AN EMERGENCY ORDINANCE EXTENDING TERMINATION
DATE OF ORDINANCE ,NO. 3A-14 AND AMENDING ORD- INANCE NO. 3A-14 IN CONFORMITY THEREWITH
As an interim ~mergency and ~rgency measure and pursuant to Government
Code Section 65806 of the State of California, the City Council of the city
of saratoga does hereby ordain as follows:
Section 1:
Section 1.1: Anything to the contrary in Section 3 of Ordinance
No. 3A-14 notwithstanding, said Ordinance No. 3A-14
shall remain in full force and effect for an additional period of
sixty (60) days from and beyond the expiration of ninety (90) days
from the date of its passage and adoption, or u~til the adoption of
permanent architectural and site control regulations for the land
described in Exhibit "A" of said ordinance, whichever is the first in
time to occur.
Section 2:
.section 2.1: This ordinance is hereby declared to be an urgency and
emergency measure adopted to protect the public safety,
health and welfare, pursuant to Government Code Section 65806 of the
State of California, and shall be effective immediately upon its passage
and adoption. The facts constituting such urgency and emergency arel
as follows:
That. due to the time consumed in studies by the Planning Commission
on establishing certain architectural and site controls on all C-S
districts, itappears that more than ninety (90) days will elapse prxor
to the effective date of such permanent zoning ordinance establishing
permanent architectural and site control'provisions for C-S zones, and
it thus becomes necessary to prevent and prohibit the creation of any
uses which may be in conflict with such proposed ordinance presently
under study by said Planning Commission during the period. beyond the
expiration of said n~nety (90) days and the reasonably probable effective
date of such proposed ordinance.
Section 3: If any section, subsection,.sentence, clause or phrase of
this ordinance is for any reason held by a court of competent
jurisdiction to be invalid, such decision shall not affect the validity
of_the remaining portions of this ordinance. The City Council of the
City of Saratoga hereby declares that it would have passed this ordinance
and each section, subsection, sentence, clause and phrase thereof, irre-
spective of the fact that any one or more sections, subsectiOns, sentences,
clauses or phrases be held invarid or unconstitutional.
This ordinance was introduced as an urgency and emergency measure and was
passed and adopted at a regular meeting of the City Council of the City of
Saratoga held on the 20th day of July, 1960, by the following vote:
AYES: Brazil, Glennon, Drake, Langwill
