HomeMy WebLinkAbout38.12.1 NCE ND, 38,12,1 AN ORDINANCE OF THE CITY OF SARATOGA ~ AMENDING THE SARATOGA CITY CODE, BY AMENDING ARTICLE VI OF CHAPTER 4 THEREOF, RELATING TO COMMUNITY ANTENNA TELEVISION SYSTEMS BEING FULLY UNDERGROUND The City Council of the City of Saratoga does hereby ordain as follows: Section 1: Section 4-210 of Chapter 4 of Article VI of the Saratoga City Code is hereby repealed. SectiOn~2:.~A new Section 4-210 is herRby added to' Chapter 4 of Article VI of the saratoga City Code, to read as follows: ~ Section 4-210 LOCATION OF PROPERTY OF GRANTEE: (a) ~All wires, cables, cable lines, conduits, and other transmission and distribution facilities of the GATV system, from the headend to the home of each subscriber, including without limitation all service drops, shall be located and installed completely underground~ subject to'the exceptionsI- as hereinafter set forth. Junction boxes, meters, meter cabints, and amplifiers in or along Grantee's transmission.' and/or distribution lines may be i~ appropriate houses upon the surface of the ground'as approvpd by the Director of Public Works. (b) Insofar as practicable, all Underground transmission and/or distribution facilities located within the right-of-way of any public street, or any privately owned areas within the City which have not yet become public streets but which are designated or delineated as proposed public streets, shall be installed in such portion of the right-of-way as is not covered with pavement; and in all events the same shall be constructed and installed only at such Iocations and in such manner as shall be approved by the Director of Public Works acting in the exercise of his reasonable discretion. (c)The provisions of this Se~tion'shai! apply regardless of any inference to the contrary in the other provision of this Article. Section 3: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held illegal, invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. The Council hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause, and phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared illegal, imvalid or unconstitutional. Section 4: This ordinance shall be in full force and effect thirty (30) days after the date of its passage and adoption.
