HomeMy WebLinkAbout08-10-1993 City Council Minutes MINUTES SARATOGA CITY COUNCIL TIME: Tuesday, August 10, 1993 - 7:30 p.m. PLACE: City Hall Administration Meeting Room, 13777 Fruitvale Ave. TYPE: Adjourned Regular Meeting 1. Roll Call Councilmembers Burger, Kohler, Monia and Mayor Tdcker were present; Councilmember Anderson was absent. Staff members present were City Manager Peacock and Public Works Director Perlin. 2. Report of City Clerk on Posting of Agenda Pursuant to Government Code 54~54.2, the agenda for this meeting was properly posted on August 6. The notice of adjournment from the August 4 Council meeting was properly posted on August 5. 3. Report on commission Recruitment After discussion, there was consensus to interview Planning Commission applicants on September 1, with two at 7:00 and two at 7:15 p.m. Library and Public Safety Commission applicants will be interviewed on September 7, with two at 7:00, two at 7:15, and three at 7:30 p.m. 4. Solid Waste Management Agreements A. Addendum No. 2 to Agreement to Provide Solid Waste Management to the West Valley Cities BURGER/MONIA MOVED TO APPROVE ADDENDUM #2. Passed 4-0. B. Agreement to Provide Solid Waste Management to the West Valley Jurisdictions MONIA/BURGERMOVED TO APPROVE AGREEMENT. Passed 4-0. 5. City'Positions on Proposed Resolutions for League of California Cities Conference at the Division Level: Economic Development; Employment Training; Wastewater Treatment Plants After discussion, there was consensus to support all three resolutions at the Peninsula Division meeting of August 26. 6. Resolution accepting Petition (Leonard Road Assessment District) Public Works Director Perlin reviewed the assessment district process. Under the 1931 Act proceedings, Council cannot override majority protest. To remove this requirement, a petition signed by property owners of 60% of the area in the district must be submitted before proceedings commence. Right now the city does not have a 60%petition. Currently 54% of the area is on petitions. Public discussion ensued as to whether to go forward with the design in the absence of the resolution. Public Works Director Perlin indicated that engineering costs to get to construction would be between $9,000 and $12,000, most probably $10,000. Options for Council: 1 - Abandon process. 2 - Continue for a few more days to see if anyone else signs up. 3 - Proceed under the 1931 Act. The Perrys suggested that if the City caps the engineering costs at $12,000, they would change from opposing to supporting the petition. If the Perrys change their position, then the petition would be 61.5%. MONIA/BURGER MOVED TO CAP THE COST OF ENGINEERING OUT OF POCKET COSTS OF $12,000, WHICH IS TO COVER COSTS UP TO AND THROUGH THE FORMATION OF City council Minutes 2 August 10, 1993 THE ASSESSMENT DISTRICT~ SHOULD THE DISTRICT BE FORMED AND ACTUAL ENGINEERING COSTS EXCEED $12,000, CITY AGREES TO MARE IN KIND CONTRIBUTION IN ADMINISTRATIVE COSTS AS A CITY CONTRIBUTION TO OFFSET COSTS ABOVE $12,000, PROVIDED A PETITION IN EXCESS OF 60% IS RECEIVED. Passed 4-0. MONIA/BURGER MOVED .TO ADOPT THE RESOLUTION ACCEPTING THE PETITIONS. Passed 4-0. MONIA/BURGER MOVED TO PROCEED WITH PREPARATION OF QUIT CLAIM'DEEDS IMMEDIATELY FOR DEDICATION OF NECESSARY RIGHT-OF-WAY. Passed 4-0. 7.
