SARATOGA CITY COUNCIL
TIME: Tuesday, August 9, 1994 - 6:30 p.m.
PLACE: City Hall Administration Meeting Room, 13777 Fruitvale Ave.
TYPE: Adjourned Regular Meeting
1. Roll Call
The meeting was called to order at 6:34 p.m. Councilmembers Jacobs,
Moran, Tucker, Wolfe, and Mayor Burger were present.
Staff members present: City Manager Peacock, City Attorney Riback,
Public Works Director Perlin.
[inance Advisory Committee Members present: Low, Ousley.
The Mayor announced that the Council was going into a closed session
pursuant to Government Code Section 54956.9(a) to confer with the City
Attorney on pending litigation which has been initiated formally and
to which the City is a party. The title of the litigation is San
Francisco Bay Keepers, etal. v. City of Saratoga, etal.
The Council reconvened in open session at 7:15 p.m., the City Council
having taken no final action on the closed session matter.
2. Report of city clerk on Posting of Agenda
Pursuant to Government Code 54954.2, the agenda for this meeting was
properly posted on August 5. The notice of adjournment from the August
3 Council meeting was properly posted on August 4.
3. Interviews with consultants for Salary Comparison Survey
a. Doug Johnson, Ralph Andersen & Assoc.
b. Alan Burdick and Michael Mount~ David M. Griffith & Assoc.,
Ltd.
C. James Carey, Carey Assco., Inc.
The Council is to manage the contract with subcommittee of Council
consisting of Jacobs and Tucker assisted by Finance Advisory Committee
members who worked on the study. City Manager not to manage contract.
The Council interviewed Doug Johnson of Ralph Andersen Associates.
The Council interviewed Alan Burdick and Michael Mount of David M.
Griffith and Assoc,, Ltd.
The Council recessed at 9:15 p.m. and reconvened at 9:25 p.m. They
then interviewed James Carey of Carey Assoc., Inc.
The Mayor then proceeded to Item 7 on the agenda.
7. Request from Robert L. Webb, 19640 Redberr~ Dr., for waiver of
requirement for future annexation as pre-condltion to annexation
to West Valley Sanitation District
The Council discussed this request with Mr. Webb and his neighbors.
WOLFE/TUCKER MOVED TO DENY THE REQUEST. Passed 4-1 (Jacobs opposed).
The Mayor then proceeded to Item 6 on the agenda.
6. Award of Construction Contract for 1994 Pavement Management
Program
The low bidder was E1 Camino Paving, with a bid of $1,020,374.07.
JACOBS/TUCKER MOVED TO DECEEL CAMINO PAVING THE LOW BIDDER. Passed
5-0.

AMOUNT OF $1,020,374.07. Passed 5-0.
JACOBS/TUCKER MOVED TO AUTHORIZE CHANGE ORDERS UP TO $50,000. Passed
5-0.
The Mayer then returned to Item 5 on the agenda.
5. Award of construction Contract 'for 1994 Street Maintenance
Program
MORAN/TUCKER MOVED TO DECLARE VALLEY SLURRY THE LOW BIDDER.
MORAN/TUCKeR MOVED TO AWARD THE CONTRACT TO VALLEY SLURRY IN THE AMOUNT
OF $204,324.07. Passed 5-0.
MORAN/TUCKER MOVED TO AUTHORIZE CHANGE ORDERS UP TO $15,000. Passed
5-0.
The Mayor then returned to Item 4 on the agenda.
4. Award of Construction Contract for Annual Minor Concrete Repairs
of Streets throughout City
WOLFE/TUCKER MOVED TO DECLARE VALLEY CONCRETE THE LOW BIDDER. Passed
5-0.
WOLFE/TUCKER MOVED TO AWARD THE CONTRACT TO VALLEY CONCRETE IN THE
AMOUNT OF $10,540. Passed 5-0.
WOLFE/TUCKER MOVED TO AUTHORIZE CHANGE ORDERS UP TO $4,460. Passed 5-
0.
The Mayor then returned to Item 3 to discuss whether to interview
.Personnel Concepts, Inc. There was consensus to set an interview for
7:00 p.m. on August 23, 1994.
8. council Items - City Council ~,Housekeeping,, Discussion
The Council discussed making sure thai: Council correspondence generated
outside of City Hall gets into City files for record purposes. They
discussed how to deal with legislative correspondence with the State
legislature and the Congress. The Mayor and City Manager are to do.
Corrections/Additions to Minutes The Council to consider changing
order of agenda; place on September 7, 1994, agenda.

9. Adjournment
The meeting was adjourned at 11:20 p.m. to Tuesday, August 23, 1994,
at 7:00 p.m. in the Administration Conference Room.
