HomeMy WebLinkAbout38.124 ORDINANCE NO. 38.124 AN ORDINANCE OF THE CITY OF SARATOGA AMENDING SECTIONS 10-2, 10-3~ and 10-5 OF ARTICLE I OF CHAPTER 1O OF THE SARATOGA CITY CODE PERTAINING TO CURFEW REGULATIONS The City Council of the City of Saratoga does hereby ordain as follows: SECTION 1: Section 10-2 of Article I of Chapter 9 of the Saratoga City Code is hereby amended to read as follows: "Section 10-2. Loitering - Persons Under 18 Years of Age. It shall be unlawful and an infraction for any person under the age of 18 years to remain, stay, tarry or loiter in or upon any public street, avenue, highway, road, alley, park, playground or place of amusement or entertainment, vacant lot, or other unsupervised place, between the hours of 10:00 p.m. and 5:00 a.m. of the following day, unless such person is accompanied by a parent, guardian or other responsible adult having control or custody of such minor. SECTION 2: Section 10-3 of Article I of Chapter 10 of the Saratoga City Code is hereby amended to read as follows: "Section 10-3. Same - Responsibility of Parents & Guardians. It shall be unlawful and an infraction for any parent, guardian or other adult person having the control, custody or care of any minor under the age of 18 years to permit, allow, or let such minor violate of Section 10-2 of the Saratoga City Code." SECTION 3: Section 10-5 of Article I of Chapter 10 of the Saratoga City Code is hereby amended to read as follows: "Section 10-5. Same - Penalties. Each violation of the provisions of Sections 10-2 or 10-3 shall constitute a separate offense. Any minor violating the provisions of Section 10-2 shall be dealt with pursuant to the provisions of Chapter 2 of Part I of Division 2 of the Welfare & Institutions Code of the State of California. Any parent, guardian or other adult person violating Section 10-3 shall, upon conviction thereof, be fined $100.00 for the first conviction, $200.00 for a second Rev. 10/17/84 -1- conviction within a period of one year, and $500~00 for a third or subsequent conviction within a period of one year." SECTION 4: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held by a court of competent jurisdiction to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Saratoga hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause and phrase thereof, irrespective of the fact that any one or more sections, subsections, clauses or phrases may be held invalid or unconstitutional. SECTION 5: This Ordinance shall take effect and be in full force and effect , thirty F~'days from and after the date of its passage and adoption.
