AN ORDINANCE CALLING A SPECIAL ELECTION IN THE CITY OF
SARATOGA FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS
OF SAID CITY FOUR PROPOSITIONS OF INCURRING BONDED
INDEBTEDNESSES OF SAID CITY FOR THE ACQUISITION,
CONSTRUCTION AND COMPLETION OF CERTAIN MUNICIPAL
IMPROVEMENT~ DECLARING THE ESTIMATED COSTS OF EACH
OF SAID IMPROVEMENTS, THE AMOUNTS OF THE PRINCIPAL
OF EACH OF SAID INDEBTEDNESSES TO BE INCURRED THEREFOR,
AND THE MAXIMUM RATE OF INTEREST TO BE PAID THEREON~
FIXING THE DATE OF SAID ELECTION, THE MANNER OF HOLDING
THE SAME, AND PROVIDING FOR NOTICE THEREOF
GENERAL OBLIGATION BONDS OF 1963
The City Council of the City of Saratoga does ordain as follows:
WHEREAS, the City Council of said City of Saratoga~ by Resolution
No. 154, passed and adopted at a regular meeting of said Council on
June 19, 1963, by the affirmative vote of more than two-thirds of all
of its members, did determine that the public interest and necessity
demended the acquisition, construction and completion of the municipal
improvements hereinafter mentioned~ and did further determine that
the costs of said proposed municipal improvements will be too great
to be paid out of the ordinary annual income and revenues of said
City and that said indebtednesses, and each of them, will require an
expenditure of funds greater than the amount allowed for it by the
· annual tax levy of said City;
NOW, THEREFORE, IT IS ORDERED, as follows:
1. A special municipal election be, and is hereby, called and
ordered and will be held in the City of Saratoga on Tuesday, the 17th
day of September, 1963, at which election shall be submitted to the
qualified electors of said City the questions of incurring the bonded
indebtednesses by said City for the objects and purposes set forth
in the following propositions, to wit:
PROPOSITION NO. 1 "Shall the City of Saratoga incur a bonded
(Pedestrian indebtedness in the principal amount of
Traffic Ways) Three Hundred Ninety Two Thousand Dollars
($392,000) in accordance with the provisions
of the Ordinance of said City calling the
election at which this proposition is sub-
mitted~ for the acquisition of lands and
easements for pathways along city streets
and elsewhere in the City~ and any other
improvements necessary for their use as
pedestrian traffic ways, and all work
auxiliary thereto and necessary to complete
the same?"
PROPOSITION N0.2 ~lShall the City of Saratoga incur a bonded
(Park Sites) indebtedness in the principal amount of
Four Hundred Ninety Thousand Dollars
($490,000) in accordance with the provisions
of the Ordinance of said City calling the
election at which this proposition is sub-
mitted, for the acquisition of lands for
park sites, and all work necessary and
auxiliary thereto to complete the acquisi-
tion of same?"
PROPOSITION N0.3 "Shall the City of Saratoga incur a bonded
(SWimming Pool indebtedness in'the principal amount of
Facilities) One Hundred Thirty Eight Thousand Dollars
($138,000) in accordance with the provisions
of the Ordinance of said City calling the
election at which this proposition is sub-
mitted, for the acquisition, construction
and completion of a combined Olympic and
instructional swimming pool and facilities
for swimming and diving purposes on the
Saratoga High School property~ together with
site improvements and other works or struc-.
tures necessary or convenient therefor~ and
all work auxiliary thereto and necessary to
complete the same?"
PROPOSITION NO. 4 "Shall the City of Saratoga incur a bonded
(Library) indebtedness in the principal amount of
Two Hundred Fifty Five Thousand Dollars
($255~000) in accordance with the provisions
of the Ordinance of said City calling the
election at which this proposition is sub-
mitted, for the acquisition, construction
and completion of a library on the Civic
Center Site on Fruitvale Avenue, including
site clearing and development, buildings,
furniture, furnishings, equipment and
appurtenances, and all work auxiliary there-
to and necessary to complete the same?"
2. The estimated cost of the municipal improvements set forth
in each proposition and the amount of the indebtedness to be in-
curred therefor, incidental to or connected with the authorization,
issuance and sale of the bonds, including legal and other fees, costs
of printing the bonds and other costs and expenses incidental to or
connected with the issuance and sale of the bonds therefor is as
follows:
Proposition No. 1, the sum of $392,000
Proposition No. 2, the sum of $490,000
Proposition No. 3, the sum of $138,000
Proposition No. 4, the sum of $255,000
3. Said Council does hereby submit to the qualified electors
of said City of Saratoga, at said special municipal election, this

Ordinance and the said propositions set forth in Section 1 hereof.
The said Council proposes to issue and sell bonds of said City in
the amount and for the objects and purposes specified in said
propositions, or any of them~ if two-thirds of the qualified elec-
tors voting on each of such propositions, at said special municipal
election, shall vote in favor thereof.
4. If two-thirds of the qdalified electors voting on any of
said propositions shall vote in favor thereof, said proposition
shall be deemed adopted. Said bonds shall be negotiable in form
and of the character known as serial, and shall bear interest at
a rate not exceeding six per cent (6%) per annum, payable semi-
annually, except that interest for the first year after the date of
the bonds may be made payable at the end of said year.
5o Said special municipal election shall be held and con-
ducted and the votes thereof canvassed, and the returns thereof
made~ and the results thereof ascertained and determined as herein
provided~ and in all particulars not prescribed by this Ordinance
said election shall be held as provided by law for the holding of
municipal elections in said City.
6. For the purpose of holding and conducting said special
municipal election there shall be eleven (11) precincts consisting
of consolidations of Santa Clara County election precincts as last
established by the Board of Supervisors of the County of Santa Clara
for the conduct of State and County elections. Their descriptions,
the polling places designated therefor, and the election officers
to conduct said election are as follows:

designated as Precinct Numbers 4677, 4678, 4679 and 4680, inclusive,
as established by the Santa Clara County Board of Supervisors:

7. All persons qualified to vote at municipal elections in
said City upon the date of the election herein provided for shall
be qualified to vote upon the proposition submitted at said special
municipal election.
8. Ballots for said election shall be provided of the form and
to the number provided by law. On said ballots, in addition to any
other printed matter which may be required by law, two voting squares
shall be set off to the right of each of said propositions submitted
at said election, in the manner provided by law, one having the word
"Yes" printed before it and the other having the word "No" printed
before it.
9. Each voter may vote on each of the propositions hereby sub-
mitted. Each voter, to vote for a proposition, and for incurring the
bonded indebtedness thereof, shall stamp a cross (X) in the blank
space opposite the word "Yes" on the ballot to the right of said
proposition, and to vote against a proposition, and against incurring
the bonded indebtedness thereof, shall stamp a cross (X) in the blank

space opposite the word "No" on the ballot to the right of said
proposition.
10. The polls shall be opened at 71:O0 o'clock A.M. of said day
and shall be kept open until 7:00 o'Slock P.M. of said day when the
polls shall be closed, except as to voters in line as provided in
Section 14436 of the Elections Code.
11. The City Clerk is hereby authorized and directed to procure
supplies necessary for the proper conduct of said election.
12. This Ordinance shall be published once a week for two suc-
cessive weeks in the Saratoga News, a newspaper of general circula-
tion printed and published less than six (61 days a week in said
City~ and such publication shall constitute notice of said election.
No other notice of the election hereby called need be given.
13. This Ordinance, being an Ordinance calling and ordering an
election, shall take effect immediately upon its adoption.
