AN ORDINANCE EXTENDING TEMPORARY INTERIM
ZONING ORDINANCE 3E-6 FOR ONE YEAR PERIOD OF TIME
WHEREAS, on the 20th day of November, 1968, this CounCil
passed ~nd adopted Ordinahce 3E-8, relating to the general
prohibition of 'the installation overhead of utilities in all
zoning districts within the City of Saratoga, said Ordinance
being adopted pursuant to Government CodedSection 65858 gf the
State of California, and to last for a period .of ninety (90)
days, and
WHEREAS, the Planning Commission and Planning Department
of the City of Saratoga are still considering and studying, and
intend within a reasonable time from date hereof to continue the~
study of, the question of the prohibition of all future overhead
utilities, and proposed exceptions thereto, and in the opinion
of this Council it becomes necessary tO extend said interim zoning
ordinance for a period of time in the future,
NOW THEREFORE, the City Council Of the City of Saratoga
does hereby ordain as follows:
Section l: That certain Ordinance 3E-6, entitled "A
Temporary Interim Zoning Ordinance Prohibit-
ing Installation of Overhead Utj~lities in all Zoning Districts
Within The City of Saratoga", and passed and adopted as an
urgency and emergency measure by the City Council of the City of
, 19 8, to remain in full
Saratoga on the 20th day of November 6
force and effect for a period of ninety ('90) days from said date
of November 20, 1968, be and the same is hereby extended for a'
period of one (1) year from the expiration' of ninety (90) days
from November 20, 1968.
Section 2: If any section, subsection, sentence, clause
or phrase of this ordinance is for any reason
held by a court of competent jurisdiction to be invalid, such decision
shall not affect the validity of the remaining portions of this
ordinance. The City Council of the City of Saratoga hereby declares
that it would have passed this ordinance and each section, sub-
section, sentence, clause and phrase thereof, $rrespective of the
fact that any one or more sections, su~bs~ctions, sentences, clauses.
or phrases be held invalid or unconstitutional.
This ordinance was regularly introduced, and after public

hearing held thereon by the City Council o~,the City 0f Saratoga,
pursuant to notice in accord with Section'65858 of the Government
Code of the State of California, it was thereafter passed and
adopted at a regular meeting of said City Council held on the.
19th day of February , 1969, by the-following vo~e, which
vote constitutes no less than a ~/5 vote of the entire Council
of the City-of Saratoga: - "
