SARATOGA CITY COUNCIL

1. Roll Call
Councilmembers Anderson, Burger, Kohler, Monia and Mayor Tucker were
present. Staff members present were Acting City Manager Perlin,'City
Attorney Riback, Community Development Director C~.rtis, Codes
Administrator Oncay, and Community Services.Officers Spoulos and Iida.
2. Report of City Clerk on Posting of Agenda
Pursuant to Government Code 54954.2, the agenda for thi~ meeting was
properly posted on February 4. The notice of adjourn]lent from the
February 2 Council meeting was properly posted on Febr]ary 3.
3. Noise Enforcement Workshop
Mr. Curtis explained why this item had been placed on th.~ agenda. He
reviewed City Code Section 7-30.040 concerning ambient noise standards
for new developments and uses. He then reviewed City Co.~e Section 7-
30.050 concerning ambient noise levels as related to existing
developments.
He stated that the City has no ambient noise level readincB for various
locations through the City, making enforcement of he ordinance
difficult.
City Attorney Riback explained the court order c( lcerning the
neighborhood lawsuit against Villa Montalvo, which relates to noise.
The Court established an allowable noise level of 56 (SA ~for villa
Montalvo, which differs from that the City Code would al.ow.
Mr. Curtis explained how ambient noise levels can change over time as
land use patterns change. Mr. Curtis then explained how single event
permits are administered. He.determines whether an event is a private
function or a community function. The surrounding ne~ hborhood is
notified although there is no requirement to do so.
Community Services Officer Spoulosdemonstrated how the n)ise meter is
used to record ambient noise. levels. She explained how~the meter is
calibrated.
city Attorney Riback suggested that the current ordinance could be
improved.
After discussion, there was no Council consensus to cevelop noise
contour maps for the City or to take any further actions
4. Presentation by Dr. F. L. Stutzman concerning E1 ctromagnetic
Fields
Dr. Stutzman, a resident of Saratoga, distributed written materials.
Councilmember Burger introduced Dr. Peter Polson, a reco.~nized expert
on electromagnetic field issues, who was the environmental consultant
on the proposed GTE Mobilnet/Cellular One cellular hone antenna
project at 14471 Big Basin Way.
Dr. Stutzman discussed his research of this issue and :plained that
there is no conclusive scientific evidence which proves t]at radiation
from cellular transmission facilities is safe. He cited ~tudies which
show that such radiation is not safe.
Mr. Don Whetstone, a resident of Saratoga, presented the esults of his
evaluation of the approved cellular site in Saratoga Iillage. He
compared his results with those developed by G. T. E.
Dr. Polson responded to the presentations made by Dr. Stuszman and Mr.

whetstone. Afterwards, a lengthy technical discussion t,ok place.
Mayor Tucker then asked whether anyCouncilmembers felt t leir votes on
the G.T.E. application were influenced by false informatic provided at
the public hearing.
Councilmember Monia moved for a revocation hearing on the approved
application. The motion died for lack of a second.
5; Route 85 Celebrations
There was consensus among the Council to support loca2ly sponsored
celebratory and fundraising events rather than a Dorridor-wide'
celebration sponsored by the Traffic Authority. Mayor Tucker will
convey this to the Traffic Authority at an upcoming meetLng.
6. Council Items (added to agenda)
Councilmember Anderson raised the issue of the Sheriif substation
relocation. The Council expressed interest in seeing tile substation
remain in Saratoga and will follow this issue closely.
Councilmember Anderson then provided modified figures for Council
expenditures presented by the Finance Director at th.~ February 2
Council meeting. She requested that the City Manager's $190 expense
for the League of California Cities Conference be removed from Council
activity budget and reposted where it belongs.
