AN 0RDINM~CE PROVIDING PENALTIES FOR VIOLATION OF ALL
ORDINANCES NOT OTHERWISE SPECIFICALLY PROVIDED FOR
AND PRESCRIBING IMPRISONMenT OF ALL VIOLATORS IN
COUNTY JAIL.
The City Council of the City of Saratoga does ordain as "
follows:
SECTION l: Any-person, firm or Corporation violating a
City ordinance, unless a lesser penalty has
heretofore specifically been prdvided in the ordinance vio-
lated, or unless a'lesser penalty shall hereafter be specifi-
cally provided by any future ordinance which is violated, shall
be punishable by a fine of not more than Five Hundred ($~O0.OO)
Dollars or by imprisonment in the Santa Clara County jail for
a period not exceeding Six (6) mpnths, or by both such fine
and imprisonment. Each and every person, firm or corporation
shall be guilty of a separate offense for each and every day
during any portion of which any violation of any ordinance of
the City of Saratoga is committed, continued or permitted by
such.person, firm or corporation~ and shall be punishable
accordingly.
In addition to the penalties hereinabove pro-
vided, any condition caused or permitted to exist in viola-
tion of any provision of any ordinance of the City of Saratoga
shall be deemed a public nuisance and may be by this City
summarily ahated as such and each iy such condition continues
shall be regarded as a new and s~parate offense.
SECTION. 2~.. Imprisonment for violation of any City
ordinance shall;be in the Santa Clara
County jail. '
SECTION. 3: if any section, sub-section, sentence, clause
or phrase of this Ordinance is for any reason
held by a court of competent jurisdiction to be invalid or
unconstitutional, such decision shall not effect the validity
of the remaining portions of this Ordinance. The City Council
of the City of Saratoga here~y declares that it would have
passed this Ordinance and each section, sub-section, sentence,
clause and phrase thereof, irresp~ective of the fact that any
one or more sections, sub-section:s, sentences, clauses or
phrases be held invalid or unconstitutional.
This Ordinance was regularly introduced and after th~
