HomeMy WebLinkAbout04-12-1994 City Council Minutes MINUTES SARATOGA CITY COUNCIL TIME: Tuesday, April 12, 1994 ~ 7:00 p.m. PLACE: City Hall Administration Meeting Room, 13777 FruLtvale Ave. TYPE: Adjourned Regular Meeting/Joint Meeting with Hak.)ne Foundation CLOSED SESSION for the purpose of conferring with real property negotiator concerning the Purchase of Real Property - 7:00-7:30 p.m. The City Clerk noted that Councilmembers Burger, Kohler, [onia and Mayor Tucker were present for the closed session at 7:00 p.m. Property: Nelson Gardens, located at 20851 Saratoga Hills R. ad in Saratoga Negotiating parties: City of Saratoga, Valley Foundation of Santa Clara County Under negotiation: Instruction to negotiator will concern price and terms of payment The closed session ended at 7:30 p.m. The City Clerk re)orted that no action had been taken. REGULAR MEETING 1. Roll Call Councilmembers Burger, Kohler, Monia and Mayor Tucker were ~resent at 7:30 p.m.; Councilmember Anderson was absent. Staff members present were City Manager Peacock and City A torney Riback. 2. Report of City Clerk on Posting of Agenda Pursuant to Government Code 54954.2, the agenda for thks meeting was properly posted on April 8. The notice of adjournme]~t from the April 6 Council meeting was properly posted on April 7. 3. Items concerning Hakone Foundation A. Management and Operations Agreement After discussion, there was consensus to tentatively approv the agreement with some amendments. B. Lease Agreement After discussion, there was consensus to tentatively ape ove the lease agreement with amendments in Sections 1 and 3. C. Trust Agreement After discussion, there was consensus to direct staff to re,raft the trust agreement as ~n amendment of the entire document. Otherwise, it is to be left unchanged. D. Bylaws The Council accepted the draft dated April 12, 1994. E. Business Plan and BUdget 1994-95 The Council accepted the Business Plan. Parking income b~sed upon major improvements in revenue so far this year, i.e. $3700 in 19)3 and $5900 in 1994 for March alone. Items A, B, and C are to be voted on by the City Council on April 20, 1994. Mayor Tucker recessed the meeting from 8:55 p.m. to 9:00 p.m. 4. Committee report on School Safety and Traffic Problems - Anderson and Monia City Council Minutes 2 Ap:il 12, 1994 Councilmember Monia reported on the meeting. .The purpose w]s to cooperate with the school district on traffic control problems. ~he schools are looking into a State grant of $50,000 for serious programs. some of which could be used as creek cleanup. They are also looking ix.to Air Quality Management District grant money for facilities, carpooling, etc. if we can come up with an overall plan. Mayor Tucker reported that West Valley College trip reducthon coordinator was willing to work with Redwood School. She als0 reporte that there is' a model for a school district (perhaps Costa Mesa) using car~ooling and she can get the name of the person to school district personne Staff was directed to place this item on the agenda for Apr.1 20 to try to put together a working group to proceed as outlined above. Also need to keep private schools informed as to what is g~ing on. 5. West Valley/Mission Joint Community college District items: a. Selection of date for joint meeting with BoLrd of Trustees There was consensus to meet on May 12. b. Selection of two Council representatives to ~eet with Board representatives to prepare agenda for joint meeting There was consensus to select Burger and Monia as Council r )resentatives. 6. Amicus Brief for Measure A Lawsuit before State S~preme Court - Request from City of San Jose The City Attorney asked to place this item on the agenda, since the request was received on April 11, 1994, after the agenda for this meeting had been posted. BURGER/KOHLER MOVED TO PLACE THE ITEM ON THE AGENDA. Passad 4-0. The City Attorney reported that we must notify the City of San Jose by April 15, 1994, if Saratoga agrees to join. MONIA/BURGER MOVED TO APPROVE FILING BASED ON FACT THAT :ARATOGA VOTERS APPROVED THE MEASURE. Passed 4-0. 7. Adjournment The meeting was adjourned at 9:45 p.m. Respectfully submitted, Harry R.
