ROLL CALL - Councilmembers Waltonsmith, Baker, Streit, Vice Mayor Mehaffey, Mayor Bogosian. Staff present: City Manager Perlin, City Clerk Ramos, Director of Community Development Walgren, Director of Administrative Services Walker, Acting Director of Public Works Cherbone, Director of Recreation Pisani, Administrative Analysts Bloomquist and Kom. REPORT OF CITY CLERK ON POSTING OF AGENDA - City Clerk Ramos reported that pursuant to Government Code 54954.2, the agenda for this meeting was properly posted on December 3, 1999. The Notice of Adjournment from the December 1 meeting was posted on December 2, 1999. · ORAL COMMUNICATIONS FROM THE PUBLIC ON NON-AGENDIZED - None · MEETING WITH ASSEMBLYMAN JIM CUNNEEN TO DISCUSS THE FOLLOWING: A. Overview of the recent legislative session A. B. Preview of the upcoming legislative session o State-local government long term fiscal relationship o ERAF return o Stabilization of local revenue sources o Speaker's Commission on state-local government finances o State Controller's SMART report B. C. TEA restoration for Santa Clara County qualifying cities D. Compulsory and binding arbitration for public safety employees E. Internet Tax issues F. Highway 85 noise abatement Assemblyman Cunneen gave an overview of the legislative session.. Highlights of his presentation included: · Intensive Reading Program (educational bill passed) · Infrastructure in California (less than one percent is allocated in the State General Fund for infrastructure programs · Water and Park Bonds in the March ballot (the City could benefit from this bonds) · HMO reforms passed (including flex time and overtime provisions, Worker's Compensation premiums) · Free air and water bill for gas stations (targeting the small business owners) · Death penalty bill · Property tax revenue allocations to cities; tax equity allocations · Expansion of the Health and Welfare and Dept. of Corrections programs Discussion ensued regarding sales and property tax (TEA) revenues. Assemblyman Cunneen asked and City Manager Perlin replied that changing the property tax allocations would require an amendment to the Tax and Revenue Code. Assemblyman Cunneen said he would be happy to support Saratoga's position and recommended the City contact Senator Sher to get his support to introduce a legislative bill. He added it would be Page I of 5 Minutes for City Council December 7, 1999 Adjourned Regular Meeting/ helpful if the City could obtain support from other cities and .agencies and present that to Senator Sher. Discussion ensued regarding compulsory and binding arbitration for public safety employees. Assemblyman Cunneen explained that he supports this issue because he believes that pUblic safety is a core function of government and deserves to have binding ~:bitration. Discussion ensued regarding Highway 85 noise abatement. Councilmember Streit said the funds are available but Caltrans is rejecting the program. Assemblyman Cunneen said he would work on getting a joint letter of support from him and Senator Sher to Caltrans to approve the project. Discussion erisued regarding housing. In response to Assemblyman Cunneen, Director of Community Development Walgren reported on the City's affordable housing status and staff's efforts to update the Housing Element of the General Plan to comply with the federal housing mandates. TONIGHT IN THE ADULT CARE CENTER AT 19655 ALLENDALE AVENUE - Mayor Bogosian adjourned the meeting with Assemblyman Cunneen at 10:20 a.m. to 7:00 p.m. this evening in the Adult Care Center at 19655 Allendale Avenue. CALL TO ORDER - Mayor Bogosian called the meeting to order at 7:04 p.m. in the Adult Care Center at 19655 Allendale Avenue. ROLL CALL - Councilmembers Waltonsmith, Baker, Streit, Vice Mayor Mehaffey, Mayor Bogosian. Staff present: City Manager Perlin, City Attorney Taylor, City Clerk Ramos, Director of Administrative Services Walker, Director of Community