, would not adversely affect the City council Agenda 2 Febrl/ary12, 1991 interests of the public or of other residents within the vicinity. At 9:50 the Mayor declared a 10-minute recess. The City council reconvened at 10:00 p.m. with all members present. 6. ~Reorganization of City Manager's Office The City Manager presented several resolutions which redefined the duties of the Assistant to the City Manager and amended the compensation for that position, deleted the position of Public Services Director, and added the position of Administrative Assistant to the non-management personnel of the City, defined the duties of the position and set the compensation level for the position. a. Resolution 2663.2amendlng resolution authorizing permanent positions in City Service for 1990-91 MONIA/ANDERSON MOVED TO ADOPT RESOLUTION 2663.2. Passed 5-0. b. Resolution 85-9.85 amending resolution setting Management Salary Ranges for 1990-91 MONIA/KOHLER MOVED TO ADOPT RESOLUTION 85-9.85. Passed 5-0. c. Resolution SS-9.s6 amending resolution adding to basic salary classes and employment position classifications for the amployees of the City of Saratoga KOHLER/ANDERSON MOVED TO ADOPT RESOLUTION 85-9.86. Passed 5-0. In response to a question the City Manager indicated the overall cost of personnel compensation would be reduced by this reorganization. 7. Approval of Cost Overrun Request - Hakone Cultural Building in the Amount of $5,619.46 After the City Council reviewed the letter from Don Miller, President of the Hakone Foundation, dated February 2~ 1991, it was agreed to take no action but that Mr. Miller be asked to adjust the line item costs to bring them into line with his letter. This change to be presented with the next draw request. If this is not done, the City Manager is to bring this matter back to the City Council. The Council also requests the Hakone Foundation present a six-month review detailing its expenditures, interest payments and fund raising results covering the period ending April 30, 1991, to the City Council in May. Vice Mayor Kohler asked that his continued opposition to approving any cost overruns be reflected in the minutes. 8. Items continued from February 6 meeting: a. Memo from Association of Bay Area Governments concerning Regional Governance: Bay Vision 2020 Proposal and AB 3 (brown) The City Council generally expressed grave concerns over many of the policies proposed in the draft document. The ~City Manager was instructed to draft a letter response which would agree in general terms that regional problems exist and must be addressed but that the proposals generally run counter to the philosophy of this City's government. The draft letter to be reviewed by the City Council on February 20. b. Congestion Management Agency Joint Powers Agreement The members of the City Council had no comment on the draft document. They asked, however, that the Agency be put on notice that the City Council objects to the Agency Board meetings being held on regular City Council meeting nights, making attendance by Saratoga City Councilmembers impossible and suggesting that meetings be moved to Thursdays, when no City Council regularly meets. c. Process for Naming Streets City Council Agenda 3 February12, 1991 KOHLER/CLEVENGER MOVED TO ACCEPT STAFF PROPOSAL FOR FUTURE NAMING OF STREETS AS PROPOSED IN THE FEBRUARY 6, 1991, STAFF REPORT FROM ASSOCIATE PLANNER TSVIA ADAR. Passed 5-0. Council asked that an inventory of streets named but not yet populated be prepared by staff for the Heritage Commission to consider renaming and that review occur as soon as possible and recommendations forwarded to the City Council. d. Required Retirement System Coverage for Part-time Temporary Employees CLEVENGER/ANDERSON MOVED TO ENROLL TEMPORARY PART-TIME EMPLOYEES IN THE SOCIAL SECURITY SYSTEM EFFECTIVE JULY 1, 1991, IN COMPLIANCE WITH THE OMNIBUS BUDGET RECONCILIATION ACT OF 1990. Passed 5-0. 9. Discussion of Possible Effects of Electromagnetic Fields on nearby residents from high tension electric transmission lines The City Council requests that electro-magnetic field readings be taken by Pacific Gas and Electric along the length of the high tension line corridor through Saratoga and that the results be filed with the City. The City Manager is to talk to Bob Storm of P.G. &E. concerning this request. 10. Selection of Library Commissioners STUTZMAN/ANDERSON MOVED TO DIRECT A RESOLUTION BE PREPARED APPOINTING KREZEK, PEACOCK AND TOWSE TO THE LIBRARY COMMISSION. Passed 4-0 (Monia abstaining because he had arrived after the interviews took place). 11. Adjournment At 11:20 p.m. the meeting was adjourned to Saturday, February 16, at 9:30 a.m. at Cox Avenue/Route 85 Overcrossing to review the project construction.
