HomeMy WebLinkAbout08-23-1994 City Council Minutes MINUTE8 SARATOGA CITY COUNCIL TIME:Tuesday, August 23, 1994 - 7:00 p.m. PLACE: City Hall Administration Meeting Room, 13777 Fruitvale Ave. TYPE: Adjourned Regular Meeting 1. Roll Call Councilmembers Jacobs, Tucker, Wolfe and Mayor Burger were present at 7:05 p.m.; Councilmember Moran was absent. Staff members present: City Manager Peacock, City Attorney Riback, Public Works Director Perlin. 2. Report of City Clerk on Posting of Agenda Pursuant to Government Code 54954.2, the agenda for this meeting was properly'posted on August 19. The notice of adjournment from the August 9 Council meeting was properly posted on August 10. 3. Interview Tony Gerczak, Personnel Concepts, Inc. - Consultant for Salary Comparison Survey The City Manager announced that Mr. Gerczak had cancelled his appointment and was no longer interested in performing the survey. 4. Request for Closed Session: Claim of City against County for Accrued Interest on Assessments and Property Taxes TUCKER/WOLFE MOVED TO PLACE THIS ITEM ON THE AGENDA. Passed 4-0. The Council next took up Item 5. 5. Final Map Approval, SD 90-010, Tr. 8639 (5 lots at 12585 Saratoga-Sunnyvale Rd.)(Developer, Vidanage) TUCKER/WOLFE MOVED TO ADOPT RESOLUTION SD90-010 APPROVING THE FINAL MAP. Passed 4-0. TUCKER/WOLFE MOVED TO AUTHORIZE THE SUBDIVISION AGREEMENT. Passed 4- 0. TUCKER/WOLFE MOVED TO APPROVE THE AGREEMENT WAIVING THE RIGHT TO PROTEST ANNEXATION TO LANDSCAPING AND LIGHTING DISTRICT LLA-1. Passed 4-0. The Mayor then proceeded to Item 8. 8. Appointment of New Trustees to Hakone Foundation Board TUCKER/WOLFE MOVED TO APPROVE .NOMINEES TO SERVE A FOUR YEAR TERM. Passed 4-0. 7. Request from Mayor for council Approval to pay her Registration Fee for National League of Cities Conference in December in Minneapolis TUCKER/WOLFE MOVED TO APPROVE REQUEST IN THE AMOUNT OF $335.00 FOR THE MAYOR. Passed 4-0. The meeting was adjourned to closed session at 7:20 p.m. 4. Consultant Selection Carey selected. Council agreed there is a need for Council to meet before study starts to decide how to use the information developed. TUCKER/JACOBS MOVED TO SELECT CAREY. Passed 4-0. Councilmember Jacobs asked whether the Council can meet with consultant in closed session. City Attorney Riback responded yes, since the City is in negotiations with employees, and the study relates to said City Council Minutes 2 August 23, 1994 negotiations. 6. Negotiations on the Nelson Gardens Property - Authority for City Manager to make Proposal Regarding a Development Agreement Councilmember Jacobs asked the City Attorney why this matter is no longer a subject of closed session. Mr. Riback said because the City is no longer considering the purchase, exchange, sale or lease of the property (i.e. Nelson Gardens). The Council agreed it did not intend to shut off possible action to acquire rather than to pursue another option and determine if such option is more attractive to the City than partial acquisition. This allows the City Manager to negotiate a proposal and consider that option in closed session instead of acquisition. Don Macrae, 20679 Reid Lane, reminded the City of a prior proposal to allow five or six lots and keep the rest for a park. That this was again discussed earlier this year. Now a totally different proposal is being considered. The public should be allowed to discuss this with the City Council before it moves forward. Ann Waltonsmith, 21060 Saratoga Hills Road, said she was discouraged and unhappy about the lack of notice!. She was also upset about the 180 degree turn of Council intentions for the property. Louise Gager, 20972 Saratoga Hills Road, also stated she did not get notice. She said it makes her sick to think that ten lots will be created. She wants to be notified of further meetings. Bud Alexander, 20760 Trinity Avenue, said he wants to be notified. Carolyn Alexander, 20760 Trinity Avenue, was bothered by the suggested actions of the City, taking money for an early out of the Williamson Act. The Council confirmed its instructions to the City Manager to receive a proposal from the Community Foundation for dedication of a portion of the property or other remuneration from the Foundation 'for other considerations to be presented to the City Council. Councilmember Tucker reported on Freeway Opening Celebrations for October 15 and 19. 9. Adjournment The meeting was adjourned at 8;25 p.m. to 7:00 p.m. on August 30 in the Administration Meeting Room, 13777 Fruitvale Avenue. Respectfully submitted, Harry R. City. Clerk
