A TEMPORARY INTERIM ZONING ORDINANCE
PROHIBITING THE EXPANSION OF SINGLE-STORY
RESIDENTIAL DWELLINGS TO TWO OR MORE STORIES
WITHIN THE CITY OF' SARATOGA
WHEREAS, the Department of Planning in the City ~f Sarat'oga is in good
faith presently conducting and intends to further'conduct studies within a reason-
able time, and the Planning Commission in good faith intends to conduct studies
within a reasonable time for the purpose of holding hearings on and making
recommendations to the City Council on new zoning regulations relating to second
and multiple-story homes in R-1 Residential districts; and
WHEREAS, this Council is informed and believes and therefore states that
unless prohibited, &ertain persons, firms and/or corporations may expand and con-
vert exfsting single-story homes to two or more stories ~n the interim while said
studies are being conducted and hearings being held, which construction would then
be in conflict with such anticipated changes,
'NOW, THEREFORE, as aninterim urgency and emergency measure pursuant to
Government Code 65858 of the State of California and the police power of this
city, ~he City Council of the City of Saratoga does hereby ordain as follows:
Section 1: No'existing single-story residential or ~ccessory structure
located in an R-1 residential zoning district shall be
expanded to add any s~dond-story structure thereto or otherwise to increase
the existing height thereof, without priorly obtaining a use permit therefore
pursuant to Article 16[of Ordinance NS-3 of this city. The within prohibition
shall not be applicable to any such expansion for which a valid building permit.
has been issued prior to the effective date of this ordinance.
Section 2: This ordinance is hereby declared to be an urgency and emergency
measure adopted to protect the public health and welfare ~d shall
be effective immediately upon its passage and adoption. All the preambles of
~hi~ ?r~i~a~_ ~r~ h~re~ referred~to~and ~ncorporated ~o .t~i~._se~t~on__by_
reference .and shall constitute a statement of the facts constituting such
urgency..
Section 3: This ordinance shall remain mn full force and effect for a
period of four (4) months from the date of its 'adoption,' unless
otherwise extended by further action of t~is Council in accordance with the
laws ~pplicabl~ ~hereto;
Section 4: If any section, subsection, sentence, clause.or phrase of this
ordinance is. fOr any reason held by a cOUrt of competent juris-
diction to be invalid, such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council of the City'of Saratoga
hereby declares that it would-have passed this ordinance and eacb section, sub-
section, sentence, clause and phrase thereof, irrespective of the fact that any
one or more sections, snbsections, sentences, clauses or phrases~ be~ held in-
valid or unconstitutional.
Section 5: This ordinance was introduced as an urgency and'~mergency measure
and was passed'and adopted at a regular meeting.of the City
Council of the City of Saratoga,' held on ~he ~th day of October ,
1973 , by the following vote, which vote constitutes noc less than four-fifths (4/5)
vote of the entire City Council of the City of Saratoga.

NOES: Councilman Dwyer
