Meeting, ~10/20~82 ORDINANCE NO. 38.107 AN ORDINANCE OF THE CITY COUNCIL.OF THE CITY OF SARATOGA AMENDING ARTICLE ~, ARTICLE.VI AND CREATING~ARTICLE VII OF CHAPTER'TWO OF THE MUNICIPAL CODE The Clty Council of'the City of Saratoga does hereby.o~dain as follows: SECTION I: Article V, Chapte~ Two of the Saratoga City C~de hereby amended to read as follows: Article V.,. Planning.Commission -Sec'. 2-40. Created; composition;. method of appointment; and method of removal..' ~ There is hereby c~eated a Plannin~ Commission which shall consist of se~en'members~to'be appointed by the M~yor-with the approval of'the~Ci'Ey Council. The c~.t~'-Council shall have the power to remove a Planning Com~issioner'~by a s~mple majority ,vote of the~i'.~o~cil' irrespeetive of.whether"th~"full Council is present'or voting. SECTION II: Article.VI o~ C~apter Two of the'Saratoga City Code is hereby amended to read as fo~lows:~ Artic.le VI. Other City Commission Sec. 2-44. Appointed Commissions. The City Council from time to time'may. find it necessary to appoint a Commisslon or adVi~6r~y body to assist the City= Council in fulfilling'its obligations.' .Sec.,2-45. Created;.composit~on; method of appointmeht.- All specia~.dommissibns or,.~dvisgry comIeittees shall be appointed by resolution of the City Council~,.the durati6n of said Cor~mission or Committee, the organization of th~ members and the.number of Commissioners shall be determined'by the Council. The Mayor sh~ll have the authority to appoint-with the-authority of the City Council and the removal procedures for individuals participa~'ing on the committee shall be by. a s~mple majority vote of the City Council. Ar~i~l~ VII. Special Gas Tax Street Improvement Fund. t. For state law relativ~ to Special Gas Tax Street Improvement Fund, see Sts~ & H. S., & 196. As to shbdivision regulations, see Appx~ A of this volume. = As to zoning regulations, see Appx. B of this volume. Sec. 2-~. Created. A special fund'is.hereby created in the city treasury to be k~Own as the Special Gas Tax Street Impr6vement Fund. (Ord. No. 10, & 1.)' Sec. 2-~;5., Payments into fund. All money received by the city from the state under the provisions of the State. Streets and Highways Code for the acquisition of real property or interest therein or for. the construction, maintenance or improvement of streets or highways'other than state highways, shall be paid into the Special Gas Tax Street Improvement Fund. '(Ord. No. 10, & 2) .2~ sec -6. Expenditur'es. All ~oney in the special fund under this article shall be expended exclusively for the purposes authori"zed by, and subject to, all the provisions of Sections 192 to 207 of the Streets and Highways' Code of the state. (Ord. No. 10, & 3) The foregoing Ordinance was regularly introduced and after the waiting time required by law was thereafter passed and adopted at a regular meeting of the City Council of the City of S&ratgga held on the 3rd day of November , 1982, by the following vote: AYES: Councilmsnbers Clevenger, Fanelli, Mallory, Foyles, and.MayorCallon NOES: None ABSENT: None ABSTAIN: None · /~.'