Development Walgren. · ORAL COMMUNICATIONS FROM THE PUBLIC ON NON-AGENDIZED ITEMS John Tauchi, Sister City Boardmember, expressed thanks to the Vice Mayor Mehaffey and the rest of the Council for their support and participation during theSister City festivities. · REVIEW OF ARGUMENTS IN SUPPORT OF OR IN OPPOSITION TO LIBRARY (GENERAL OBLIGATION) BOND MEASURE TO BE HELD AT A SPECIAL ELECTION ON MARCH 7, 2000 Recommendation: Select, review and approve arguments as necessary, and direct City Clerk to submit to the County Registrar of Voters office. City Manager Perlin presented the staff report and announced that Bill McDonnell fi'om Friends of the Library is available for any questions. Discussion ensued regarding parking for the new library. Council concurred to include parking language in the argmnent. Bill McDonnell responded he would submit a revised argument, as noted this evening, to the City Clerk. In response to City Attorney Taylor, there was consensus of the Council to extend the deadline of receipt of arguments in favor of or againgt to the City Clerk to Thursday, December 9, 1999 at 5:00 p .m. BAKER/STREIT MOVED TO APPROVE THE AGREEMENT, AS AMENDED TO INCLUDE PARKING LANGUAGE. MOTION PASSED 5.-0. Director of Administrative Services Walker presented and reported on the Tax Rate Statement for submittal to the County Register of Voters office. THERE WAS CONSENSUS OF THE COUNCIL TO APPROVE THE TAX RATE STATEMENT AS PRESENTED. Page 2 of 5 Minutes for City Council December 7, 1999 Adjourned Regular Meeting/ · PRESENTATION BY LOCAL ARTIST HEATHER DONALDSON ON PROPOSED WATER SCULPTURE FOR CIVIC CENTER COURTYARD Recommendation: Receive presentation and direct staff appropriately. City Manager Perlin presented the staff report and deferred additional comments to Ms. Donaldson, water sculpture artist, who provided a brief description and process of the proposed sculpture. Mayor Bogosian expressed his concerns about the waste in using water for this purpose. Councilmember Waltonsmith expressed her concerns about the "shelf life" of the proposed sculpture. Discussion ensued. MEHAFFEY/STREIT MOVED TO ACCEPT THE OFFER FROM THE SARATOGA ROTARY CLUB TO FUND THE CONSTRUCTION OF A WATER SCULPTURE BY HEATHER DONALDSON AS PRESENTED USING NON POTABLE WATER TO BE ERECTED IN THE COURTYARD AT CITY HALL. MOTION PASSED 5-0. 4. AWARD OF CONSTRUCTION CONTRACT FOR CIVIC THEATER HVAC UPGRADES Recommendation: To be presented at the meeting. City Manager Perlin presented the staff report. MEHAFFEY/WALTONSMITH MOVED TO DECLARE REDWOOD GENERAL AND MECHANICAL OF REDWOOD CITY TO BE THE LOWEST RESPONSIBLE BIDDER ON THE PROJECT; TO AWARD A CONSTRUCTION CONTRACT TO REDWOOD GENERAL AND MECHANICAL IN THE AMOUNT OF $128,952 AND TO AUTHORIZE STAFF TO EXECUTE CHANGE ORDERS TO THE CONTRACT LIP TO $13,000. MOTION PASSED 5- 0. 5. DISCUSSION ABOUT THE EXTENSION OF MEASURE G TO ENCOMPASS COMMERCIAL ZONING DISTRICTS. Recommendation: Direct staff appropriately. Mayor Bogosian commented he requested that this item be placed on the agenda this evening to discuss placing a measure before the voters next November requiring a citywide election to approve change in zoning designation from commercial to residential. Discussion ensued. Vice Mayor Mehaffey supported the concept and commented that Measure G has shifted pressure to develop high density residential on properties zoned for commercial or offices. Councilmember Baker commented he would support it so long as there is sufficient time to prepare the information and educate the citizens about the intent and purpose of the proposed measure. Discussion ensued. THERE WAS CONSENSUS OF THE COUNCIL TO DIRECT THE CITY ATTORNEY TO DRAFT AN OUTLINE OF THE PROPOSED MEASURE AND A TIMELINE FOR SUBMITTALS AND PUBLIC HEARINGS AND REPORT BACK TO THE COUNCIL AT A SUBSEQUENT MEETING. City Manager Perlin said the meeting of January 25, 2000 would be a good meeting to