WHEREAS the City Council has determined, upon the basis of an engineering and traffic survey, that a speed greater than 25 miles per hour would facilitate the orderly movement of vehicular traffic on the hereinafter described portion of public street within this City, and a 35 miles per hour prima facie speed limit would be reasonable and safe upon the same~ and this Council hereby determines that a prima facie speed limit of 35 miles per hour is hereby established for the hereinafter described portion of public street in this City~ NOW, THEREFOI~E, the City Council of the City of Saratoga does ordain as follows: Secti.on l: There is hereby added to Section 9.51 (b) of the Saratoga City Code, which section establishes a 35 miles per hour prima facte speed limit, the following portion of the following street: Name. of.St.r~.et Descrip~ion Quito Road From its intersection on the North with Saratoga Avenue, to its inter- section at the South with Pollard Road including only those portions of highway within the City. .Secti.op 2: If any section, subsection, sentence, clause or phrase of this ordinance is for auy reason held by a court of competent juris- diction to be invalid~ such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Sara- toga hereby declares that it would have passed this ordinance and each sec- tion~ subsection~ sentence, clause and phrase thereof~ irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be held invalid or unconstitutional. Se.ction 3: This ordinance shall be in full force and effect thirty (30) days after the date of its passage and adoption.