agendize this matter because it is a joint meeting with the Planning Commission and it would provide a good opportunity for discussion between the Council and the Planning Commission. REVIEW OF COUNCIL MASTER MEETING CALENDAR FOR 2000 Recommendation: Finalize calendar and direct staff to come back on December 15, 1999 with the final version fc~r Council approval. City Manager Perlin presented a staff report and recommended approving the calendar this evening unless Council wants to make significant changes to it. Mayor Bogosian recommended rescheduling the city Manager evaluation to January 19, 2000 in conjunction with the City Attorney evaluation. THERE WAS CONSENSUS OF THE COUNCIL TO APPROVE THE MASTER MEETING CALENDAR FOR 2000 AS AMENDED TO RESCHEDULE THE CITY MANAGER EVALUATION TO JANUARY 19, 2000. 7. COUNCIL AGENCY ASSIGNMENTS AND COMMISSION LIAISONS Recommendation: Make selections. City Manager Perlin reported that a proposed resolution has been prepared listing the recommendations made by Mayor Bogosian for adoption this evening, if Council so desires. Councilmember Streit reported on: SASCC and their concerns about where to conduct their business during the construction phase of the Community Center; VTA PAC discussions regarding the use of Measure A and B funds. Councilmember Baker reported on: Emergency Planning Council and the availability of the report covering the Citywide exercise recently conducted; Santa Clara Cities Association induction of new officers and placement of their new Executive Director; the West Valley Sanitation District's annual report is now available. Mayor Bogosian reported on discussions of the North Central Flood Control Zone Advisory Committee regarding flood projects and the need for more funding and support from the citizens. 9. SELF EVALUATION OF PREVIOUS MEETINGS: NOV. 17 AND DEC. 1 Page 4 of 5 Minutes for City Council December 7, 1999 Adjourned Regular Meeting/ Councilmember Baker commented on the discussion regarding the Mt. Winery draft EIR and staff's comments fi:om the County Planning Commission meeting which they attended. Mayor Bogosian replied that he and Director Walgren attended the meeting. All of the points made by the Council at their December 1 meeting were expressed at that meeting. The County granted the City's request for an extension of the public comment period to January 15, 2000. City Manager Perlin recommended putting this item back on the January 5, 2000 agenda. City Attorney Taylor responded to some questions of the Council at the December 1st meeting regarding parking of Mt. Winery patrons on private property and the applicability of the City's septic abatement ordinance on the Mt. Winery project. Vice Mayor Mehaffey directed staff to provide this information to the resident on Vintage Lane who expressed concern about the Mt. Winery patrons parking on their private street at the December 1st meeting. Councilmember Waltonsmith commented she received a suggestion fi:om Parks and Recreation Commissioner Seroffto list the trails on the City's website. 10. OTHER Mayor Bogosian requested to agendize a discussion about the JPA concept for youth sports facility on December 15, 1999. Council concurred. Councilmember Baker announced today is Pearl Harbor Day. Councilmember Streit expressed thanks to City staff (Jim Martin, Rick Torres and David Ashby) for their assistance in setting up goal posts at Congress Springs Park for the recent AYSO Soccer Tournament. City Manager Perlin reported on the following: · Staff's holiday luncheon on Thursday, December 16, 1999; · West Valley cities rotate their membership on the VTA board in alphabetical order and it may be the City's mm, but he will confirm this and report back to the Council; · Animal Control IPA referred to in his memo (Lagniappe #99-8)\ ADJOURNMENT - Mayor Bogosian adjourned the meeting at 9:12 p.m. in memory of the people who died in Pearl Harbor.
